Resolution 2012-195 RESOLUTION NO. 2012 - 195 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, RELATING TO PETITION VAC- PL20120001606, TO DISCLAIM, RENOUNCE, AND VACATE THE COUNTY AND PUBLIC INTEREST IN A PORTION OF STATE ROAD NO. 29 (COPELAND AVENUE SOUTH) BEING A 200-FOOT PUBLIC ROAD RIGHT-OF-WAY LOCATED IN SECTION 23, TOWNSHIP 53 SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA, MORE SPECIFICALLY SHOWN IN EXHIBIT A. WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes, petitioner, A. Rony Joel, has requested the vacation of the County and public interest in a portion of State Road 29, also known as Copeland Avenue South, being a 200-foot public road right-of-way, located in Section 23, Township 53 South, Range 29 East, Collier County, Florida, and more specifically described in Exhibit A; and WHEREAS, at its September 11, 2012 regular meeting, the Board of County Commissioners, via Resolution No. 2012-147, approved the scheduling of a public hearing pursuant to Section 336.09, Florida Statutes; and WHEREAS, the Board of County Commissioners, on this day, held a public hearing to consider the petitioner's request and notice of said public hearing was given as required by law; and WHEREAS, the granting of the petitioner's request will not adversely affect the ownership or right of convenient access of the property owners. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in a portion of State Road 29, also known as Copeland Avenue South, being a 200-foot public road right-of- way, as specifically depicted in Exhibit A, is hereby vacated, extinguished, renounced, and disclaimed, and this action is declared to be in the public interest and for the public benefit. BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby directed to record a certified copy of this Resolution in the Public Records of Collier County. Copeland Avenue South) right—of—way (having a width of 200 feet), according to the State of Florida, State Road Department Right Of Way Map, Section No. 0307-250, Road No. 29, Collier County, as recorded in Road Book 1, Page 30 of the Public Records of Collier County, Florida and which is more particularly as follows: Commencing at the Baseline of Survey P.T.
