EXECUTIVE SUMMARY Alcor(cpeel- RECOMMENDATION TEAT TIE BOARD ADOPT A RESOLUTION AUTHORISING THE ACQUISITION BY • Pi GIFT, PURCHASE OR CONDEMNATION THE EASEMENT INTERESTS FOR DRAINAGE AND TEMPORARY CONSTRUCTION PURPOSES FOR TEE PROJECT PARCELS REQUIRED TO COMPLETE TEE BONITA BEACH ROAD FOUR LAMING IMPROVEMENTS (BETWEEN FORESTER ROAD TO VANDERBILT DRIVE), CIE NO. 031. OBJECTIVE: To obtain authorization from the Board of County Commissioners, Collier County, Florida, to acquire by gift, purchase or condemnation the easement interests for drainage and temporary construction purposes for the Project Parcels required to complete the Bonita Beach Road four laning improvements (between Forester Road to Vanderbilt Drive), CIE No. 031. CONSIDERATION: On October 26, 1993, the Board of County Commissioners adopted Ordinance No. 93-78 and Resolution 93-493 therein establishing the 1993 (Fifth Annual) Capital Improvement Element of the Growth Management Plan. These documents reaffirm previous authorizations to staff to implement four laning improvements to Bonita Beach Road with the construction start date planned for November 1994. Staff has reviewed alternative locations, environmental factors, cost variables, safety and welfare consideration as they relate to the construction of the Project for the south side of Bonita Beach Road (Lee County is acquiring the north side of Bonita Beach Road) and the Board finds that the most feasible locations for the additional drainage easement and temporary construction easements are to the Project Parcels, being more particularly described in Exhibit "A" of the attached / Resolution. FISCAL IMPACT: The sum of $183,248 is the total fiscal impact for the acquisition and condemnation expenses for the easements for the Bonita Beach Road four laning Project which is comprised of the following costs: MISCELLANEOUS EXPENSES TYPE OF PARCEL LAND COSTS APPRAISAL COSTS (Attornev/CPA/Court Fees) Drainage Easements $ 16,841 $ 5,206 $ 5,117 (3 Parcels) Temporary Construction Easements (22 Parcels) $ 80,377 $ 38,176 $ 37,531 Total $183,248 $ 97,218 $ 43,382 $ 42,648 (25 Parcels) Cost: The sum of $183,248 is the fiscal impact for the acquisition and condemnation expenses associated with the easements for the Bonita Beach Road four laning Project. (The amount of $390,800 is the total fiscal impact for fee and easement acquisitions for the Bonita Beach Road four laning Project) . PIO! j(3 MAY 1794 - RESOLUTION NO. 94- 356 A RESOLUTION AUTHORIZING THE ACQUISITION OF NON- EXCLUSIVE PERPETUAL DRAINAGE EASEMENTS AND TEMPORARY CONSTRUCTION EASEMENTS FOR THE CONSTRUCTION OF THE ROADWAY FOUR-LANING OF BONITA BEACH ROAD PHASE II (BETWEEN FORESTER ROAD AND VANDERBILT DRIVE) . WHEREAS, the Board of County Commissioners on October 26, 1993 adopted Ordinance No. 93-78 and Resolution No. 93-493 establishing the 1993 (Fifth Annual) Capital Improvement Element of the Growth Management Plan in order to establish priorities for the design, acquisition and construction of the various capital improvement projects which comprise the Transportation Element of the County's Comprehensive Plan; and WHEREAS, the four-laning improvements to Bonita Beach Road between Forester Road and Vanderbilt Drive are component parts of the Transportation Element of the County's Comprehensive Plan; and WHEREAS, the Board of County Commissioners on December 7, 1993 adopted Resolution No. 93-550 authorizing the County Staff to acquire by gift or purchase certain easements and fee simple title to the property and property interests required and necessary for the four-lane construction of Bonita Beach Road Phase II between Forester Road and Vanderbilt Drive; and WHEREAS, the County Staff has evaluated alternative locations, reviewed the environmental factors, considered the cost variables, and analyzed the safety and welfare considerations as they relate to the construction of the four-lane improvements for Bonita Beach Road Phase II, between Forester Road and Vanderbilt r Drive; and WHEREAS, the County Staff has recommended that it is necessary and in the best interest of Collier County, Florida, to acquire certain non-exclusive perpetual drainage easements and temporary construction easements are required and necessary for the construction of the four-laning of Bonita Beach Road Phase II, between Forester Road and Vanderbilt Drive; and WHEREAS, the construction of the four-laning of Bonita Beach 1 Road Phase II, between Forester Road and Vanderbilt Drive is necessary in order to protect the health, safety and welfare of the citizens of Collier County and is in the best interest of Collier County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the Board that the construction of the four-laning of Bonita