RECOMMENDATION THAT THE BOARD ADOPT A RESOLUTION AUTHORIZING THE
ACQUISITION BY GIFT,PURCHASE OR CONDEMNATION OF FEE SIMPLE TITLE FOR
ROAD RIGHT-OF-WAY FOR PARCEL 102A REQUIRED TO COMPLETE THE
FOUR LANING ROADWAY IMPROVEMENTS FOR C.R. 951 PHASE II FROM
RATTLESNAKE-HAMMOCK ROAD TO DAVIS BOULEVARD.
OBJECTIVE: To adopt a Resolution to acquire by gift, purchase or condemnation the fee simple
title for road right-of-way for Parcel 102A required to complete the four-laving roadway
improvements for C.R. 951 Phase II from Rattlesnake Hammock Road to Davis Boulevard.
CONSIDERATION: On September 27, 1994, the Board of County Commissioners adopted
Ordinance No. 94-54 therein establishing the 1994 (Sixth Annual) Capital Improvement Element of
the Growth Management Plan.
On April 5, 1994,the Board of County Commissioners adopted Resolution No. 94-225 authorizing the
County Staff to acquire by gift or purchase certain easements and fee simple title to the property and
PIN property interests required and necessary for the four-laving roadway improvement of C.R. 951 Phase II
from Rattlesnake Hammock Road to Davis Boulevard.
Staff has reviewed alternative locations, environmental factors, cost variables, safety and welfare
considerations as they relate to the construction of the Project and the Board finds that the most feasible
location for the additional road right-of-way for the construction of this Project is to Parcel No. 102A,
being more particularly described in Exhibit"A" of the attached Resolution.
FISCAL IMPACT: The sum of$28.130 is the maximum fiscal impact for the acquisition and
condemnation expenses for the fee simple interest,referenced in Exhibit "A", required to complete the
four-laning roadway improvements for C.R. 951 Phase II from Rattlesnake Hammock Road to Davis
Boulevard.
Road projects are funded across several gas tax and road impact fee funds; therefore, payment of all
expenses for this Project will be paid from Fund Nos. 331-340 in Cost Center No. 163650, Project No.
66061, for C.R. 951 Phase II from Rattlesnake Hammock Road to Davis Boulevard.
GROWTH MANAGEMENT IMPACT: As a Capital Improvement Element project, the
recommendation is consistent with the County's Growth Management Plan.

DAVIS BOULEVARD.
WHEREAS,the Board of County Commissioners,on September 27, 1994,adopted
Ordinance No.94-54 therein establishing the 1994(Sixth Annual)Capital Improvement Element
of the Growth Management Plan in order to establish priorities for the design,acquisition and
construction of the various capital improvement projects which comprise the Transportation
Element of the County's Comprehensive Plan;and
• WHEREAS,the four-laning improvements to C.R.951 Phase II from Rattlesnake
Hammock Road to Davis Boulevard are component parts of the Transportation Element of the
County's Comprehensive Plan;and
WHEREAS,the Board of County Commissioners,on April 5, 1994,adopted Resolution
No.94-225 authorizing the County Staff to acquire by gift or purchase certain easements or fee
simple title to the property and property interests required and necessary for the four-laning
/'"■ roadway improvements of C.R.951 Phase II from Rattlesnake Hammock Road to Davis
Boulevard;and
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that it has been determined by the
Board that the construction of the four-laning roadway improvements for C.R.951 Phase H from
Rattlesnake Hammock Road to Davis Boulevard,(hereinafter referred to as"the Project")is
necessary and in the public's best interest in order to protect the health,safety and welfare of the
citizens of Collier County.
AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff analysis
regarding alternative locations,environmental factors,cost variables,safety and welfare
• considerations as they relate to the construction of the Project and finds that the most feasible
location for the road right-of-way for C.R.951 in the area of Parcel No. 102A is the property
described in Exhibit"A"attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that the construction of the Project is part of the
County's long range plan that is included in the Transportation Element of the County's
Comprehensive Plan;

