RECOMMENDATION TEAT THE BOARD ADOPT A RESOLUTION AUTHORIZING TEE ACQUISITION BY
GIFT, PURCHASE OR CONDEMNATION TEE DRAINAGE EASEMENTS FOR DRAINAGE, UTILITY AND
MAINTENANCE PURPOSES WHICH ARE REQUIRED TO COMPLETE TEE CONSTRUCTION AND
MAINTENANCE OF TEE STORMWATER OUTFALL SWALE FROM RADIO ROAD NORTH TO THE GOLDEN
GATE MAIN CANAL WITHIN THE LIFE OF THE SURFACE WATER PERMIT.
OBJECTIVE: To obtain authorization from the Board of County Commissioners, Collier
County, Florida, to acquire by gift, purchase or condemnation the easement
interests for drainage, utility and maintenance purposes for the Project Parcels
required to complete the construction and maintenance of the stormwater outfall
Swale from Radio Road north to the Golden Gate Main Canal within the life of the
surface water permit.
CONSIDERATION: On September 27, 1994, the Board of County Commissioners adopted
Ordinance No. 94-54 therein establishing the 1994 (Sixth Annual) Capital
Improvement Element of the Growth Management Plan.
On November 1, 1994, the Board of County Commissioners adopted Resolution No.
94-760 authorizing County Staff to acquire by gift or purchase certain easements
and/or fee simple title to the property and property interests required and
necessary for the construction of the stormwater outfall swale from Radio Road
north to the Golden Gate Main Canal.
p' Staff.has reviewed alternative locations, environmental factors, cost variables,
safety and welfare considerations as they relate to the construction of the
Project and the Board finds that the most feasible location for the additional
drainage easements is to the Project Parcels, being more particularly described in
Exhibit "A" of the attached Resolution.
7ISCAL IMPACT: The sum of $115,339.00 (plus any business damages) is the total
fiscal impact for the acquisition and condemnation expenses for the drainage
easements required to complete the construction of the stormwater outfall swale
from Radio Road north to the Golden Gate Main Canal which is comprised of the
following costs:

PERPETUAL DRAINAGE EASEMENTS FOR DRAINAGE, UTILITY AND
MAINTENANCE PURPOSES BY GIFT, PURCHASE OR CONDEMNATION WH;CH
ARE REQUIRED TO ALLOW THE CONSTRUCTION AND MAINTENANCE OF THE
STORMWATER OUTFALL SWALE FROM RADIO ROAD NORTH TO THE GOLDEN
GATE MAIN CANAL TO OCCUR WITHIN THE LIFE OF THE SURFACE WATER
PERMIT.
WHEREAS, the Board of County Commissioners, on September 27, 19,4,
adopted Ordinance No. 94-54 therein establishing the 1994 (Sixth
Annual) Capital Improvement Element of the Growth Management Plan in
order to establish priorities for the design, acquisition and
construction of the various capital improvement projects which comprise
the Transportation Element of the County's Comprehensive Plan; and
WHEREAS, the South Florida Water Management District Right-of-Way
Occupancy Permit and the Surface Water Permit which are required to
construct the outfall swale from Radio Road north to the Golden Gate
Main Canal will expire on May 31, 1995 and May 5, 1997, respectively.
On September 6, 1994, the Board of County Commissioners authorized
staff to initiate and complete the construction of the outfall swale
within the life of the permits; and

WHEREAS, the Board of County Commissioners on November 1, 1994,
adopted Resolution No. 94-760 authorizing the County Staff to acquire
by gift or purchase certain easements and/or fee simple title to the
property and property interests required and necessary for the
construction of the stormwater outfall swale from Radio Road north to
the Golden Gate Main Canal and; furthermore, authorized staff to
proceed with the advance acquisition by donation only of the related
road right-of-way, drainage, utility maintenance easements and/or fee
simple title acquisitions on undeveloped and available lands for the
roadway corridor of Radio Road Phase II Project; and
WHEREAS, the County Staff has evaluated alternative locations,
reviewed the environmental factors, considered the cost variables, and
analyzed the safety and welfare considerations as they relate to the
construction of the stormwater outfall swale from Radio Road north to
the Golden Gate Main Canal; and

