EXECUTIVE SUMMARY
n RECOMMENDATION TO ADOPT THREE (3 ) RESOLUTIONS AUTHORIZING THE
ACQUISITION OF PERPETUAL RIGHT-OF-WAY EASEMENTS, TEMPORARY
CONSTRUCTION EASEMENTS, AND DRAINAGE EASEMENTS BY GIFT, PURCHASE
OR CONDEMNATION, WHICH ARE REQUIRED FOR THE CONSTRUCTION OF
TRANSPORTATION IMPROVEMENTS TO RADIO ROAD FROM AIRPORT ROAD TO
SANTA BARBARA BOULEVARD.
OBJECTIVE: To obtain authorization from the Board of County
Commissioners, Collier County, Florida, to acquire by condemnation,
if necessary, all rights and interests in real property which are
required for the construction of transportation improvements to
Radio Road (four lane construction from Airport Road to Santa
Barbara Boulevard) .
CONSIDERATION: While many of the easements identified on Composite
Exhibit "A" to the resolution will be acquired by purchase
agreement prior to the date of an Order of Taking hearing, steps
must be taken at this time to ensure that a date-certain is
established at which time Collier County will have sufficient right
and title to enter upon these private lands and construct the
roadway improvements. Adoption of the attached Resolutionswill
permit the Office of the County Attorney to proceed with the
preparation of pleadings in eminent domain which shall be necessary
to condemn the interests in real property sought by the County.
Staff will continue to negotiate for the amicable purchase of the
necessary easements in order to minimize the County's exposure for
the property owners' attorney fees and other expert witness costs
(appraisers, engineers, accountants, etc. ) according to Florida
Statutes, Chapter 73 .091.
FISCAL IMPACT:, Updated appraisals indicate the present day value
of the easements is approximately $278 ,000 . In addition,
professional service fees (both ours and those of the property
owner which the County may be directed to pay by the court) could
reach $100,000. All costs and expenses will be charged against:

GROWTH MANAGEMENT IMPACT: None. This project is a part of the
Capital Improvement Element of the County's Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners adopt the
attached Resolutions, thereby allowing for condemnation of the
easements necessary for the four-lane construction of Radio Road.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION
OF ROAD RIGHT-OF-WAY, UTILITY, DRAINAGE AND MAINTENANCE
EASEMENTS BY GIFT PURCHASE OR CONDEMNATION, WHICH ARE
NECESSARY FOR THE CONSTRUCTION AND MAINTENANCE
OF TRANSPORTATION IMPROVEMENTS ON RADIO ROAD (CR-856).
WHEREAS, the Board of County Commissioners, on November 12,
1991, adopted the Collier County Five and Ten Year Secondary Road
Program for FY 1991/92 through 1995/96 in order to establish
priorities for the design, right-of-way acquisition and
construction of the various capital improvement projects which
comprise the Transportation Element of the County's Comprehensive
Plan, and of which Plan the improvements to Radio Road (CR-856)
(hereinafter referred to as the "Project") are component parts;
and
WHEREAS, alternate locations, environmental factors, long
range planning, cost variables, safety and welfare considerations

have been reviewed as they relate to the implementation of said
transportation improvements, and it has been recommended by County
Staff that the road right-of-way, utility, drainage and
maintenance easements described and identified in composite
Exhibit "A" are the most feasible locations to construct
' the transportation improvements and related facilities; and
WHEREAS, the construction of said transportation
improvements and related facilities has been determined by the
Board of County Commissioners of Collier County, Florida, to be
necessary and in the best interests of Collier County; and
WHEREAS, in accordance with the construction plans for the
Project, construction of the transportation improvements and
related facilities shall require the acquisition of the road
right-of-way, utility, drainage and maintenance easements as
identified in composite Exhibit "A".

