RIGHT OF ENTRY
KNOW ALL MEN BY THESE PRESENTS that JUAN GALARZA, a married man, joined by his spouse, GLADYS
GALARZA, whose post office address is 4020 18th Ave SE, Naples, Florida 34117, hereinafter known as "Grantor",
for and in consideration of Ten Dollars ($10.00) and other valuable consideration to them in hand paid, do
hereby grant unto COLLIER COUNTY, a political subdivision of the State of Florida, its successors or assigns,
whose post office address is 3335 Tamiami Trail East, Suite 101, Naples, Florida 34112, hereinafter known as
"Grantee", the temporary license and right to enter upon the lands of the Grantor, as described below, which
is made a part hereof, to place or remove materials in order to reinforce Grantor's driveway, including but not
limited to, gravel or other similar material, appurtenant thereto for the purpose of maintaining a designated
driveway thereon for use by Collier County and/or its agent Waste Management Inc. of Florida as a turnaround
facility for bi-weekly pick-up of solid waste, garbage, refuse and recycling at 4020 18th Ave SE, Naples, FL. Such
is part of the Designated Driveways project which is being performed throughout Collier County to ensure long-
term reliability of turnaround locations.
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument and its
respective heirs, legal representatives, successors or assigns. regardless of the number and gender in which
used, shall be deemed,to include any other gender or number as the context or the use thereof may require.)
ALL RIGHT AND PRIVILEGE herein granted shall remain in full force and effect on the lands of the Grantor
described herein until the earlier of the following: 1) terminated in writing by the Grantor, its successors and
assigns; 2) the construction and permitting of a turnaround within the right-of-way at the west end of the road;
or 3) three years from the date hereof,whichever occurs first. This Right of Entry shall run with the land.
The West 150 feet of Tract 106, GOLDEN GATE ESTATES, UNIT NO. 86, according to the map or
plat thereof as recorded in Plat Book 5, Page 25, of the Public Records of Collier County, Florida.
ADDITIONALLY, the rights and interest granted hereunder are conditioned upon the reasonable exercise
thereof by Grantee. Grantee agrees not to unreasonably interfere with Grantor's use of the lands described
herein, and agrees to provide Grantor with advance notice when exercising its rights hereunder. Grantee
further agrees that it shall, at the Grantee's cost, repair any surface damage caused to Grantor's property as a
result of Grantee's exercise of its rights hereunder.
