A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA
CLOSING TWELVE (12) APPROVED PLANNED UNIT
DEVELOPMENTS: AIRPORT PLAZA, DaVINCI ESTATES IN
OLDE CYPRESS, GLEN EDEN ON THE BAY,
LAURELWOOD, MADIERA, PARK CENTRAL NORTH, PINE
RIDGE MIXED USE CENTER, TARPON COVE,
TIMBERWOOD, WHITTENBERG, WHITTENBERG
ESTATES, AND WILLOUGHBY GARDENS, WHICH HAVE
FULLY COMPLETED DEVELOPMENT PURSUANT TO
THEIR DEVELOPMENT ORDERS AND/OR HAVE BEEN
FOUND BY COLLIER COUNTY TO BE COMPLIANT WITH
THEIR SPECIFIC DEVELOPER COMMITMENTS.
WHEREAS, it is in the mutual interests of the herein named Planned Unit
Developments and Collier County to close out the Planned Unit Developments so that annual
reporting obligations on behalf of the Planned Unit Developments and review of those reports
by the County will become unnecessary upon approval of this Resolution; and
WHEREAS, five of the herein named Planned Unit Developments have explicitly
complied with each and every developer commitment (Glen Eden on the Bay, Laurelwood,
Madiera, Park Central North, and Timberwood); and
WHEREAS, a review of the remaining seven Planned Unit Developments revealed
potential incomplete commitments which have been found to be no longer necessary; and
WHEREAS, Section 10.02.13.F.5 requires that a release of PUD commitments
determined to be no longer necessary be approved by the Board of County Commissioners.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: the following Planned
Unit Developments within Collier County are found to be "built-out" and therefore are
deemed "closed out" for purposes of the Land Development Code, Section 10.02.13.F:
Airport Plaza (Ord. 95-68), DaVinci Estates in Olde Cypress (Ords. 00-11, 01-36), Glen Eden
on the Bay (Ord. 99-03), Laurelwood (Ord. 94-63), Madiera (Ord. 00-80), Park Central North
(Ord. 01-48), Pine Ridge Mixed Use Center (Ords. 81-80, 92-79, 93-06, 98-27), Tarpon Cove
(Ord. 95-76), Timberwood (Ords. 85-62, 88-21), Whittenberg (Ords. 92-58, 96-44),
Whittenberg Estates (Ords. 99-20, 00-07), and Willoughby Gardens (Ord. 81-67).