NOW , THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
/"1 COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board has
considered the environmental factors, safety factors and cost
factors relating to the location of the transportation
improvements and related facilities.
AND IT IS FURTHER RESOLVED that the Board has determined that
there are no mobile homes located within the lands described in
composite Exhibit "A", and that said road right-of-way, utility,
drainage and maintenance easements are the most economically
feasible locations in order to permit the construction and
maintenance of the transportation improvements and related
facilities.
AND IT IS FURTHER RESOLVED that the Board has determined that
the construction and maintenance of the transportation
improvements and related facilities is necessary and in the best
interests of Collier County.
AND IT IS FURTHER RESOLVED that the construction and
maintenance of the transportation improvements and related
• facilities is compatible with the lohg range planning goals and
objectives of the Growth Management Plan for Collier County.
AND IT IS FURTHER RESOLVED that it is necessary and in the
best interest of Collier County for the Board to acquire the
road right-of-way, utility, drainage and maintenance easements
described in composite Exhibit "A"; and County Staff is hereby
authorized and directed to acquire by gift, purchase or
condemnation the road right-of-way, utility, drainage and
maintenance easements described in composite Exhibit "A", attached
hereto and incorporated herein, in accordance with the provisions
of Chapters 73, 74 and 127, Florida Statutes, and County Staff is
hereby directed to institute condemnation proceedings to acquire
said easements in those instances in which said easements cannot
be obtained through agreement at the County appraiser's estimate
of just compensation due the property owner and/or in those
instances in which it is determined that condemnation is the only
feasible method of obtaining the unencumbered interest sought.
THIS RESOLUTION ADOPTED after motion, second and majority vote.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION
OF DRAINAGE EASEMENTS BY GIFT, PURCHASE OR CONDEMNATION,
WHICH ARE NECESSARY FOR THE CONSTRUCTION AND MAINTENANCE
OF TRANSPORTATION IMPROVEMENTS ON RADIO ROAD (CR-856)
BETWEEN AIRPORT ROAD AND SANTA BARBARA BOULEVARD.
WHEREAS, the Board of County Commissioners, on November 12,
1991, adopted the Collier County Five and Ten Year Secondary Road
Program for FY 1989/90 through 1994/95 in order to establish
priorities for the design, right-of-way acquisition and
construction of the various capital improvement projects which
comprise the Transportation Element of the County's Comprehensive
Plan, and of which Plan the improvements to Radio Road
(hereinafter referred to as the "Project") are component parts;
and
WHEREAS, alternate locations, environmental factors, long
range planning, cost variables, safety and welfare considerations
have been reviewed as they relate to the implementation of said
transportation improvements, and the drainage improvements related
/1 to the transportation improvements, and it has been recommended by
County Staff that the drainage easements described and identified
in Exhibit "A" are the most feasible locations to construct
the drainage improvements which are related to the transportation
facilities; and
WHEREAS, the construction of said drainage improvements and
related transportation facilities has been determined by the
Board of County Commissioners of Collier County, Florida, to be
necessary and in the best interest of Collier County; and
WHEREAS, in accordance with the construction plans for the
Project, construction of the transportation improvements and
related facilities shall require the acquisition of the drainage
easements identified in Exhibit "A":
NOW , THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board has
considered the environmental factors, safety factors and cost
factors relating to the location of the drainage improvements
and related transportation facilities.
AND IT IS FURTHER RESOLVED that the Board has determined that
there are no mobile homes located within the lands described in
Exhibit "A", and that said drainage easements are the most
economically feasible locations to construct and maintain the
drainage improvements and related transportation facilities.
AND IT IS FURTHER RESOLVED that the Board has determined that
the construction and maintenance of the drainage improvements and
related transportation facilities is necessary and in the best
interest of Collier County.
AND IT IS FURTHER RESOLVED that the construction and
maintenance of the drainage improvements and related
transportation facilities is compatible with the long range
planning goals and objectives of the Growth Management Plan for
Collier County.
AND IT IS FURTHER RESOLVED that it is necessary and in the
best interest of Collier County for the Board to acquire the
drainage easements described in Exhibit "A"; and County
Staff is hereby authorized and directed to acquire by gift,
/""N purchase or condemnation the drainage easements described in
Exhibit "A", attached hereto and incbrporated herein, in
accordance with the provisions of Chapters 73, 74 and 127, Florida
Statutes, and County Staff is hereby directed to institute
condemnation proceedings to acquire such drainage easements in
the event that the drainage easements cannot be obtained through
agreement at the County appraiser's estimate of just
compensation due the property owner, and/or it is determined that
condemnation is the only feasible method of obtaining the
unencumbered interest sought.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION
OF ROAD RIGHT-OF-WAY, UTILITY, DRAINAGE AND MAINTENANCE
EASEMENTS BY GIFT PURCHASE OR CONDEMNATION, WHICH ARE
NECESSARY FOR THE CONSTRUCTION AND MAINTENANCE
OF TRANSPORTATION IMPROVEMENTS ON RADIO ROAD (CR-856) .
WHEREAS, the Board of County Commissioners, on November 12,
1991, adopted the Collier County Five and Ten Year Secondary Road
Program for FY 1991/92 through 1995/96 in order to establish
priorities for the design, right-of-way acquisition and
construction of the various capital improvement projects which
comprise the Transportation Element of the County's Comprehensive
Plan, and of which Plan the improvements to Radio Road (CR-856)
(hereinafter referred to as the "Project") are component parts;
and
WHEREAS, alternate locations, environmental factors, long
range planning, cost variables, safety and welfare considerations
have been reviewed as they relate to the implementation of said
transportation improvements, and it has been recommended by County
Staff that the road right-of-way, utility, drainage and
maintenance easements described and identified in composite
Exhibit "A" are the most feasible locations to construct
the transportation improvements and related facilities; and
WHEREAS, the construction of said transportation
improvements and related facilities has been determined by the
Board of County Commissioners of Collier County, Florida, to be
necessary and in the best interests of Collier County; and
WHEREAS, in accordance with the construction plans for the
Project, construction of the transportation improvements and
related facilities shall require the acquisition of the road
right-of-way, utility, drainage and maintenance easements as
identified in composite Exhibit "A".