WHEREAS, the County Staff has recommended that it is necessary and
in the best interest of Collier County, Florida, to acquire certain
non-exclusive, perpetual drainage easements for drainage, utility and
maintenance purposes which are required and necessary for the
construction of the stormwater outfall swale from Radio Road north .t�io-
the Golden Gate Main Canal; and
WHEREAS, the construction of the stormwater outfall swale from
Radio Road north to the Golden Gate Main Canal is necessary in order to
protect the health, safety and welfare of the citizens of Collier
County and is in the best interest of Collier County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS-
SIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the
Board that the construction of the stormwater outfall swale from Radio
Road to the Golden Gate Main Canal (hereinafter referred to as "the
Project") is necessary for a public purpose and is in the best
interest of Collier County.
AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff
nalysis regarding alternative locations, environmental factors, cost
variables, safety and welfare considerations as they relate to the
construction of the Project and finds that the most feasible location
for the certain non-exclusive, perpetual drainage easements for
drainage, utility and maintenance purposes is described in Exhibit "A"
attached hereto.
AND IT IS FURTHER RESOLVED that the construction of the Radio Road
Phase II Project is part of the County's long range plan that is
included in the Transportation Element of the County's Comprehensive
Plan. The stormwater outfall swale is part of the Radio Road Phase II
Project.
AND IT IS FURTHER RESOLVED that to implement said construction of
the Project it is appropriate and necessary for the Board to acquire a �T
certain non-exclusive, perpetual drainage easements for drainage,

AND IT IS FURTHER RESOLVED that the County staff is hereby
authorized to immediately acquire by gift, purchase or condemnation in
accordance with the provisions of Chapters 73, 74 and 127, Florida
Statutes, the certain non-exclusive, perpetual drainage easements for
drainage, utility and maintenance purposes being more particularly, ''-described in Exhibit "A", attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the
property sought to be acquired and therefore it will not be necessary
to remove any mobile homes from the property to be acquired.
This Resolution adopted after motion, second and majority vote.

OCCUR WITHIN THE LIFE OF THE SURFACE WATER PERMIT; AND FOR THE DONATION OF THE
RELATED ROADWAY IMPROVEMENTS FOR THE RADIO ROAD PRASE IT PROJECT (SANTA BARBARA
BOULEVARD TO S.R. 84), CIE NO. 16.
OBJECTIVE: To obtain authorization from the Board of County Commissioners, Collier
County, Florida, to acquire by gift or purchase all rights and interests in real
property which are required for the construction and maintenance of the stormwater
outfall swale from Radio Road north to the Golden Gate Main Canal; and for the
related roadway corridor improvements for the Radio Road Phase II Project (Santa
Barbara Boulevard to S.R. 84), CIE No. 16.
- CONSIDERATION: The permits (South Florida Water Management District Right-of-Way
Occupancy Permit and Surface Water Permit) which are required to construct the
outfall swale will expire on May 31, 1995 and May 5, 1997, respectively. On
September 6, 1994, the Board of County Commissioners authorized staff to initiate
the acquisitions and complete the construction of the stormwater outfall swale
within the life of the permits. Although the Radio Road Phase II Project (Santa
Barbara Boulevard to S.R. 84), CIE No. 16, is outside the current Five Year Work
Program, the Board of County Commissioners authorized staff to proceed with the
advance acquisition for the donation of the related road right-of-way, drainage,
utility, maintenance easements and/or fee simple title acquisitions on undeveloped
and available lands for the roadway corridor purposes.
Adoption of the attached Resolution will authorize the selection of (an) appraisal
firm(s) from the list of appraisal firms pre-qualified and approved by the Board of
County Commissioners for work on right-of-way acquisitions projects; and will
authorize the Finance Department to make immediate payments to property owners who
have agreed to convey to the County.
Adoption of the attached Resolution establishes that the Director of the Office of
Capital Projects Management, or his designee, is delegated the authority to approve
the purchase of land interests above the staff compensation estimate or appraised
value (administrative settlements) and pay related costs when it is in the best
interest of the Project, only when the difference between the proposed settlement
and the staff compensation estimate or appraised value is less than Six Thousand
Five Hundred and 00/100 Dollars ($6,500.00). This settlement approval authority is
delegated by the Board of County Commissioners to the extent that such approvals do
not conflict with the provisions of Section 125.355, Florida Statutes.
Adoption of the attached Resolution will also confirm that, once acquired and
recorded in the Public Records of Collier County, Florida, the right-of-way and
easements for this Project shall be formally "accepted" by the Board of County
Commissioners, Collier County, Florida.