12 WHEREAS, the Board of County Commissioners, on September 27, 1994
• 13 adopted Ordinance No. 94-54 therein establishing the 1994 (Sixth
14 Annual) Capital Improvement Element of the Growth Management Plan in
15 order to establish priorities for the design, acquisition and
16 construction of the various capital improvement projects which
17 comprise the Transportation Element of the County's Comprehensive
18 Plan; and
19 WHEREAS, the four-laning roadway improvements to C.R. 951 Phase II
20 from Rattlesnake-Hammock Road to Davis Boulevard are component parts
21 of the Transportation Element of the County's Comprehensive Plan; and
22 WHEREAS, the Board of County Commissioners on April 5, 1994,
23 adopted Resolution No. 94-225 authorizing the County Staff to acquire
24 by gift or purchase certain easements and fee simple title to the
25 property and property interests required and necessary for the
26 four-laving roadway improvements of C.R. 951 Phase II from
27 Rattlesnake-Hammock Road to Davis Boulevard; and
28 WHEREAS, the County Staff has evaluated alternative locations,
29 reviewed the environmental factors, considered the cost variables, and
30 analyzed the safety and welfare considerations as they relate to the
31 construction of the four-laving roadway improvements for C.R. 951
32 Phase II from Rattlesnake-Hammock Road to Davis Boulevard; and

6 WHEREAS, the County Staff has recommended that it is necessary and
7 in the best interest of Collier County, Florida, to acquire certain
• 8 non-exclusive, perpetual road right-of-way, drainage, utility and
9 maintenance easements which are required and necessary for the
10 construction of the four-laning roadway improvements for C.R. 951
• 11 Phase II from Rattlesnake-Hammock Road to Davis Boulevard; and
12 WHEREAS, the construction of the four-laning roadway improvements
13 for C.R. 951 Phase II from Rattlesnake-Hammock Road to Davis Boulevard
• 14 is necessary in order to protect the health, safety and welfare of the
15 citizens of Collier County and is in the best interest of Collier
16 County.
17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS-
18 SIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the
19 Board that the construction of the four-laning roadway improvements
20 for C.R. 951 Phase II from Rattlesnake-Hammock Road to Davis Boulevard
21 (hereinafter referred to as "the Project") is necessary for a public
22 purpose and is in the best interests of Collier County.
23 AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff
24 analysis regarding alternative locations, environmental factors, cost
25 variables, safety and welfare considerations as they relate to the
26 construction of the Project and finds that the most feasible location
27 for the certain non-exclusive, perpetual road right-of-way, drainage,
28 utility and maintenance easements are described in Exhibit "A"
29 attached hereto.
30 AND IT IS FURTHER RESOLVED that the construction of the Project is
31 part of the County's long range plan that is included in the Trans-
32 portation Element of the County's Comprehensive Plan.

1 AND IT IS FURTHER RESOLVED that to implement said construction of
2 the Project it is appropriate and necessary for the Board to acquire
3 certain non-exclusive, perpetual road right-of-way, drainage, utility
4 and maintenance easements described in the attached Exhibit "A",
5 attached hereto and incorporated herein, which are necessary for the
6 construction of the four-laning roadway improvements for the C.R. 951
7 Phase II from Rattlesnake-Hammock Road to Davis Boulevard.
8 AND IT IS FURTHER RESOLVED that the County staff is hereby
9 authorized to immediately acquire by gift, purchase or condemnation in
10 accordance with the provisions of Chapters 73, 74 and 127, Florida
11 Statutes, the certain non-exclusive, perpetual road right-of-way,
12 drainage, utility and maintenance easements being more particularly
13 described in Exhibit "A", attached hereto and incorporated herein.
14 AND IT IS FURTHER RESOLVED that no mobile homes are located on the
15 property sought to be acquired and therefore it will not be necessary
16 to remove any mobile homes from the property to be acquired.