NOW , THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board has
considered the environmental factors, safety factors and cost
factors relating to the location of the transportation
improvements and related facilities.
AND IT IS FURTHER RESOLVED that the Board has determined that
there are no mobile homes located within the lands described in
composite Exhibit "A", and that said road right-of-way, utility,
drainage and maintenance easements are the most economically
feasible locations in order to permit the construction and
maintenance of the transportation improvements and related
facilities.
AND IT IS FURTHER RESOLVED that the Board has determined that
the construction and maintenance of the transportation
improvements and related facilities is necessary and in the best
interests of Collier County.
AND IT IS FURTHER RESOLVED that the construction and
maintenance of the transportation improvements and related
facilities is compatible with the long range planning goals and
objectives of the Growth Management Plan for Collier County.
AND IT IS FURTHER RESOLVED that it is necessary and in the
best interest of Collier County for the Board to acquire the
road right-of-way, utility, drainage and maintenance easements
described in composite Exhibit "A"; and County Staff is hereby
authorized and directed to acquire by gift, purchase or
condemnation the road right-of-way, utility, drainage and
maintenance easements described in composite Exhibit "A", attached
hereto and incorporated herein, in accordance with the provisions
of Chapters 73, 74 and 127, Florida Statutes, and County Staff is
hereby directed to institute condemnation proceedings to acquire
said easements in those instances in which said easements cannot
be obtained through agreement at the County appraiser's estimate
of just compensation due the property owner and/or in those
instances in which it is determined that condemnation is the only
feasible method of obtaining the unencumbered interest sought.

WHEREAS, the Board of County Commissioners, on November 12,
1991, adopted the Collier County Five and Ten Year Secondary Road
Program for FY 1989/90 through 1994/96 in order to establish
priorities for the design, right-of-way acquisition and
construction of the various capital improvement projects which
comprise the Transportation Element of the County's Comprehensive
Plan, and of which Plan the improvements to Radio Road
(hereinafter referred to as the "Project") are component parts;

WHEREAS, alternate locations, environmental factors, long
range planning, cost variables, safety and welfare considerations
have been reviewed as they relate to the implementation of said
transportation improvements, and the drainage improvements related
to the transportation improvements, and it has been recommended by
County Staff that the drainage easements described and identified
in Exhibit "A" are the most feasible locations to construct
the drainage improvements which are related to the transportation
facilities; and
WHEREAS, the construction of said drainage improvements and
related transportation facilities has been determined by the
Board of County Commissioners of Collier County, Florida, to be
necessary and in the best. interest of Collier County; and
WHEREAS, in accordance with the construction plans for the
Project, construction of the transportation improvements and
related facilities shall require the acquisition of the drainage
easements identified in Exhibit "A".
NOW , THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board has

factors relating to the location of the drainage improvements
and related transportation facilities.

