OBJECTIVE: To obtain authorization from the Board of County Commissioners, Collier County, Florida, to acquire by condemnation, if necessary, all rights and interests in real property which are required for the construction of transportation improvements to Immokalee Road (four lane construction from US-41 to I-75. CONSIDERATION: While many of the easements identified on Composite Exhibit "A" to the resolution will be acquired by purchase agreement prior to the date of an Order of Taking hearing, steps must be taken at this time to ensure that a date-certain is established at which time Collier County will have sufficient right and title to enter upon these private lands and construct the roadway improvements. Adoption of the attached Resolutions will permit the Office of the County Attorney to proceed with the preparation of pleadings in eminent domain which shall be necessary to condemn the interests in real property sought by the County. Staff will continue to negotiate for the amicable purchase of the necessary easements in order to minimize the County's exposure for the property owners' attorney fees and other expert witness costs (appraisers, engineers, accountants, etc. ) according to Florida Statutes, Chapter 73.091. FISCAL IMPACT: Updated appraisals indicate the present day value of the easements is approximately $776,000. In addition, professional service fees (both ours and those of the property owner which the County may be directed to pay by the court) could reach $120,000. All costs and expenses will be charged against: 331-163650-(Object Code)-66041 GROWTH MANAGEMENT IMPACT$ None. This project is a part of the Capital Improvement Element of the County's Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners adopt the attached Resolutions, thereby allowing for condemnation of the easements necessary for the four-lane construction of Immokalee Road. WHEREAS, the Board of County Commissioners, on November 12, 1991, adopted the Collier County Five and Ten Year Secondary Road Program for FY 1989/90 through 1994/95 in order to establish priorities for the design, right-of-way acquisition and construction of the various capital improvement projects which comprise the Transportation Element of the County's Comprehensive Plan, and of which Plan the improvements to Immokalee Road (hereinafter referred to as the "Project") are component parts; and WHEREAS, alternate locations, environmental factors, long range planning, cost variables, safety and welfare considerations have been reviewed as they relate to the implementation of said • transportation improvements, and the drainage improvements related ,• to the transportation improvements, and it has been recommended by County engineering staff that the drainage easement described and identified in Exhibit "A" is the most feasible location to construct the drainage improvements which are related to the transportation facilities; and WHEREAS, the construction of said drainage improvements and related transportation facilities has been determined by the Board of County Commissioners of Collier County, Florida, to be necessary and in the best interest of Collier County; and WHEREAS, in accordance with the construction plans for the Project, construction of the transportation improvements and related facilities shall require the acquisition of the drainage easement identified in Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board has considered the environmental factors, safety factors and cost factors relating to the location of the drainage improvements and related transportation facilities. • AND IT IS FURTHER RESOLVED that the Board has determined that there are no mobile homes located upon that land described in Exhibit "A", and that said land is the most economically feasible location in order to permit the construction and maintenance of the drainage improvements and related transportation facilities. AND IT IS FURTHER RESOLVED that the Board has determined that the construction and maintenance of the drainage improvements and related transportation facilities is necessary and in the best interest of Collier County. AND IT IS FURTHER RESOLVED that the construction and maintenance of the drainage improvements and related transportation facilities is compatible with the long range planning goals and objectives of the Growth Management Plan for Collier County. AND IT IS FURTHER RESOLVED that it is necessary and in the best interest of Collier County for the Board to acquire the drainage easement described in Exhibit "A"; and County Staff is hereby authorized and directed to acquire by gift, purchase or condemnation that drainage easement described in Exhibit "A", attached hereto and incorporated herein, in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, and County Staff is hereby directed to institute condemnation proceedings to acquire such drainage easement in the event that the drainage easement cannot be obtained through agreement at the County appraiser's estimate of just compensation due the property owner, and/or it is determined that condemnation is the only feasible method of obtaining the unencumbered interest sought. G' > 11■11[ /, • RESOLUTION NO. 92- 2?7 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF n COLLIER COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION OF A DRAINAGE EASEMENT BY GIFT, PURCHASE OR CONDEMNATION, WHICH IS NECESSARY FOR THE CONSTRUCTION AND MAINTENANCE OF TRANSPORTATION IMPROVEMENTS ON IMMOKALEE ROAD (CR-846) BETWEEN US-41 AND EAST OF AIRPORT ROAD. WHEREAS, the Board of County Commissioners, on November 12, 1991, adopted the Collier County Five and Ten Year Secondary Road Program for FY 1989/90 through 1994/95 in ordor to establish priorities for the design, right-of-way acquisition and construction of the various capital improvement projects which comprise the Transportation Element of the County's Comprehensive Plan, and of which Plan the improvements to Immokalee Road (hereinafter referred to as the "Project") are component parts; and WHEREAS, alternate locations, environmental factors, long