Relating to Petition Number V-85•SC•for a variance of property hereinafter
described in Collier County, Florida.
INOCR=AS, the legislature of the State of Florida in Chapter 123.
'.,. Florida Statutes, has conferred on all counties in Florida the power to
establish, coordinate and enforce Boning and such business regulation. ea
are necessary for the protection of the public, and
WHEREAS, the County pursuant thereto has adopted a Comprehensive
Zoning Ordinance establishing regulations for the zoning of particular
geographic divisions of the County, among which is the granting of
variances, and
WHEREAS, the Board of Zoning Appeals being the duly elected con-
stituted board of the area hereby affected, has held a public hearing
after notice as in said regulations made and provided, and has considered
the advisability of a variance from the required parking spaces of 42
spaces to 40 spaces in a C-4 tone for the property hereinafter described.
and ha. found as a matter of fact that satisfactory provision and
arrangement has been made concerning all applicable matters required by
said regulation. and in accordance with Section 11.1.b of the Zoning
Regulations for the unincorporated area of Collier County, and
WHEREAS, all interested parties have been liven opportunity to be
heard by this Board in public meeting assembled and the Board having
considered all matters presented,
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS of
"Collier County, Florida, that the petition V-85-SC petitioned by Midwest
Title Cairantee Company of Florida with respect to the property here-
inafter described as:
The S 100' of the North 300' of Block A, Sperling's
Subdivision, Unit One, Plat Book 4, Page 12, Public
Records of Collier County, Florida

be and the same hereby is approved for a variance of the toning district
wherein said property is located, subject to the following conditional:'
(1) The Petitioner, 'DOT and the County Engineer shall work
together to satisfactorily improve the 118-41 access. This way

features as agreed upon by all parties.
(2) The employer shall try to organise car pooling among his
employees.
(3) If • parking problem develops, due to the lack of parking
spaces. the Board of County Commissioners may require that the
10th Street access be closed and the required parking provided.
BE IT RESOLVED that this resolution relating to Petition Number
V-83-5C be recorded in the minutes of this Board.