ROAD RIGHT-OF-WAY, DRAINAGE, UTILITY AND MAINTENANCE EASEMENTS FOR THE
CONSTRUCTION OF THE FOUR-LANING ROADWAY IMPROVEMENTS FOR C.R. 951 PHASE
II FROM RATTLESNAKE-HAMMOCK ROAD TO DAVIS BOULEVARD.
WHEREAS, the Board of County Commissioners, on September 27, 1994
adopted Ordinance No. 94-54 therein establishing the 1994 (Sixth
Annual) Capital Improvement Element of the Growth Management Plan in
order to establish priorities for the design, acquisition and
construction of the various capital improvement projects which comprise
the Transportation Element of the County's Comprehensive Plan; and
WHEREAS, the four-laning roadway improvements to C.R. 951 Phase II
from Rattlesnake-Hammock Road to Davis Boulevard are component parts of
the Transportation Element of the County's Comprehensive Plan; and
WHEREAS, the Board of County Commissioners on April 5, 1994,
adopted Resolution No. 94-225 authorizing the County Staff to acquire
/by gift or purchase certain easements and fee simple title to the
operty and property interests required and necessary for the
four-laning roadway improvements of C.R. 951 Phase II from
Rattlesnake-Hammock Road to Davis Boulevard; and
WHEREAS, the County Staff has evaluated alternative locations,
reviewed the environmental factors, considered the cost variables, and
analyzed the safety and welfare considerations as they relate to the
construction of the four-laning roadway improvements for C.R. 951 Phase
II from Rattlesnake-Hammock Road to Davis Boulevard; and
WHEREAS, the County Staff has recommended that it is necessary and
in the best interest of Collier County, Florida, to acquire certain
non-exclusive, perpetual road right-of-way, drainage, utility and
maintenance easements which are required and necessary for the
construction of the four-laning roadway improvements for C.R. 951 Phase
II from Rattlesnake-Hammock Road to Davis Boulevard; and
•

WHEREAS, the construction of the four-laning roadway improvements
for C.R. 951 Phase II from Rattlesnake-Hammock Road to Davis Boulevard
is necessary in order to protect the health, safety and welfare of the
citizens of Collier County and is in the best interest of Collier
County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS-
SIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the
Board that the construction of the four-laning roadway improvements for
C.R. 951 Phase II from Rattlesnake-Hammock Road to Davis Boulevard
(hereinafter referred to as "the Project") is necessary for a public
purpose and is in the best interests of Collier County.
AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff
analysis regarding alternative locations, environmental factors, cost
/ %riables, safety and welfare considerations as they relate to the
construction of the Project and finds that the most feasible location
for the certain non-exclusive, perpetual road right-of-way, drainage,
utility and maintenance easements are described in Exhibit "A" attached
hereto.
AND IT IS FURTHER RESOLVED that the construction of the Project is

