Ms. Potts testified on February 23, 2013 she parked her vehicle and placed the handicapped placard on the rear view mirror and entered the store to shop. When she returned she discovered the placard on the floor of the car and a citation placed on the windshield. She has a valid handicap parking placard. Officer Burd testified on the day of the incident, he observed a vehicle parked in a handicapped space without proper identification displayed. He surveyed the vehicle and did not see the placard on the floor of the vehicle and issued the citation. The Special Magistrate required the Respondent to pay the $5.00 Administrative Fee required for persons legally in posssession of a handicap parking placard, however not properly displaying it. Investigator Andresky represented the County and testified. • On 1/3/13 at 11:20 am he observed the irrigation system discharging water at Mr. Winschel's property. • The time allotted under the water restriction requirements for running the system is 12:00 a.m. to 8:00 a.m. for the day in question. • Based on the circumstances a citation was issued. April 5, 2013 Mr. Winschel was issued a previous citation on May 15, 2012 and paid the fine associated with the violation. Mr. Winschel testified: • He was not present the day of the incident and the system malfunctioned and discharged water at an "unscheduled" time. • He diagnosed the system, the timer was set correctly and could not determine any reason the system would malfunction. • The diagnosis was hindered by the fact the system had already ceased operation. • This past weekend, the incident occurred again, he was present and determined the timer is malfunctioning and in need of replacement. • He has terminated operation of the system until the repairs are completed. • The previous violation was due to his maladjustment of the timer to allow for the change to daylight savings time. • He requested the fines be waived due to equipment malfunction. The Special Magistrate informed Mr. Winschel he acknowledges the violation occurred and is requesting an exception to the rules. She expressed concern that the operation of the system was not terminated following the original incident until the problem was diagnosed, therefore allowing the system, on at least one occasion to discharge water at a time disallowed under current rules. April 5, 2013 Investigator Pulse testified: • On February 19, 2013 she conducted a site visit based on a neighbor complaint a shed was placed on the property in violation of County's setback requirement of 10 feet from a property line. • In researching the records, no permit was identified allowing placement of the structure. • Aerial photos indicate the shed was placed on the property between 1989 —1994 as it appears on the 1994 aerial photo, but not the 1989 photo. • Given the circumstances of the investigation, a violation was issued. Mrs. Fitz- Gerald testified: • The neighbor complaint was in response to a complaint she filed regarding debris on the neighbor's property. • The shed has been located on the property for more than 30 years. • She and her late husband placed the shed on the property in the late 1970's or early 1980's. • She and her husband met in person with an employee of Collier County at Horseshoe Drive prior to placing the shed. • The employee reviewed the codes in effect at the time and informed them "no permit was required to place the shed" as there was no concrete slab associated with the construction. • The 1989 aerial photo indicates a large tree located on the neighbor's property line and it impedes the view of the shed. The tree was subsequently removed before the 1994 aerial photo was taken. • She cannot locate the original receipt from purchase of the shed, nor documentation of the meeting.
