A RESOLUTION PROVIDING FOR AN AMENDMENT
TO RESOLUTION 90 -498 PERTAINING TO
DEVELOPMENT ORDER 90 -5 FOR THE HALSTATT/
GREY OAKS PUD TO CORRECT SCRIVENER'S
ERROR.
? WHEREAS, the Collier County Board of Commissioners
adopted Resolution 90 -498, pertaining to the adoption of
Development Order 90 -5 for the Halstatt /Grey Oaks PUD on
r October 16, 1990, and
WHEREAS, following said action adopting Resolution
90 -498 and Development Order 90 -5, staff was advised that
certain words had been omitted from Section 5, Subsection
d.(4) of said Development Order by mistake and constitutes a
scrivener's error.
NOW, THEI,.: ?ORE, BE IT RESOLVED by the Board of County
Commissioners of Collier County, Florida, that Resolution
90 -498, adopting Development Order.90 -5, is hereby amended to
add the words "apply for or" to the third sentence of Section
5, Subsection d.(4) so that said Subsection (4) now reads as
follows:
If an ASI is established for any deficient road
segment listed in Paragraph 5.b of this development
order that does not include the Halstatt /Grey Oaks
DRI, the DRI shall not apply for or be issued any
Certificate of Adequate Public Facility until the
Notice of Change decision is made by Collier
County, if neither DCA nor SWFRPC participates in
the public hearing on this Notice of Change
Pursuant to 380.06(19)(f) and the change is adopted
by Collier County, as proposed, or until any appeal
Of such decision to the Florida Land and Water
Adjudicator Commission is resolved.
IT FURTHER RESOLVED that this Resolution be recorded in
the minutes of this Board.
