The Investigator shall prepare a report containing all the facts discovered that relate to the allegations, and submit said report to the Director. 8. 19 FINAL DETERMINATION 1. The County or EI''.S personnel policies take precedence over these rules in the event of a discrepancy or overlapping issues. 2. Upon receiving said report of the Director, with the advice of County Legal Counsel. The Director may : A. Consider all the facts contained therein. B. Confer with cognizant members of EMS, and or the EI'ISAC committee. C. Confer with the EMS member ( s ) accused of the alleged mis conduct, with or without additional EMS members present and with or without makina a record of any one or all of said conferences. D. At the conclusion of the above, decide the disposition of the allegations ) and indicate a decision, usinc one of the following choices as listed on the final disposition form : i. Unfounded - The complaint was not based on facts as shown by the investigation, or the reported incident did not occur. 2. Exonerated - The incident occurred, but the action taken by the member(s ) was deemed lawful and proper. 3. Not sustained - The allegation was supported by insufficient evidence which could not prove or disprove the allegation. 4. Sustained - The allegation was supported by sufficient evidence to justify disciplinary action against the member ( s) . E. The findings of the Director shall be recorded in the file and signed by the Director, and the Battalion Comd. F. Upon reaching a decision, the Director, with or without further consultation with EMS members, or the EMSAC committee unless they have been requested to review the incident, at the Directors discretion may : 1. Inform the State Attorney ' s Office when criminal acts may be involved. Cause the EMS member ( s) accused of the alleged misconduct to be informed of the findings. 3. Permit the members ) accused of the alleged misconduct to present oral or written responses to the charges. 4. Pursue disciplinary action under the Collier County_ Human Resources Policies and Procedure Manual. 5. Inform Battalion Comd and the member ( s ) supervisor of the above. 8. 2 11 INVESTIGATION RECORDS : A. EMS shall record the decision of the Director, along with the signatures of the Director and the assigned investigator in its file at the closing of documents and shall thereafter he relieved of further responsibility in the case, except for continuous maintenance of all files of its cases. B. EMS .=hall, subject to the Collie_ County Human Resources Policies and Procedure Manual, ensure that copies of final decisions concerning cases ar placed in member ' s personnel files if probable evidence was found and the aecaty on( s ) sustained. C. All records and files pertaining to EMS investigations shall be maintained under secure conditions within the EMS Office. D. The EMS will disseminate information regarding procedures to be followed in registering complaints against the EMS or its members and will publish statistical summaries of investigations annually for dissemination to the public and to EMS members. E. If the EMSAC committee have been requested to review an incident then the Chairman of the EMSAC committee will record the findings of the committee. 8. 2. 12 FINAL EMS COMPLAINT PROCEDURE In order to properly and promptly respond to complaints using the ground ambulance or aero-transport, levied against the EMS service, uniform procedures shall be followed in processing all complaints. : 1. All complaints levied must be reduced to written form, utilizing an authorized Consumer Issue Resolution (CIR ) i cn n ^^ ^ PAGE 7 form. 2. There shall be a set time period in which the complaint will be processed, and responded too, not to exceed six months. 3. All CIR forms shall be reviewed by a supervisor, agent or administrator, within the EMS department, signed and dated by all parties reviewing. 4. EMS personnel handling _IR complaints shall be given specific direction on how to process complaints to assure uniformity. 5. On a quarterly basis, the EMS department will report orally or in writing to the EMSAC on the number of CIR forms filed during that time period, the nature of the complaint, and the resolution if applicable. The CIR forms shall be made available to EMSAC should a need arise or a request be made. S. All complainants will be notified of their right to an appeal before the EMSAC, should they be dissatisfied with the outcome suggested by EMS. 7. All appeals to EMSAC must be in writing with a copy of the CIE attached, and a consent form signed by the patient, or authorized agent, to release information to EMSAC. S.