AND IT IS FURTHER RESOLVED that the Board has determined that
there are no mobile homes located within the lands described in
Exhibit "A", and that said drainage easements are the most

drainage improvements and related transportation facilities.
AND IT IS FURTHER RESOLVED that the Board has determined that
the construction and maintenance of the drainage improvements and +r
related transportation facilities is• necessary and in the best
interest of Collier County.
AND IT IS FURTHER RESOLVED that the construction and
maintenance of the drainage improvements and related
transportation facilities is compatible with the long range
planning goals and objectives of the Growth Management Plan for

AND IT IS FURTHER RESOLVED that it is necessary and in the
best interest of Collier County for the Board to acquire the
drainage easements described in Exhibit "A"; and County
Staff is hereby authorized and directed to acquire by gift,
purchase or condemnation the drainage easements described in
Exhibit "A", attached hereto and incorporated herein, in
accordance with the provisions of Chapters 73, 74 and 127, Florida
Statutes, and County Staff is hereby directed to institute
condemnation proceedings to acquire such drainage easements in
the event that the drainage easements cannot be obtained through
agreement at the County appraiser's estimate of just
compensation due the property owner, and/or it is determined that
• condemnation is the only feasible method of obtaining the
.unencumbered interest sought.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION
OF TEMPORARY CONSTRUCTION EASEMENTS BY GIFT, PURCHASE
OR CONDEMNATION, WHICH ARE NECESSARY FOR THE
CONSTRUCTION OF TRANSPORTATION IMPROVEMENTS ON RADIO
ROAD (CR-856).
WHEREAS, the Board of County Commissioners, on November 12,
1991, adopted the Collier County Five and Ten Year Secondary Road
Program for FY 1991/92 through 1995/96 in order to establish
priorities for the design, right-of-way acquisition and
construction of the various capital improvement projects which
• comprise the Transportation Element of the County's Comprehensive
Plan, and of which Plan the improvements to Radio Road (CR-856)
(hereinafter referred to as the "Project") are component parts;
and
WHEREAS, alternate locations, environmental factors, long
range planning, cost variables, safety and welfare considerations
have been reviewed as they relate to the implementation of said
transportation improvements, and it has been recommended by County
Staff that the construction plans for the Radio Road four-
laning project represent the most feasible locations to construct
the transportation improvements and related facilities; and
WHEREAS, the construction of said transportation
improvements and related facilities has been determined by the
Board of County Commissioners of Collier County, Florida, to be
necessary and in the best interests of Collier County; and
WHEREAS, in accordance with the construction plans for the
Project, construction of the transportation improvements and
related facilities shall require the acquisition of the
temporary construction easements as identified in composite
Exhibit "A".

PERPETUAL ROAD, UTILITY, DRAINAGE AND MAINTENANCE EASEMENTS BY
GIFT, PURCHASE OR CONDEMNATION, WHICH ARE REQUIRED FOR THE FOUR-
LANE EXPANSION OF RADIO ROAD AND AUTHORIZING ACQUISITION BY GIFT,
PURCHASE OR CONDEMNATION OF THE UTILITY EASEMENT REQUIRED FOR THE
CONSTRUCTION AND INSTALLATION OF A SEWER FORCE MAIN AND PUMP
STATION TO SERVICE THE NAPLES PRODUCTION PARK MUNICIPAL SERVICE
TAXING AND BENEFIT UNIT DISTRICT.
OBJECTIVE: To obtain authorization from the Board of County
Commissioners, Collier County, Florida, to acquire by condemnation,
if necessary, the perpetual road, utility, drainage and maintenance
easements which are required for the four-lane expansion of Radio
Road and the utility easement required for the installation of a
sewer force main and pump station which are part of the
improvements funded by the Naples Production Park MSTU.
CONSIDERATION: Negotiations for the purchase of the subject
easements, as described in the Resolution exhibits, have to date
been unsuccessful. One property owner simply refuses to discuss
the easements with County staff, and the other property owner has
held out for more compensation than staff believes is warranted
(even in consideration of the cost of litigation) .
While additional resolutions authorizing condemnation of easements
for the four-lane expansion of Radio Road will be brought before
the Board in the very near future, these particular resolutions are
being recommended for adoption at this time due to the project
schedule for the construction and installation of improvements
within the Naples Production Park MSTU.
Adoption of the attached Resolutions will permit the Office of the
County Attorney to proceed with the preparation of pleadings in
eminent domain which shall be necessary to condemn the interests in
real property sought by the County.
FISCAL IMPACT: The most recent appraisals estimate $101 , 500 to be
the total compensation to the property owners for the taking of the
subject road, utility, drainage and maintenance easements, with
$4, 300 of this amount attributable to the utility easement upon
which the pump station is to be constructed. While updated
appraisals will be ordered shortly before the Order of Taking
hearing, due to the real estate market's current recession,
compensation estimates are not expected to increase to any
significant degree.