FISCAL IMPACT: The sum of $122,500 is the total fiscal impact for the acquisition
!xpenses for stormwater outfall swale lands and for the donation of the related
roadway corridor for the Radio Road Phase II Project (Santa Barbara Boulevard to
S.R. 84), CIE No. 16. The estimated purchase price for the acquisition of the land
for the outfall swale and for the donation of the related roadway project is
$110,000. These costs are to be charged against account number 333-163650-761100-
65033. This amount includes the value of the land and improvements and any
severance damages to the remainder of the properties. All service fee expenses
(title searches and appraisals) in the amount of $12,500 will be charged against
account number 333-163650-631600-65033.
GROWTH MANAGEMENT IMPACT: The recommended actions for the easement and/or fee
simple title acquisitions for the Radio Road Phase II Project are consistent with
the County's Growth Management Plan and prior Board approvals to implement CIE No.
16.
RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida,
adopt the attached Resolution authorizing the acquisition by gift or purchase of
perpetual road right-of-way, utility, drainage and maintenance easements and/or fee
simple title which are required for the construction of the stormwater outfall
swale from Radio Road north to the Golden Gate Main Canal; and for the donation of
the related roadway corridor improvements to Radio Road Phase II Project (Santa
Barbara Boulevard to S.R. 84), CIE No. 16.

Staff that it is necessary and in the best interest of Collier County,

Florida, to maintain flexibility over the acquisition of property
rights required for the construction of the stormwater outfall swale
improvements from Radio Road North to the Golden Gate Main Canal within
the life of the permits for the Radio Road Phase II Project (Santa
Barbara Boulevard to S.R.' 84) , hereinafter referred to as "Project" as
identified on Exhibit "A" attached hereto and incorporated herein by
reference, either by perpetual exclusive easements, non-exclusive
easements, or by fee simple acquisitions; and
WHEREAS, the design and construction of said transportation
improvements and related facilities have been determined by the Board
of County Commissioners of Collier County, Florida, to be necessary and
in the best interest of Collier County; and
WHEREAS, the construction of the transportation improvements and
related facilities contemplated by the Project are necessary in order
to protect the health, safety and welfare of the citizens of Collier
County, and will assist Collier County in meeting certain concurrency
requirements of the Growth Management Plan for Collier County.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSION-
ERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board has considered the environmental factors, safety factors
and fiscal considerations relating to the final adopted location of the
transportation improvements and related facilities.
2. The road right-of-way, utility, drainage and maintenance ease-
ments or fee simple acquisitions identified on Exhibit "A" are the most
feasible locations, both necessary and consistent with the project
requirements, in order to permit the construction and maintenance of
the drainage improvements and related transportation facilities for the
Radio Road Phase II Project (Santa Barbara Boulevard to S.R. 84) , CIE
No. 16.

n 3. The Board has determined that the construction and maintenance of
the drainage improvements and related transportation facilities are
necessary and in the best interest of Collier County.
4. The construction and maintenance of the drainage improvements and
related transportation facilities are compatible with the long range
planning goals and objectives of the Growth Management Plan for Collier
County.
5. It is necessary and in the best interest of Collier County for the
Board to acquire the road right-of-way, utility, drainage and
maintenance easements or fee simple title identified in Exhibit "A";
and County Staff is hereby authorized and directed to acquire by gift
or purchase the road right-of-way, utility, drainage and maintenance
easements and/or the fee simple title of the properties identified in
Exhibit "A".

6. The Chairman of the Board of County Commissioners is hereby
authorized to execute Appraisal Agreements with the appraisal firm(s)
selected from the list of firms pre-qualified by the Board of County
Commissioners. The Board further directs staff to use appraisal
reports or internal compensation estimates as staff determines is
necessary to best serve the needs of the Project in a timely and cost-
effective manner.
7. The Board of County Commissioners, in accordance with the pro-
visions of Chapter 125.355, Florida Statutes, hereby formally waives
the requirement for a formal, independent appraisal report for the
purchase of a property where the purchase price of the parcel (the
compensation due to the property owner) is less than One Hundred
Thousand and 00/100 Dollars ($100,000.00) . In lieu of the independent