range planning, cost variables, safety and welfare considerations have been reviewed as they relate to the implementation of said transportation improvements, and the drainage improvements related to the transportation improvements, and it has been recommended by County engineering staff that the drainage easement described and identified in Exhibit "A" is the most feasible location to construct the drainage improvements which are related to the transportation facilities; and WHEREAS, the construction of said drainage improvements and related transportation facilities has been determined by the Board of County Commissioners of Collier County, Florida, to be necessary and in the best interest of Collier County; and WHEREAS, in accordance with the construction plans for the Project, construction of the transportation improvements and related facilities shall require the acquisition of the drainage easement identified in Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board has considered the environmental factors, safety factors and cost factors relating to the location of the drainage improvements and related transportation facilities. n AND IT IS FURTHER RESOLVED that the Board has determined that there are no mobile homes located upon that land described in Exhibit "A", and that said land is the most economically feasible location in order to permit the construction and maintenance of the drainage improvements and related transportation facilities. AND IT IS FURTHER RESOLVED that the Board has determined that the construction and maintenance of the drainage improvements and related transportation facilities is necessary and in the best interest of Collier County. AND IT IS FURTHER RESOLVED that the construction and maintenance of the drainage improvements and related transportation facilities is compatible with the long range planning goals and objectives of the Growth Management Plan for Collier County. AND IT IS FURTHER RESOLVED that it is necessary and in the best interest of Collier County for the Board to acquire the drainage easement described in Exhibit "A"; and County Staff is hereby authorized and directed to acquire by gift, purchase or condemnation that drainage easement described in Exhibit "A", attached hereto and incorporated herein, in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, and County Staff is hereby directed to institute condemnation proceedings to acquire such drainage easement in the event that the drainage easement cannot be obtained through agreement at the County appraiser's estimate of just compensation due the property owner, and/or it is determined that condemnation is the only feasible method of obtaining the unencumbered interest sought. Resolution w/exhibit (3 pgs. ) (4 pgs. ) 1/87-S13 5. • EXECUTIVE S UM MARY RECOMMENDATION TO ADOPT A RESOLUTION AUTHORIZING THE ACQUISITION OF RIGHT-OF-WAY REQUIRED FOR THE CONSTRUCTION OF ROAD, UTILITY AND DRAINAGE IMPROVEMENTS TO IMMOKALEE ROAD ( CR-846 ) , FROM US-41 TO INTERSTATE I-75 (CIE NO. 006 ) , AND TO GRANT PROJECT AUTHORITY TO THE COUNTY ATTORNEY AND THE TRANSPORTATION SERVICES ADMINISTRATOR TO EXPEDITE RIGHT-OF-WAY ACQUISITION AND CONSTRUCTION. OBJECTIVE: To obtain authorization from the Board of County Commissioners, Collier County, Florida, to acquire right-of-way required for the construction of road, utility and drainage improvements to Immokalee Road, from US-41 to Interstate I-75 , and to obtain Board authorization to expedite the appraisal and negotiation phases of the project. CONSIDERATION: Adoption of the attached resolution will authorize the selection of (an ) appraisal firm( s ) from the list of a firms pre-qualified and approved by the Board of County PPraisal Commissioners for work on right-of-way acquisition projects; and will authorize the Finance Department to make immediate payment to property owners who have agreed to convey to the County, at or below the estimate of compensation as specified in the appraiser' s Certificate of Appraisal , the right-of-way required for construction of the project. The attached resolution is virtually n identical to that adopted by the Board authorizing right-of-way acquisition activities in support of the Radio' Road four-laning project which the Transportation Services Division, at that time, proposed for use on most major right-of-way acquisition projects where time is a major constraint . Past practices which staff is hereby attempting gto streamline, o Returning to the Board, after the initial authorization to acquire, for subsequent authorization to begin the competitive selection process for appraisal firms , and then returning to the full Board for subsequent approval of the Appraisal Agreement; and o Returning to the Board, after negotiations , for the subsequent approval and execution of a bilateral purchase agreement for each and every purchase on the project (regardless of the dollar amount of the purchase) . Adoption of the attached Resolution will also confirm that, once acquired and recorded in the Public Records of Collier County, Florida, the right-of-way for this Project shall be formally "accepted" by the Board of County Commissioners, Collier County, Florida, for the following purposes: o Four lane construction, and drainage and utilities installation on Immokalee Road ( from US-41 to Interstate I-75 ) ; and o Maintenance of all improvements as required for public safety; and o Exercise of the County' s police powers. FISCAL IMPACT: Preliminary estimates indicate the total cost of the right-of-way acquisition phase of the project to be $2 , 437 , 900 in Fiscal Year 1990/91 . This estimate includes all service fees ( title search, appraisals, attorneys ) , the value of the land and improvements and any severance damages to the remainder properties, n and also includes contingencies for settlements above appraised value and for condemnation awards ( see cost summary attachments ) . All costs and expenses will be charged against: 313-163673-(Object Code)-66041. GROWTH MANAGEMENT IMPACT: The construction of improvements to Immokalee Road