A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, RELATING TO PETITION VAC-
PL20120001606, TO DISCLAIM, RENOUNCE, AND VACATE THE
COUNTY AND PUBLIC INTEREST IN A PORTION OF STATE ROAD
NO. 29 (COPELAND AVENUE SOUTH) BEING A 200-FOOT PUBLIC
ROAD RIGHT-OF-WAY LOCATED IN SECTION 23, TOWNSHIP 53
SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA, MORE
SPECIFICALLY SHOWN IN EXHIBIT A.
WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes, petitioner, A.
Rony Joel, has requested the vacation of the County and public interest in a portion of State Road
29, also known as Copeland Avenue South, being a 200-foot public road right-of-way, located in
Section 23, Township 53 South, Range 29 East, Collier County, Florida, and more specifically
described in Exhibit A; and
WHEREAS, at its September 11, 2012 regular meeting, the Board of County
Commissioners, via Resolution No. 2012-147, approved the scheduling of a public hearing
pursuant to Section 336.09, Florida Statutes; and
WHEREAS, the Board of County Commissioners, on this day, held a public hearing to
consider the petitioner's request and notice of said public hearing was given as required by law;
and
WHEREAS, the granting of the petitioner's request will not adversely affect the
ownership or right of convenient access of the property owners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in a portion
of State Road 29, also known as Copeland Avenue South, being a 200-foot public road right-of-
way, as specifically depicted in Exhibit A, is hereby vacated, extinguished, renounced, and
disclaimed, and this action is declared to be in the public interest and for the public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of this Resolution in the Public Records of Collier County.
THIS RESOLUTION ADOPTED after motion, second and majority vote favoring same,
this the 23rd day of October, 2012.

Property Description \
Being a 50—foot wide strip of land that is lying within the NW 1/4 of Section 23, Township 53 South, Range
29 East, Collier County, Florida and is a portion of the State Road No. 29 (a.k.a. Copeland Avenue South)
right—of—way (having a width of 200 feet), according to the State of Florida, State Road Department Right Of
Way Map, Section No. 0307-250, Road No. 29, Collier County, as recorded in Road Book 1, Page 30 of the
Public Records of Collier County, Florida and which is more particularly as follows:
Commencing at the Baseline of Survey P.T. Station 170+23.48, according to the above referenced
Right—of—Way Map. thence South 89'36' 16" East, a distance of 50.00 feet to the intersection of the east
right—of—way line of said State Road No.29 (having a 100—foot wide right—of—way) and which intersection is
the Point of Beginning; thence along said east right—of—way line the following 2 courses; (1) continuing
South 89' 36' 16" East 50.00 feet to the beginning of a non—tangent curve concave to the east having a
radius of 1810.08 feet, a chord length of 79.99 feet and a chord bearing South 00' 52' 14" East: (2) thence
southerly along said curve through a central angle of 02' 31' 56" an arc distance 80.00 feet to a point
through which a radial line bears South 87' 51' 48" West; thence South 87' 51' 48" West 50.00 feet to the
beginning of a non—tangent curve concave to the east having a radius of 1860.08 feet, a chord length of
82.20 feet and a chord bearing North 00' 52' 14 " West; thence northerly along last said curve through a
central angle of 02' 31' 56" an arc distance 82.21 feet to the Point of Beginning.
Containing 4,055 square feet, more or less
Subject to any easements, rights—of—way, encumbrances, reservations, restrictions and other matters of title.
Bearings in this description are based upon an assumed bearing of North 00' 23' 44' East for the Baseline
of Survey, per the above described right—of—way map.