RECOMMENDATION TO ADOPT A RESOLUTION AUTHORISING THE ACQUISITION OF PERPETUAL
RIGHT-OF-WAY, UTILITY, DRAINAGE AND MAINTENANCE EASEMENTS, TEMPORARY CONSTRUCTION
EASEMENTS OR FEE SIMPLE TITLE BY GIFT OR PURCHASE WHICH ACQUISITIONS ARE REQUIRED
FOR THE WIDENING IMPROVEMENTS OF C.R. 951 PHASE II (FROM C.R. 864 (RATTLESNAKE
HAMMOCK ROAD) TO S.R. 84 (DAVIS BOULEVARD)) .
OBJECTIVE: To obtain authorization from the Board of County Commissioners, Collier
County, Florida, to acquire by gift or purchase all rights and interests in real
property which are required for the construction and maintenance of transportation
improvements for the portion of C.R. 951 roadway from C.R. 864 (Rattlesnake Hammock
Road) to S.R. 84 (Davis Boulevard) .
CONSIDERATION: On October 26, 1993, the Board of County Commissioners adopted
Ordinance 93-78 and Resolution 93-493 therein establishing the 1993 (Fifth Annual)
Capital Improvement Element of the Growth Management Plan. These documents
reaffirm previous authorizations to staff to implement widening improvements to
C.R. 951 Phase II Project.
Adoption of the attached Resolution will authorize the selection of (an) appraisal
firm(s) from the list of appraisal firms pre-qualified and approved by the Board of
County Commissioners for work on right-of-way acquisitions projects; and will
authorize the Finance Department to make immediate payments to property owners who
have agreed to convey to the County.
Adoption of the attached Resolution establishes that the Director of the Office of
Capital Projects Management, or his designee, is delegated the authority to approve
the purchase of land interests above the staff compensation estimate or appraised
value (administrative settlements) and pay normally related costs when it is in the
best interest of the project, only when the difference between the proposed
settlement and the staff compensation estimate or appraised value is less than Six
Thousand Five Hundred and 00/100 Dollars ($6,500.00) . This settlement approval
authority is delegated by the Board of County Commissioners to the extent that such
approvals do not conflict with the provisions of Section 125.355, Florida Statutes.
Adoption of the attached Resolution will also confirm that, once acquired and
recorded in the Public Records of Collier County, Florida, the right-of-way for
this Project shall be formally "accepted" by the Board of County Commissioners,
Collier County, Florida.
FISCAL IMPACT: Preliminary appraisals indicate that the cost of the perpetual road
right-of-way, utility, drainage and maintenance easements or fee simple title
purchases shall not be in excess of $210,100.00. This amount includes all service
fees (title searches, appraisals, attorneys), the value of the land and
improvements and any severance damages to the remainder of the properties. A
Budget Amendment will be necessary to transfer $110,100 from reserves in Fund 336
to account number 336-163650-761100-66062. All purchases will be charged against
this account number.
GROWTH MANAGEMENT IMPACT: As a Capital Improvement Element project, the
'^ recommendation is consistent with the County's Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners adopt the attached
Resolution authorizing the acquisition by gift or purchase of perpetual road
right-of-way, utility, drainage and maintenance easements, temporary construction
easements or fee simple title which are required quired for the construction of the
widening improvements to C.R. 951 Phase II from C.R. 864 (Rattlesnake Hammock
Road) to S.R. 84 (Davis Boulevard) and approve the necessary Budget Amendment.

WHEREAS, the Board of County Commissioners, on October 26, 1993,
adopted Ordinance 93-78 and Resolution 93-493 therein establishing the