is part of the Transportation Services Five Year Secondary Road Program covering FY 89/90 through FY 94/95 and is listed as a Capital Improvement Element (CIE) Number 006 within the County' s Comprehensive Plan. WHEREAS, on June 8, 1990, the Board of County Commissioners, adopted the Collier County Five and Ten Year Secondary Road Program for FY 1989/90 - 1994/95 AND FY 1995/96 - FY 1999/00, therein establishing priorities for budgeting, design, right-of- way acquisition and construction of capital road improvement projects; and WHEREAS, the construction of Immokalee Road (CR-846) four-laning improvements between US-41 and Interstate I-75 is scheduled to begin during the First Quarter of 1991, pursuant to the adopted Secondary Road Program; and WHEREAS, the Collier of County entered into an engineering contract with Hole Montes and Associates to prepare the engineering design plans for Immokalee Road• (CR-846) four-laning improvements between US-41 and Interstate I-75; and WHEREAS, it is necessary and in the best interest of Collier County, Florida, to acquire either by perpetual, non-exclusive easement or by . fee simple purchase the additional right-of-way along the Immokalee Road corridor for the construction, installation, operation and maintenance of a public roadway and associated drainage and utility facilities, as shown on the plans prepared by Hole Montes and Associates, and as approved by the Collier County Transportation Division; and WHEREAS, the expeditious acquisition of right-of-way along Immokalee Road (see Exhibit "A" - Preliminary Right-of-Way Map) is of paramount importance to completing the Project on schedule, attaining infrastructure goals in accordance with the Transportation Element of the County's Growth Management Plan; and WHEREAS, accomplishing the right-of-way acquisition and construction on or ahead of schedule shall require a properly " coordinated team effort by the Transportation Services Division, the Real Property Management Department and the Office of the County Attorney, wherein certain routine processes may have to be streamlined and compressed into the shortest possible time- frames, provided however, that such time-frames shall allow for quality work product by both staff and consultants, and which shall not discredit nor aver from the requirement for conducting good-faith negotiations for the purchase of required right-of- way; /""\ NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. The four-laning improvements to Immokalee Road (CR-846) and the acquisition of the rights-of-way as defined in Exhibit "A", attached hereto and incorporated herein, from US-41 to Interstate 1-75, are necessary and in the best interest of the citizens of Collier County, Florida. 2. Negotiations for the acquisition of said right-of-way by gift or by purchase up to the appraised value, in either fee simple or by perpetual, non-exclusive easement, are hereby authorized. 3. The Board of County Commissioners of Collier County, Florida, recognizes the critical nature of the Immokalee Road Project Schedule and its relationship to meeting the levels of service required by the Transportation Element of Collier County's Comprehensive Plan, and further recognizes that some ordinary County processes and standard operating procedures relative to consultant selection and right-of-way acquisition may negatively impact the Project Schedule. 4. In accordance with the above-stated recognition by the Board of County Commissioners, the Transportation Services Administrator is hereby delegated the authority to negotiate with appraisal firms from the existing Board-approved list of appraisers, and the Chairman of the Board of County Commissioners is hereby authorized to execute Appraisal Agreements (the combined sum of which shall not exceed $40,000) , with the appraisal firm(s) which, based upon the analysis and recommendation of staff, is (are) best able to serve the needs of the Project in a timely and cost-effective manner. ' 5. Upon the approval by the County Attorney's Office of all Real mPropertyeManagement Department cstaff gis hereby encouraged to offer immediate delivery to the respective property owners, of the full compensation (as established by the appraisal), in return for the immediate and proper execution of the respective easements and/or deeds, and such other legal documents and/or affidavits as the County Attorney's Office deems appropriate in order to protect the interests of the County. 6. In lieu of those standard procedures, whereby an Easement Agreement or Purchase Agreement is executed by a property owner subsequent to negotiations, which agreement is then placed upon the Board meeting agenda for execution by the Chairman, all before a Requisition and Purchase Order may be approved allowing the Finance Department to issue a check for closing, the Board of County Commissioners of Collier County, Florida, hereby authorizes staff to negotiate with the respective property owners for the purchase of the required right-of-way, and in those instances wherein the property owner agrees, by sworn affidavit, to convey the required right-of-way to the County in exchange for compensation in an amount not to exceed the appraisal report, and upon the proper execution by the property owner of those easements and/or deeds, and such other legal documents as the Office of the County Attorney may have required (see above) , the Board hereby authorizes the Finance Department to issue checks, payable to the property owners of record, in those amounts as • upon the amount of compensation specified in the above-referenced appraisal report. 7. All right-of-way obtained in the manner described above shall be deemed "accepted" by the Board of County Commissioners, as the governing board of Collier County, Florida, a political subdivision of the State of Florida, and as such, staff is hereby authorized to record in the Public Records of Collier County, Florida, said easements and/or deeds, and such other instruments as may be required to remove the lien of any encumbrance from the public right-of-way.
