Minutes 08/02/1983 ty ePs EMPLOYEE MEETING V August 2, 1983 In attendance at Employee Meeting - EMS Director: Doug Greenfield Chairman EMSEAC: Diane Flagg Members : Jeff Page, Dave Kitchen, Denny Hare Employees : Keith Teague, Jerry Montgomery, Pat Hedrich , Dale Ginter, Marty Ginter 1015 hrs . Employee Meeting - to discuss disciplinary review board - Opened by Diane Flagg to discuss outline attached to these minutes . 1045 hrs . Disciplinary review board outline discussed. One change was made on page 2 as noted . Jerry Montgomery asked about item 3 on page 1 , reference to limitations . Diane stated that limitations are related to any executive action taken by the Director. 1115 hrs . Diane stated that there will be a procedure for reporting administrative discrepancies to Doug Greenfield. These should go to Diane. A section of the operations manual will be devoted to this new policy. 1120 hrs . Discussion continued until the meeting was adjourned at 1155 hours. NOTE: The first meeting of the newly appointed disciplinary review board will be August 9, 1983, at 9:30 a.m. at Head- quarters . s EMPLOYEE ADVISORY COUNCIL 1155 hrs . EMSEAC Meeting - in atendance: Diane Flagg, Jeff Page, Bill Peplinski , Dave Kitchen, Denny Hare. Called to order by Diane Flagg for purpose of appointing members to the Disciplinary Board. The members are: Tom Maguire, Mark Willis, Dale Ginter Alternates : Bill Griffin, Terry Lichliter, Sue Keny These individuals were elected by a quorum of five EMSEAC members . 1300 hrs . Doug Greenfield stated that the supervisors are always super- visors for Collier County EMS whether in duty or off duty. This applies to enforcing S.O.P. and disciplinary actions . 1310 hrs . It was decided to hold the regular EMSEAC meetings on August 9, at 9 :30 a.m. and discuss old and new business . There will also be a meeting of the newly appointed disciplinary review board. All employee' s are urged to attend. 1315 hrs . Meeting was adjourned. NIP THE DISCIPLINARY REVIEW BOARD PURPOSE 1 . To consider measures related to the Operation Manual ' s Codes of Conduct, and the disciplinary actions taken for offenses committed, infraction of rules, or deficiencies of work which include investigations of specific accusations of misconduct. 2. To recommend administrative actions it seems appropri- ate for enforcing standards of conduct, concurrent with EMS policy. 3. It may investigate, subject to limitation, alleged violations of the codes of official conduct, rules , regulations or other standards of conduct applicable to employees in the per- formance of their duties. 4. No resolution may be made, unless approved by a vote of not less than four of the six members . In the event of a tie, the judgement will be in the employee' s behalf. 5 . The Board may act only upon receipt of a complaint presented to the EMSAC chairman in writing by the affected employee. No less than a written reprimand will be considered for review. The complaint must be submitted within seven calendar days of the notification of disciplinary action taken against the employee. 1 6. No member of the Board may participate in any proceeding relating to his or her own official conduct, the conduct of their spouse, or if EMSAC Chairman rules a conflict may exist. 7. It shall be the duty of each member of the Board to attend all sessions . In the event that a member is absent or is disqualified due to a conflict of interest, an alternate member appointed by the EMSAC chairman will take his or her place. 8. Any full-time (non-probationary) employee of Collier EMS may request a hearing. 9. Any employee under probation for a change in pay grade may request a hearing providing it is not directly related to their status in pay grade or the change of that status . FORM OF REVIEW 1 . Must be in writing and signed by the party or parties requesting review. 2. Contain a statement of the facts out of which the charges originated, and state the specific act or acts alleged to consti- tute misconduct, the dates , places and persons involved. 3. State the nature of the violation or violations alleged and refer to the established policies, decisions, rules or regula- tions it is alleged have been violated . 2 ✓ y RULES OF CONDUCT The Board shall consist of three employees appointed by the employees Advisory Council and three staff members appointed by the Director. Effective this date, the hearing shall be held within 14 days after written complaint from the employee has been received by the EMSAC chairman. For good cause shown, the employee may request a postponement of the date, subject to approval of the EMSAC chairman . Should the employee fail to appear for hearing, the original disciplinary action shall remain . The decision of the Board shall be by majority vote of its members and the action imposed shall be delivered in writing to all parties involved with copies to all personnel . Additional rules of procedure may be determined by the Board during the course of a hearing, if situations not covered by the rules adopted should occur. 3