right-of-way acquisition and construction of the various capital
improvement projects which comprise the Transportation Element of the
County's Comprehensive Plan, and of which Plan the four-laning
improvements to C.R. 951 from C.R. 864 (Rattlesnake Hammock Road) to
S.R. 84 (Davis Boulevard) Phase II (hereinafter referred to as the
"Project") are component parts; and
WHEREAS, alternate locations, environmental factors, long range
planning, cost variables, concurrence, and safety and welfare
considerations have been reviewed as they relate to the implementation
of said transportation improvements; and it has been recommended by
County Staff that it is necessary and in the best interest of Collier
County, Florida, to maintain flexibility over the acquisition of
. property rights required for the construction of the improvements (see
Exhibit "A") either by perpetual exclusive easements, non-exclusive
easements or by fee simple acquisitions; and
WHEREAS, the construction of said transportation improvements and
related facilities has been determined by the Board of County
Commissioners of Collier County, Florida, to be necessary and in the
best interest of Collier County; and
WHEREAS, the construction of the transportation improvements and
related facilities contemplated by the Project is necessary in order to
protect the health, safety and welfare of the citizens of Collier
County, and will help Collier County meet the concurrence requirements
)f the Growth Management Plan for Collier County.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSION-
OF COLLIER COUNTY, FLORIDA, that:
1. The Board has considered the environmental factors, safety factors
and cost factors relating to the location of the transportation im-
provements and related facilities.
2. The road right-of-way, utility, drainage and maintenance ease-
ments, temporary construction easements or fee simple acquisitions
identified on Exhibit "A" are the most feasible locations in order to
permit the construction and maintenance of the transportation
improvements and related facilities.
3. The Board has determined that the construction and maintenance of
the transportation improvements and related facilities are necessary
and in the best interest of Collier County.
^4. The construction and maintenance of the transportation improve-
ments and related facilities are compatible with the long range
planning goals and objectives of the Growth Management Plan for Collier
County.
5. It is necessary and in the best interest of Collier County for the
Board to acquire the road right-of-way, utility, drainage and
maintenance easements, temporary construction easements or fee simple
title identified in Exhibit "A"; and County Staff is hereby authorized
and directed to acquire by gift or purchase the road right-of-way,
utility, drainage and maintenance easements, temporary construction
easements and/or the fee simple title of the properties identified in
Exhibit "A", attached hereto and incorporated herein.
6. The Chairman of the Board of County Commissioners is hereby
authorized to execute Appraisal Agreements with the appraisal firm(s)
selected from the list of firms pre-qualified by the Board of County

Commissioners. The Board further directs staff to use appraisal
- ...reports or internal compensation estimates as staff determines is
necessary to best serve the needs of the Project in a timely and cost-
effective manner.
7. The Board of County Commissioners, in accordance with the pro-
visions of Chapter 125.355, Florida Statutes, hereby formally waives
the requirement for a formal, independent appraisal report for the
purchase of a property where the purchase price of the parcel (the
compensation due to the property owner) is less than One Hundred
Thousand and 00/100 Dollars ($100,000.00) . In lieu of the independent
appraisal report, staff is hereby authorized to make purchase offers
for the properties, the dollar amounts of which shall be predicated on
"staff compensation estimates" based upon independent appraisals (and
the data therefrom) obtained on similar properties and upon
consideration and application of appropriate market value and cost data
pertinent to the subject parcels.
3. Upon the approval by the County Attorney's Office of all documents
necessary for the subject property acquisition, Real Property Manage-
ment Department staff is hereby directed to offer immediate delivery to
the respective property owners of the full compensation (as establish-
ed by the appraisal or staff compensation estimates in accordance with
the provisions of Chapter 125.355, Florida Statutes) , in return for the
immediate and proper execution of the respective easements and/or
deeds, and such other legal documents and/or affidavits as the County
Attorney's Office deems appropriate in order to protect the interests
of the County; and the Board of County Commissioners hereby authorizes
its present Chairman and any subsequent Chairman, for the life of the
Project, to execute any instruments which have been approved by the
Office of the County Attorney, to remove the lien of any encumbrance
and for any such other purpose as may be required for the acquired road
right-of-way, utility, drainage and maintenance easements, temporary
construction easements or fee simple title.