All costs associated with the acquisition of the -pump station
required for the Naples Production Park MSTU project will be
refunded to the above account upon collection of the MSTU district
assessments.
GROWTH MANAGEMENT IMPACT: The four-laning improvements to Radio
Road are part of the Transportation Element of the County's
Comprehensive Plan. As such the recommended action is in
compliance with the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners adopt the
attached Resolutions authorizing the acquisition by gift, purchase
or condemnation of the perpetual road, utility, drainage and
maintenance easements which are required for the four-lane
expansion of Radio Road and the acquisition by gift, purchase or •
condemnation of the utility easement required for the construction
and installation of the sewer force main and pump station which
will service the Naples Production Park Municipal Service Taxing

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION
OF ROAD RIGHT-OF-WAY, UTILITY, DRAINAGE AND MAINTENANCE
EASEMENTS BY GIFT PURCHASE OR CONDEMNATION, WHICH ARE
NECESSARY FOR THE CONSTRUCTION AND MAINTENANCE
OF TRANSPORTATION IMPROVEMENTS ON RADIO ROAD (CR-856).
WHEREAS, the Board of County Commissioners, on November 12,
1991, adopted the Collier County Five and Ten Year Secondary Road
Program for FY 1991/92 through 1995/96 in order to establish
priorities for the design, right-of-way acquisition and
construction of the various capital improvement projects which
comprise the Transportation Element of the County's Comprehensive
Plan, and of which Plan the improvements to Radio Road (CR-856)
(hereinafter referred to as the "Project") are component parts;
and
WHEREAS, alternate locations, environmental factors, long
range planning, cost variables, safety and welfare considerations
have been reviewed as they relate to the implementation of said
transportation improvements, and it has been recommended by County
Staff that the road right-of-way, utility, drainage and
maintenance easements described and identified in composite
Exhibit "A" are the most feasible locations to construct
the transportation improvements and related facilities; and
WHEREAS, the construction of said transportation
improvements and related facilities has been determined by the
Board of County Commissioners of Collier County, Florida, to be
necessary and in the best interests of Collier County; and
WHEREAS, in accordance with the approved construction plans

SERVICE TAXING AND BENEFIT UNIT WHICH
EASEMENTS ARE NECESSARY FOR THE CON-

FACILITIES.
WHEREAS, the Board of County Commissioners of Collier
County (the Board) adopted Collier County Ordinance No. 85-19
on August 6, 1985, creating the Naples Production Park
Municipal Services Taxing and Benefit Unit (Unit) , providing
for the construction of assessable improvements, establishing
assessments against benefited properties, providing for the
issuance of assessment bonds and establishing a method of
collection of the special assessments; and
WHEREAS, the Board adopted Ordinance No. 88-23 on February
23, 1988 which established the procedure for the creation of
municipal service benefit units, provided for the levy and
collection of special assessments and provided that all special
assessments shall constitute a lien upon the property assessed;
and
WHEREAS, the Board adopted Resolution No. 90-409 on August
7, 1990, confirming the creation of the Naples Production Park
Municipal Service Taxing and Benefit Unit and providing that
the assessment procedures shall be levied and imposed pursuant
to Collier County Ordinance No. 88-23; and
WHEREAS, the Board adopted Resolution No. 90-410 on August
7, 1990, confirming the appointment of the Naples Production
Park Management Committee for the purpose of insuring timely
and appropriate completion of project objectives; and
WHEREAS, the Board adopted Resolution No. 90-411 on August
7, 1990, initiating a program for the purpose of providing
potable water, sanitary sewer, road and drainage improvements
in the Naples Production Park Municipal Service Taxing and
Benefit Unit; and

