ORDER OF THE SPECIAL MAGISTRATE IMPOSING FINES/LIENS THIS CAUSE came before the Special Magistrate for public hearing upon the Petitioner's Motion for Imposition of Fines/Liens on May 2, 2008, and the Special Magistrate, having heard argument respective to all appropriate matters, hereupon issues its Findings of Fact and Order of the Special Magistrate, as follows: FINDINGS OF FACT 1. On November 16, 2007, Respondent(s) was/were found guilty of violation of Ordinance No. 04-58, Sections 6, Subsections 12f, 12g, 12h, 12i, 12n and 15, for minimum housing violations within Collier County, which violation occurred on the property located at 31 Ocho Rios, Naples, FL 34114, Folio #68341280000. 2. An Order was entered by the Special Magistrate ordering Respondent(s) to pay operational costs in the amount of$251.03 and to pay fines of$250 per day for failure to comply with the terms of the Order. (A copy of the Order is recorded at OR 4308, PG 3929 and attached hereto). 3. No Request for Re-hearing or Appeal pursuant to Ordinance 07-44 has been timely filed. 4. Respondent(s), having been duly noticed for the public hearing regarding the County's Motion, appeared at the public hearing and gave testimony regarding mitigating circumstances preventing timely compliance. 5. The violation has been abated. ORDER Based upon the foregoing Findings of Fact and pursuant to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No.07-44, it is hereby ORDERED: A. Petitioner's Motion for Imposition of Fines/Liens is granted. B. Respondent is ordered to pay previously assessed operational costs of$251.03. C. Fines of$33,750.00 which accrued for 135 days for the period between November 24, 2007 and April 7, 2008, are hereby waived due to Respondent's abatement. D. Respondent is ordered to pay all outstanding costs in the total amount of$251.03 forthwith or be subject to Notice of Assessment of Lien against all properties owned by Respondent in Collier County, Florida. 1\41 DONE AND ORDERED this AA day of ,2008 at Collier County,Florida. Any release of lien or confirmation of compliance or confirmation of the satisfaction of the obligations of this order may also be obtained at this location. LIEN RIGHTS: This order will be recorded in the Public Records of Collier County. After three (3) months from the filing of any such lien or civil claim which remains unpaid, the Special Magistrate may authorize the County Attorney to foreclose on the lien or pursue collection on unpaid claims. In the event that outstanding fines are forwarded to a collections agency, the Violator will be responsible for those costs incurred by Collier County. APPEAL RIGHTS: Any aggrieved party may appeal a final order of the Special Magistrate to the Circuit Court within thirty (30) days of the execution of the Order appealed. An appeal shall not be a hearing de novo, but shall be limited to appellate review of the record created within the original hearing. It is the responsibility of the appealing party to obtain a transcribed record of the hearing from the Clerk of Courts.
