A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA RELATING TO PETITION VAC-
PL20120002668 TO DISCLAIM, RENOUNCE AND VACATE THE
COUNTY AND THE PUBLIC INTEREST IN A PORTION OF A 15-FOOT
WIDE DRAINAGE EASEMENT, BEING A PART OF LOTS 77 AND 78,
QUAIL WEST PHASE III, UNIT 7, PLAT BOOK 46, PAGES 89
THROUGH 102 OF THE PUBLIC RECORDS OF COLLIER COUNTY,
FLORIDA, BEING A PART OF SECTION 8, TOWNSHIP 48 SOUTH,
RANGE 26 EAST, COLLIER COUNTY, FLORIDA BEING MORE
SPECIFICALLY SHOWN IN EXHIBIT A.
WHEREAS, pursuant to Section 177.101, Florida Statutes, and Resolution 2006-160,
Petitioner, Alexis Crespo, of Waldrop Engineering, P.A., has requested the vacation of the
County and the public interest in a portion of a 15-foot wide Drainage Easement, being a part of
Lots 77 and 78, Quail West Phase III, Unit 7, Plat Book 46, Pages 89 through 102 of the Public
Records of Collier County, Florida, also being a part of Section 8, Township 48 South, Range 26
East, Collier County, Florida, being more specifically described in Exhibit A; and
WHEREAS, at its February 26, 2013 regular meeting, the Board of Commissioners, via
Resolution No. 2013-43, approved the scheduling of a public hearing on March 26, 2013,
pursuant to Section 177.101, Florida Statutes, and Resolution 2006-160; and
WHEREAS, the Board of County Commissioners, on this day, held a public hearing to
consider the petitioner's request and notice of said public hearing was given as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest in a
portion of a 15-foot wide Drainage Easement, being a part of Lots 77 and 78, Quail West Phase
III, Unit 7, Plat Book 46, Pages 89 through 102 of the Public Records of Collier County, Florida,
being a part of Section 8, Township 48 South, Range 26 East, Collier County, Florida as
specifically depicted in Exhibit A, is hereby vacated, extinguished, renounced and disclaimed,
and this action is declared to be in the public interest and for the public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the Public Records and to make proper
notation of this Resolution on the plat recorded in Plat Book 46, Pages 89-102 of the public
records of Collier County, Florida.

DRAINAGE EASEMENT
THIS DRAINAGE EASEMENT is granted and conveyed this c 4 'day of
2013, by Q UAIL WEST HOLDINGS, LLC, a Florida limited liability comp which has a
mailing address of 2647 Professional Circle, Suite 1201,Naples, FL 34119, (hereinafter referred
to as "Grantor") to the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY, AND AS THE EX-
OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT,
its successors and/or assigns, which has a mailing address of 3299 East Tamiami Trail, Naples,
FL 34112,(hereinafter referred to as"Grantee").
Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and their respective, heirs, legal representatives, successors or assigns.
WITNESSETH: That the Grantor for and in consideration of the sum of ten dollars($10.00) and
other valuable consideration paid by Grantee, the receipt and sufficiency of which is hereby
acknowledged by Grantor, hereby conveys, grants,bargains and sells unto Grantee, its successors
and assigns, a perpetual, non-exclusive easement for drainage facilities, access and maintenance
purposes with no responsibility for maintenance, on the following described lands located in
Collier County, Florida,to wit:
Said lands are legally described in Exhibit"B".
Attached hereto and incorporated by reference herein.
Subject to easements,restrictions and reservations of record.
This is not homestead property.
TO HAVE AND TO HOLD the same unto the Grantee, its successors and/or assigns, together
with the right and privilege to enter upon said land to excavate, relocate and/or take and/or
introduce materials, including but not limited to,water lines and pipes, well pumps and raw water
wells, and other equipment or improvements appurtenant thereto or thereunder for the purpose of
constructing, reconstructing, operating, relocating, repairing and/or otherwise maintaining the
subject drainage facilities and/or systems(s) or portion(s) thereof, in, on over and/or under the
easement area. The easement area granted herein shall constitute easements running with the
land and shall burden the lands described above. Grantor and Grantee are used for singular or
plural, as the context allows.

MORTGAGEE JOINDER,CONSENT AND SUBORDINATION
For Ten Dollars($10.00)and other good and valuable consideration,the adequacy and receipt of
which are hereby acknowledged, REGIONS BANK, Alabama banking corporation, the owner and
holder of a mortgage given by QUAIL WEST HOLDINGS, LLC, a Florida limited liability
("Grantor") to REGIONS BANK, an Alabama banking corporation ("Mortgagee"), encumbering the
real property described in that certain Mortgage and Security Agreement dated May 17, 2012, and
recorded May 18, 2012, in Official Records Book as Official Instrument No. 2012000111700, of the
Public Records of Lee County, Florida, and also recorded May 18, 2012, in Official Records Book 4798,
Page 2208, of the Public Records of Collier County, Florida, together with that certain Collateral
Assignment of Leases, Rents and Contract Rights dated May 17, 2012, and recorded May 18, 2012, in
Official Records Book as Official Instrument No. 2012000111701,of the Public Records of Lee County,
Florida, and also recorded May 18, 2012, in Official Records Book 4798, Page 2228, of the Public
Records of Collier County, Florida,together with that certain UCC-1 Financing Statement recorded under
ORI No. 2012000111702, and re-recorded under ORI No. 2012000139819,both of the Public Records of
Lee County, Florida, and also recorded in Official Records Book 4798, Page 2239, and re-recorded in
Official Records Book 4810, Page 2785, both of the Public Records of Collier County, Florida, together
with that certain Collateral Assignment of Developer Rights recorded May 18, 2012, under ORI No.
2012000111718, of the Public Records of Lee County, Florida, and also recorded May 18, 2012, in
Official Records Book 4798, Page 2243, of the Public Records of Collier County, Florida, and as may be
otherwise amended (hereinafter collectively referred to as the "Mortgage"), hereby joins in, consents to
and subordinates the lien of its Mortgage to that certain Drainage Easement to which this document is
attached ("Easement") which is executed by Grantor, in favor of Collier County, Florida, with the intent
that the Mortgage shall be subject and subordinate to the Easement.