WHEREAS, the Board authorized the engineering design and
construction of the potable water system, sanitary sewer
facilities, road, drainage and maintenance improvements; and
WHEREAS, the Board has entered into an engineering
contract with Wilson, Miller, Barton, Soll and Peek, Inc. to
prepare the engineering design plans for a potable water sys-
tem, sanitary sewer facilities, road right-of-way, drainage and
maintenance improvements for the Unit; and
WHEREAS, alternate locations, environmental factors, long
range planning, cost variables and safety and welfare consider-
ations have been reviewed for the perpetual road right-of-way
easements, utility easements, drainage easements and main-
tenance easements which relate to the implementation of
roadway, utility, drainage and maintenance improvements and
facilities; and
WHEREAS, it has been recommended by County staff that the
perpetual utility easement described and identified in Exhibit
"A" , attached hereto and incorporated herein, is the most
feasible location to construct and install a utility facility;
and
WHEREAS, it is necessary to obtain a perpetual utility
easement for the construction, installation and maintenance of
a utility facility; and
WHEREAS, the construction of the utility improvement and
facility within the Unit is necessary to protect the health,
safety and welfare of the citizens of Collier County.

construction of the various capital improvement projects which
comprise the Transportation Element of the County's Comprehensive
Plan, and of which Plan the improvements to Radio Road (CR-856)
(hereinafter referred to as the "Project") are component parts;

WHEREAS, alternate locations, environmental factors, long
range planning, cost variables, safety and welfare considerations
have been reviewed as they relate to the implementation of said
transportation improvements, and it has been recommended by County

use on most major right-of-way acquisition projects where time• is
a major constraint. . Past right-of-way acquisition practices
which staff is hereby attempting to streamline, involved:
o Returning to the Board, after the initial authorization to
acquire, for subsequent authorization to contract with
appraisal firms; and
o Returning to the Board, after negotiations, for the
subsequent approval and execution of a bilateral purchase
agreement for each and every purchase on the project
(regardless of the dollar amount of the purchase).
By law, staff must continue,to seek Board approval. for any purchase
in excess of the appraiser's estimate of compensation. The major
change proposed in the method of acquiring real estate is the
substitution of. a Seller's Affidavit (or unilateral agreement) in ,, ;
place of the bilateral agreement in those instances where the
property, owner is,willing to. convey the right-of-way at or below

GROWTH-MANAGEMENT IMPACT: The construction of improvements to
Radio Road is part of the Transportation Services Five Year
Secondary Road Program covering FY 89/90 through FY 94/95 and is
listed as a Capital Improvement• Element (CIE) Number 015 within the
County's Comprehensive Plan.
RECOMMENDATION: That the Board of County Commissioners adopt the
attached Resolution authorizing the acquisition of the right-of-way
which may be required for the construction of the road, utility and

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, RECOGNIZING THE CRITICAL NATURE OF THE PROJECT
SCHEDULE FOR THE ACQUISITION OF RIGHT-OF-WAY AND FOR THE
CONSTRUCTION OF FOUR-LANING IMPROVEMENTS TO RADIO ROAD (CAPITAL
IMPROVEMENT ELEMENT (CIE) PROJECT NO. 015), AND GRANTING PROJECT
AUTHORITY TO THE COUNTY ATTORNEY AND THE TRANSPORTATION SERVICES
ADMINISTRATOR TO PROCEED WITH IMPLEMENTATION STRATEGIES REQUIRED
TO EXPEDITE SAID RIGHT-OF-WAY ACQUISITION AND CONSTRUCTION.
WHEREAS, on June 8, 1990, the Board of County Commissioners,
adopted the Collier County Five and Ten Year Secondary Road
Program for FY 1989/90 - 1994/95 AND FY 1995/96 - FY 1999/00,
therein establishing priorities for budgeting, design, right-of-
way acquisition and construction of capital road improvement
projects; and
WHEREAS, the construction of Radio Road (CR-856) four-laning
improvements between Airport Road and Santa Barbara Boulevard is
scheduled to begin during the First Quarter of 1991, pursuant to
the adopted Secondary Road Program; and
WHEREAS, the Collier County Board of Commissioners has entered
into an engineering contract with Agnoli, Barber and Brundage,
Inc . , to prepare the engineering design plans for Radio Road
(CR-856) four-laning improvements between Airport Road and Davis
Boulevard (SR-84) ; and