9. In those instances where negotiated settlements may be obtained
via the "Seller's Affidavit", "Purchase Agreement" or "Easement
Agreement" mechanism, the Director of the Office of Capital Projects
Management, or his designee, is charged with the responsibility for
completion of the various capital improvement projects and is hereby
delegated the authority to approve the purchase of land interests above
the staff compensation estimate or appraised value and pay normally
related costs when it is in the best interest of the Project, within
the pro-rata share of the land rights acquisition budget for the parcel
being acquired, only when the difference between the purchase price and
staff compensation estimate or appraised value is less than Six
Thousand Five Hundred and 00/100 Dollars ($6,500.00) . This settlement
approval authority is delegated by the Board of County Commissioners to
the extent that such approvals do not conflict with the provisions of
Section 125.355, Florida Statutes.
10. The Chairman of the Board of County Commissioners is hereby
authorized to execute Purchase Agreements and Easement Agreements where
the land owner has agreed to sell the required land rights to the
County at its appraised value or at that amount considered the
"Administrative Settlement Amount" as such term is internally used by
the administrative agencies of Collier County.
11. Where the property owner agrees, by sworn affidavit or agreement
("Seller's Affidavit", "Purchase Agreement" or "Easement Agreement") ,
to convey a necessary interest in real property to the County, and upon
the proper execution by the property owner of those easements and/or
deeds, and such other legal documents as the Office of the County
Attorney may require, the Board hereby authorizes the Finance
Department to issue warrants, payable to the property owner(s) of
record, in those amounts as shall be specified on a closing statement
and which shall be based upon the appraisal or staff compensation
estimate in accordance with this Resolution and the provisions of
'"3ection 125.355, Florida Statutes.

' \l2. All title to properties or interests in properties which have been
obtained in the manner described above shall be deemed "accepted" by
the Board of County Commissioners, as the governing body of Collier
County, Florida, a political subdivision of the State of Florida, and
as such, staff is hereby authorized to record in the Public Records of
Collier County, Florida, said deeds or easements and such other
instruments as may be required to remove the lien of any encumbrance
from the acquired properties.

A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND BY GIFT,
PURCHASE OR CONDEMNATION OF A FEE SIMPLE INTEREST FOR THE
CONSTRUCTION OF THE FOUR-LANING ROADWAY IMPROVEMENTS
FOR C.R. 951 PHASE II FROM RATTLESNAKE HAMMOCK ROAD TO
DAVIS BOULEVARD.
WHEREAS,the Board of County Commissioners,on September 27, 1994,adopted
Ordinance No.94-54 therein establishing the 1994(Sixth Annual)Capital Improvement Element
of the Growth Management Plan in order to establish priorities for the design,acquisition and
construction of the various capital improvement projects which comprise the Transportation
Element of the County's Comprehensive Plan;and
WHEREAS,the four-lasng improvements to C.R.951 Phase II from Rattlesnake
Hammock Road to Davis Boulevard are component parts of the Transportation Element of the
County's Comprehensive Plan;and
HE:•. AS,the Board of County Commissioners,on April 5, 1994,adopted Resolution
No.94-225 authorizing the County Staff to acquire by gift or purchase certain easements or fee
simple title to the property and property interests required and necessary for the four-laning
n roadway improvements of C.R.951 Phase II from Rattlesnake Hammock Road to Davis
Boulevard;and
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that it has been determined by the
Board that the construction of the four-laning roadway improvements for C.R.951 Phase II from
Rattlesnake Hammock Road to Davis Boulevard,(hereinafter referred to as"the Project")is
necessary and in the public's best interest in order to protect the health,safety and welfare of the
citizens of Collier County.
AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff analysis
regarding alternative locations,environmental factors,cost variables,safety and welfare
considerations as they relate to the construction of the Project and finds that the most feasible
location for the road right-of-way for C.R.951 in the area of Parcel No. 102A is the property
described in Exhibit"A"attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that the construction of the Project is part of the
County's long range plan that is included in the Transportation Element of the County's
Comprehensive Plan;
AND IT IS FURTHER RESOLVED that to implement construction of the Project it is
"*1 appropriate and necessary for the Board to acquire fee simple title in the property identified as

Parcel No. 102A, which is more particularly described in Exhibit"A",attached hereto and
incorporated herein.
AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to
immedi:441y a,.luire by gift,purchase or condemnation in accordance with the provisions of
Chapters 73,74 and 127,Florida Statutes,fee simple title to the property identified as Parcel No.
102A,being more particularly described in Exhibit"A",attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the property
sought to be acquired and therefore it will not be necessary to remove any mobile homes from the
property to be acquired.
This Resolution adopted on this /4 day of . 1997,after motion,
second and majority vote.