appraisal report, staff is hereby authorized to make purchase offers
for the properties, the dollar amounts of which shall be predicated on
"staff compensation estimates" based upon independent appraisals (and
the data therefrom) obtained on similar properties and upon
consideration and application of appropriate market value and cost data
pertinent to the subject parcels.
8. Upon the approval by the County Attorney's Office of all documents
necessary for the subject property acquisition, Real Property Manage-
ment Department staff is hereby directed to offer immediate delivery to
the respective property owners of the full compensation (as establish-
ed by the appraisal or staff compensation estimates in accordance with
the provisions of Chapter 125.355, Florida Statutes) , in return for the
immediate and proper execution of the respective easements and/or
deeds, and such other legal documents and/or affidavits as the County
Attorney's Office deems appropriate in order to protect the interests
of the County; and the Board of County Commissioners hereby authorizes
its present Chairman and any subsequent Chairman, for the life of the
Project, to execute any instruments which have been approved by the
Office of the County Attorney, to remove the lien of any encumbrance
and for any such other purpose as may be required for the acquired road
right-of-way, utility, drainage and maintenance easements or fee simple
title.
9. In those instances where negotiated settlements may be obtained
via the "Seller's Affidavit", "Purchase Agreement" or "Easement
Agreement" mechanism, the Director of the Office of Capital Projects
Management, or his designee, is charged with the responsibility for
completion of various capital improvement projects, and is hereby
delegated the authority to approve the purchase of land interests above
the staff compensation estimate or appraised value and pay normally
related costs when it is in the best interest of the Project, within

the pro-rata share of the land rights acquisition budget for the parcel
being acquired, only when the difference between the purchase price and
compensation estimate or appraised value is less than Six Thousand Five
Hundred and 00/100 Dollars ($6,500.00) . This settlement approval
authority is delegated by the Board of County Commissioners to the
extent that such approvals do not conflict with the provisions of
Section 125.355, Florida Statutes.
10. The Chairman of the Board of County Commissioners is hereby
authorized to execute Purchase Agreements and Easement Agreements where
the land owner has agreed to sell the required land rights to the
County at its appraised value or at that amount considered the
"Administrative Settlement Amount" as such term is internally used by
the administrative agencies of Collier County.
11. Where the property owner agrees, by sworn affidavit or agreement
("Seller's Affidavit", "Purchase Agreement" or "Easement Agreement") ,
to convey a necessary interest in real property to the County, and upon
the proper execution by the property owner of those easements and/or
deeds, and such other legal documents as the Office of the County
Attorney may require, the Board hereby authorizes the Finance
Department to issue warrants, payable to the property owner(s) of
record, in those amounts as shall be specified on a closing statement
and which shall be based upon the appraisal or staff compensation
estimate in accordance with this Resolution and the provisions of
Section 125.355, Florida Statutes.
12. All title to properties or interests in properties which have been
obtained in the manner described above shall be deemed "accepted" by
the Board of County Commissioners, as the governing body of Collier
County, Florida, a political subdivision of the State of Florida, and

CONSIDERATION: On October 28, 1997, the Board of County Commissioners adopted • •' ance
Number 97-55 therein establishing the 1997 (Seventh Annual) Capital Improvement Element of the
Growth Management Plan. The Transportation Element of the County's Comprehensive Plan was
adopted in Ordinance No. 97-62 for CIE Number 16. •
On November 1, 1994, the Board of County Commissioners adopted Resolution Number 94-760
authorizing the County Staff to acquire by gift, certain easements, and fee simple title to the property
and property interests required and necessary for the four-laning roadway improvement of Radio Road
from Santa Barbara Boulevard to Davis Boulevard(S.R. 84).
Staff has reviewed alternative locations, environmental factors, cost variables, safety and welfare
considerations as they relate to the construction of the Project and the Board finds that the most feasible
location for the additional road right-of-way for the construction of the Project is being more
particularly described in Exhibit"A"of the attached Resolution.
FISCAL IMPACT: Total acquisition costs are estimated at $886,807,. and includes;all land,
improvements, and severance damage pay-outs as well as all overhead costs and expenses which may
be incurred through condemnation, and final judgment expenses for the non-exclusive, perpetual
easements and/or fee simple title referenced in Exhibit "A", p�

Funds are available FY 98 in the amount of$528,450 in:

2 COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that it has been determined by the f/-•�

7 AND IT IS FURTHER RESOLVED that construction of the Project is part of the County's
8 long range planning effort,and is included in the Transportation Element of the County's
9 Comprehensive Plan for Growth Management,as approved by the Florida Department of
10 Community Affairs.
11 AND IT IS FURTHER RESOLVED that the County Staff has reviewed alternative
12 locations for the project,various impacts to the environment,public safety and welfare
13 considerations associated with the design and construction of the Project,and the costs
14 associated with the design,property rights acquisition,and construction of the Project;and the
15 Board finds that after consideration of these issues,the most feasible location for construction
16 of the proposed improvements is collectively represented by the legal descriptions comprising
17 Exhibit"A"attached hereto and incorporated herein.
18 AND IT IS FURTHER RESOLVED that in order to construct the Project as designed,it is
19 necessary for the Board to acquire the various real property interests described in Exhibit"A"to
20 wit: fee simple title;perpetual,non-exclusive road right-of-way,sidewalk,slope,utility,
21 drainage,maintenance and temporary construction interests by easement.
22 AND IT IS FURTHER RESOLVED that all property,whether encumbered by easement or
23 acquired in fee simple,shall be put to public purposes.
24 AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to
25 immediately acquire by gift,purchase or condemnation in accordance with the provisions of
26 Chapters 73,74 and 127,Florida Statutes,the above-referenced real property interests more
27 particularly described in Exhibit"A"attached hereto and incorporated herein.
28 AND IT IS FURTHER RESOLVED that no mobile homes are located on the property
29 sought to be acquired and therefore it will not be necessary to remove any mobile homes from
30 the property to be acquired.

A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND BY GIFT,
PURCHASE OR CONDEMNATION OF FEE SIMPLE TITLE INTERESTS
AND/OR PERPETUAL, NON-EXCLUSIVE, ROAD RIGHT-OF-WAY,
SIDEWALK, SLOPE, UTILITY, DRAINAGE, MAINTENANCE AND
TEMPORARY CONSTRUCTION INTERESTS BY EASEMENT FOR THE
CONSTRUCTION OF THE FOUR-LANING ROADWAY IMPROVEMENTS FOR
RADIO ROAD (C.R. 856) PROJECT FROM SANTA BARBARA BOULEVARD
TO DAVIS BOULEVARD(S.R.84).
WHEREAS,the Board of County Commissioners,on October 28, 1997,adopted Ordinance
No.97-55 therein establishing the 1997(Seventh Annual)Capital Improvement Element of the
Growth Management Plan in order to establish priorities for the design,acquisition and construction
of the various capital improvement projects. The Transportation Element of the County's
Comprehensive Plan was adopted in Ordinance No.97-62;and
WHEREAS,the four-laning improvements to Radio Road(C.R.856)from Santa Barbara
Boulevard to Davis Boulevard(S.R.84)is one of the capital improvement projects required under the
Transportation Element of the County's Comprehensive Plan;and
WHEREAS,the Board of County Commissioners,on November 1, 1994,adopted Resolution
No.94-760 authorizing the County Staff to acquire by gift certain easements,and/or fee simple title
to the property and property interests required and necessary for the four-laning roadway
improvements of Radio Road from Santa Barbara Boulevard to Davis Boulevard;and
WHEREAS,the location for construction of the proposed improvements has been fixed by
survey and is collectively represented by the legal descriptions comprising Exhibit"A"attached
hereto and incorporated herein.
WHEREAS,after consideration of the availability of alternate routes and locations,the
comparative costs of project alternatives,various impacts upon the environment,long range planning
options,and public safety considerations,the Board desires to exercise its right to condemn property
for public purposes.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that it has been determined by the Board
that the construction of the four-laning roadway improvements for Radio Road from Santa Barbara
Boulevard to Davis Boulevard, (hereinafter referred to as"the Project")is necessary and in the
public's best interest in order to protect the health,safety and welfare of the citizens of Collier
County.
AND IT IS FURTHER RESOLVED that construction of the Project is part of the County's
long range planning effort,and is included in the Transportation Element of the County's

Comprehensive Plan for Growth Management,as approved by the Florida Department of Community
" ' Affairs.
AND IT IS FURTHER RESOLVED that the County Staff has reviewed alternative locations
for the project,various impacts to the environment,public safety and welfare considerations
associated with the design and construction of the Project,and the costs associated with the design,
property rights acquisition,and construction of the Project;and the Board finds that after
consideration of these issues,the most feasible location for construction of the proposed
improvements is collectively represented by the legal descriptions comprising Exhibit"A"attached
hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that in order to construct the Project as designed,it is
necessary for the Board to acquire the various real property interests described in Exhibit"A"to wit:
fee simple title;perpetual,non-exclusive road right-of-way,sidewalk,slope,utility,drainage,
maintenance and temporary construction interests by easement.
AND IT IS FURTHER RESOLVED that all property,whether encumbered by easement or
acquired in fee simple,shall be put to public purposes.
AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to
immediately acquire by gift,purchase or condemnation in accordance with the provisions of Chapters
73,74 and 127,Florida Statutes,the above-referenced real property interests more particularly
described in Exhibit"A"attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the property sought
to be acquired and therefore it will not be necessary to remove any mobile homes from the property
to be acquired.
