Pine Ridge Rd - (US 41 & Airport Rd) Collier County Transportation ROW Pine Ridge Rd - US 41 & Airport Rd e +\ii\ C?", EXECUTIVE SUMMARY RECOMMENDATION TO ADOPT A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTIES BY GIFT OR PURCHASE IN SUPPORT OF THE SIX-LANE IMPROVEMENTS TO PINE RIDGE ROAD (C.R. 896) BETWEEN U.S. 41 AND AIRPORT ROAD (CAPITAL IMPROVEMENT ELEMENT PROJECT NO. 014) , AND AUTHORIZING STAFF TO PROCEED WITH ACTIVITIES REQUIRED TO EXPEDITE SAID PROPERTY ACQUISITION. OBJECTIVE: To obtain authorization from the Board of County Commissioners for the acquisition of properties by gift or purchase for the six-lane improvements to Pine Ridge Road (C.R. 896) , between U.S. 41 and Airport Road, and obtain authorization for staff to proceed with activities required to expedite said property acquisition. CONSIDERATION: The Board of County Commissioners approved the Collier County Five Year Secondary Road Program for FY 1991/92 - 1995/96 on November 12, 1991, thereby establishing priorities for budgeting, design, property acquisition and construction of transportation improvement projects. It is imperative that the required properties for the six-lane improvements be acquired as soon as possible. Staff will acquire either a fee simple or easement interest in order to allow staff flexibility during negotiations with the property owner. If Collier County is unable to obtain the required properties by donation or purchase, staff will return to the Board of County Commissioners with a Condemnation Resolution. The acquisition of the required properties will be accelerated in order to accommodate the proposed construction schedule. Adoption of the attached Resolution will authorize the following: 1. The Chairman to execute the Appraisal Agreement(s) for an amount not to exceed $5,000.00 with the firm(s) previously qualified by the Board of County Commissioners for eminent domain appraisal services; 2. Staff to negotiate for the purchase of the required properties by sworn affidavit in exchange for amounts which do not exceed the compensation estimates as set forth in an appraisal report and authorizes the Finance Department to JUN 0992 r, �,,,� � r .� •" 1 } make payments in those amounts as specified in the Closing /'" Statement which has been approved by the Office of the County Attorney; 3. The Chairman to execute Purchase Agreements, Easement Agreements or any other documents pertinent to acquiring the required properties which have been approved by the Office of the County Attorney; 4. Staff to purchase properties based upon an independent appraisal and the data therefrom obtained on similar properties if the purchase price is less than $100,000.00, pursuant to Chapter 125.355, Florida Statutes; and 5. Staff to record all documents in the Public Records of Collier County Florida, and such other instruments as may be required to remove the lien of any encumbrance from the acquired properties. FISCAL IMPACT: Staff estimates that the total cost of the acquisition phase of the project shall not exceed $43, 300.00. This estimate includes the appraisal and appraisal update fees, value of the land and improvements, severance damages to the remainder properties, if any, and also includes contingencies for settlements above appraised value and condemnation awards. All costs and expenses will be charged against: /.2N, 333-163650-Object Code-69041. Currently there are funds in the seount of $240,000 budgeted and available for land purchase George F. Archibald Administrator Transportation Services GROWTH MANAGEMENT IMPACT: The construction of the improvements to Pine Ridge Road is part of the Transportation Services Division Five Year Secondary Road Program covering FY 1991/92 - 1995/96 and is listed as a Capital Improvement Element (CIE) Number 014 within the County's Comprehensive Plan. RECOMMENDATION: That the Board of County Commissioners adopt and authorize the Chairman to execute the attached Resolution and authorize the acquisition of the properties by gift or purchase and authorize staff to proceed with activities required to expedite said property acquisition. The six-lane improvements to Pine Ridge Road, and the acquisition of proposed right-of-way, as identified in Exhibit "A", attached hereto and incorporated herein, from US-41 to Airport Road, is necessary and in the best interests of the citizens of Collier County, Florida. 2. The Chairman of the Board of County Commissioners is hereby authorized to execute Appraisal Agreements (the combined sum of which shall not exceed $5,000.00), with the appraisal firm(s) which, based upon the analysis and recommendation of staff, is (are) best able to serve the needs of the Project in a timely and cost-effective manner. Such appraisal firm(s) shall be selected from the list of firms pre-qualified by the Board of County Commissioners for eminent domain appraisal services. 3. Staff is hereby authorized to negotiate for the purchase of the required right-of-way; and in those instances wherein property owners agree by sworn affidavit ("Seller's Affidavit" ) to convey the required right-of-way to the County in exchange for amounts which do not exceed the compensation estimates as set forth in the respective appraisal reports, and upon the proper execution by the property owners of those easements and/or deeds, and such other legal documents as the Office of the County Attorney may require, the Board hereby authorizes the Finance JUN 0 99 9 2 F Authorizing Resolution Right-of-Way Acquisition Pine Ridge Road Page 2 Department to make payments in those amounts, and to such entities, as shall be specified on closing statements which have been approved by the Office of the County Attorney. 4. The Board of County Commissioners, in accordance with the provisions of Chapter 125.355, Florida Statutes, hereby waives the requirement for a formal, independent appraisal report for the purchase of each and every right-of-way parcel where the purchase price of the parcel (the compensation due the property owner) is less than $100,000.00. In place of the independent appraisal report, staff is hereby authorized to make purchase offers for the properties, the dollar amounts of which shall be predicated upon the size of the parcel, the improvements (if any) thereon, and consideration and application of appropriate market value and cost data relative to the subject parcels, i.e. , based upon independent appraisals (and the data therefrom) obtained on similar properties. 8. All title to the right-of-way obtained in the manner described above shall be deemed "accepted" by the Board of County Commissioners, as the governing body of Collier County, Florida, a political subdivision of the State of Florida, and as such, staff is hereby authorized to record in the Public Records of Collier County, Florida, said easements and/or deeds, and such other instruments as may be required to remove the lien of any encumbrance from the acquired properties.