WHEREAS, it is necessary and in the best interest of Collier
County, Florida, to acquire either by perpetual easement or by
fee simple purchase the additional right-of-way along the Radio
Road corridor for the construction, installation, operation and
maintenance of a public roadway and associated drainage and
utility facilities, as shown on the plans prepared by Agnoli,
Barber and Brundage, Inc . , and as approved by the Collier County
Transportation Division; and
WHEREAS, the expeditious acquisition of right-of-way along Radio
Road (see Exhibit "A" - Preliminary Right-of-Way Map) is of
paramount importance to completing the Project on schedule, and
attaining infrastructure goals in accordance with the
Transportation Element of the County's Growth Management Plan;
and
WHEREAS, accomplishing the right-of-way acquisition and
construction on or ahead of schedule shall require a properly
coordinated team effort by the Transportation Services Division,
the Real Property Management Department and the Office of the
County Attorney, wherein certain routine processes may have to be
streamlined and compressed into the shortest possible time-
frames, provided however, that such time-frames shall allow for
quality work product by both staff and consultants, and which
shall not discredit nor aver from the County's policy of
conducting good-faith negotiations for the purchase of required
right-of-way;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, THAT:
1 . The four-laning improvements to Radio Road (CR-856) and the
acquisition of the rights-of-way as defined in Exhibit "A", from
Airport Road to just West of Santa Barbara Boulevard, are
necessary and in the best interest of the citizens of Collier
County, Florida; and
2. Negotiations for the acquisition of said right-of-way by gift
or by purchase up to the appraised value, in either fee simple or
by perpetual easement, are hereby authorized; and
3 . The Collier County Transportation Services Division shall
endeavor to award a construction contract for the four-laning of
Radio Road, from Airport Road to Santa Barbara Boulevard, on or
before March 31, 1991, and moreover, the Transportation Services
Division is hereby directed to proceed with the advertisement and
bid phase of the construction project prior to the completion of
the right-of-way acquisition phase of the project if, in the
opinion of the Transportation Services Administrator, such
actions become necessary to protect the integrity of the Project
schedule; and
4. The Board of County Commissioners of Collier County, Florida,
recognizes the critical nature of the Radio Road Project Schedule
and its relationship to meeting the levels of service required by
the Transportation Element of Collier County's Comprehensive
Plan, and further recognizes that some ordinary County processes
and standard operating procedures relative to consultant
selection and right-of-way acquisition may negatively impact the
Project Schedule; and
5 . In accordance with the above-stated recognition by the Board
of County Commissioners, the time-consuming and formal
competitive bidding process for the selection of real estate
appraisers is hereby waived, and the Transportation Services
Administrator is hereby delegated the authority to negotiate with
appraisal firms from the existing Board-approved list of
appraisers, and the Chairman of the Board of County Commissioners
is hereby authorized to execute Appraisal Agreements (the
combined sum of which shall not exceed $60,000) , with the
appraisal firm(s) which, based upon the analysis and
recommendation of staff, is (are) best able to serve the needs of
the Project in a timely and cost-effective manner; and
6 . Upon the approval by the County Attorney's Office of all
documents necessary for the subject right-of-way acquisition,
Real Property Management Department staff is hereby encouraged to
offer immediate delivery to the respective property owners, of
the full compensation (as established by the appraisal), in
return for the immediate and proper. execution of the respective
easements and/or deeds, and such other legal documents and/or
affidavits as the County Attorney's Office deems appropriate in
order to protect the interests of the County; and
7. In lieu of the those standard procedures, whereby an Easement
Agreement or Purchase Agreement is executed by a property owner
subsequent to negotiations, which agreement is then placed upon
the Board meeting agenda for execution by the Chairman, all
before a Requisition and Purchase Order may be approved allowing

the Finance Department to issue a check for closing, the Board of
County Commissioners of Collier County, Florida, hereby
authorizes staff to negotiate with the respective property owners
for the purchase of the required right-of-way, and in those
instances wherein the property owner agrees, by sworn affidavit,
to convey the required right-of-way to the County in exchange for
compensation in an amount not to exceed the appraiser's
Certificate of Appraisal, and upon the proper execution by the
property owner of those easements or deeds, and such other legal
documents as the Office of the County Attorney may have required
(see above) , the Board hereby authorizes the Finance Department
to issue checks, payable to the property owners of record, in
those amounts as shall be specified on a closing statement which
shall be based upon the amount of compensation specified in the
above-referenced sworn affidavit; and
8. All right-of-way obtained in the manner described above shall
be deemed "accepted" by the Board of County Commissioners, as the
governing board of Collier County, Florida, a political
subdivision of the State of Florida, and as such, staff is hereby
authorized to record in the Public Records of Collier County,
Florida, said easements and/or deeds, and such other instruments
as may be required to remove the lien of any encumbrance from the
public right-of-way.
