Ordinance 2000-054ORDINANCE NO. 2000- 54 AN ORDINANCE, AMENDING COLLIER ORDINANCE NO. 87-25, BY REVISING SECTION PROVIDING FOR INCLUSION IN THE CODE OF LAWS ANI ORDINANCES; PROVIDING FOR CONFLICT SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. establishing the Collier County Purchasing Department and providing definitions, providing for duties and and authority of the Purchasing Director, providing for conflict of interest, providing for procedure for the adoption of a purchasing policy, and providing for changes and amendments to Purchasing Policy; 25. WHEREAS, on August 1, 2000 staff obtained permission from the Board of County Commissioners to amend Ordinance No. 87-25, by amending Section Five thereof. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: AMENDMENT TO SECTION FIVE OF COLLIER COUNTY ORDINANCE NO. 87- SECTION FIVE of Collier County Ordinance No. 87-25 is hereby amended as folioK SECTION FIVE - CONFLICT OF INTEREST. = No officer of the County shall contract with or have any business dealings witlir~t~e C~:~nty~,~. whereby they may derive income or benefits other than those provided as remunera~fro~the~ ~ " County for their employment. However, no officer or employee of the Cou~sh~ be prohibited from purchasing, at public auction authorized by law or pursuant to procedures outlined in Section 274.06 Florida Statutes, Surplus Property Alternative Pr~edures, used goods or materials from the County on the same basis as are all other members of the public. Sale of su~lus go~s or materials as outlined above shall ~ subject to the approval of the Board of County Commissioners prior to implementation. Further, the County may purchase from any employee or officer any real or personal property owned by such officer or employee which it is determined to be needed for County business, provided that the consideration paid for such property d~s not exceed its fair market value. SECTION TWO: ~CLUSION IN T~ CODE OF LAWS AND ORDNANCES. The provisions of this Ordinance shall become and be made a pa~ of the C~e of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renum~red or re-lettered to accomplish such, and the word "ordinance" may ~ changed to "section," "article," or any other appropriate word. Words underlined are added; Words Strazk T~raag~ are deleted. WHEREAS, the Board of County Commissioners adopted Collier County Ordinance No. 87-25, SECTION THREE: CONFLICT AND SEVERABILITY. In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR: EH~ECTIVE DATE.