Beach Road Phase II, between Forester Road and Vanderbilt Drive (hereinafter referred to as "the Project") is necessary for a public purpose and is in the best interests of Collier County. AND IT IS FURTHER RESOLVED that the Board reviewed the Staff analysis regarding alternative locations, environmental factors, cost variables, safety and welfare considerations as they relate to the construction of the Project and finds that the most feasible locations for the certain non-exclusive perpetual drainage easements and temporary construction easements are described in Exhibit "A" attached hereto; and AND IT IS FURTHER RESOLVED that to implement said construction of the Project it is appropriate and necessary for the Board to acquire certain non-exclusive perpetual drainage easements and temporary construction easements as described in Exhibit "A", attached hereto and incorporated herein, which are necessary for the construction of the four-lane improvements to Bonita Beach Road Phase II, between Forester Road and Vanderbilt r f Drive. AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to immediately acquire by gift, purchase or condemnation in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, certain non-exclusive perpetual drainage easements and temporary construction easements more particularly described in Exhibit "A", attached hereto and incorporated herein. 2 n n AND IT IS FURTHER RESOLVED that no mobile homes are located on the property sought to be acquired and therefore it will not be necessary to remove any mobile homes from the property to be acquired. OBJECTIVE: To obtain authorization from the Board of County Commissioners, Collier County, Florida, to acquire by gift or purchase all rights and interests in real property which are required for the construction and maintenance of transportation improvements for the four-laning of Bonita Beach Road (commencing at Forester Road and terminating at Vanderbilt Drive, a distance of approximately 1.7 miles). CONSIDERATION: On October 26, 1993, the Board of County Commissioners adopted Ordinance 93-78 and Resolution 93-493 therein establishing the 1993 (Fifth Annual) Capital Improvement Element of the Growth Management Plan. These documents authorize the implementation of four laning improvements to Bonita Beach Road. Moreover, an Inter-Local Agreement between Lee and Collier Counties outlines further authorizations with respect to cost sharing of design, right-of-way and construction. Accordingly, it is deemed necessary for the design to acquire additional road .i'".■ right-of-way, utility, drainage and maintenance easements, temporary construction easements or fee simple title for the completion of the improvements for the four-laning of Bonita Beach Road. The entire road alignment will be designed and constructed within the existing right-of-way with the exception and notation that construction easements, drainage easements, and right-of-way will be necessary in and around the bridge sections and at other isolated areas of the project such as intersections. The planned alignment maximizes the use of existing right-of-way and minimizes the need to acquire additional right-of-way. It is noted that Lee and Collier Counties shall individually but concurrently acquire rights-of-way along the north and south sides of Bonita Beach Road, respectively. Adoption of the attached Resolution will authorize the selection of (an) appraisal firm(s) from the list of appraisal firms pre-qualified and approved by the Board of County commissioners for work on right-of-way acquisitions projects; and will authorize the Finance Department to make immediate payments to property owners who have agreed to convey to the County. Adoption of the attached Resolution establishes that the Director of the Office of Capital Projects Management, or his designee, is delegated the authority to approve the purchase of land interests above the staff compensation estimate or appraised value (administrative settlements) and pay normally related costs when it is in the best interest of the project, only when the difference between the staff compensation estimate or appraised value is less than Six Thousand Five Hundred and 00/100 Dollars ($6,500.00). This settlement approval authority is delegated by the �-� Board of County Commissioners to the extent that such approvals do not conflict with the provisions of Section 125.355, Florida Statutes. AO.E No DEC 0 71993 Adoption of the attached Resolution will also confirm that, once acquired and recorded in the Public Records of Collier County, Florida, the right-of-way for this project shall be formally "accepted" by the Board of County Commissioners, Collier County, Florida, for the following purposes: 1) Four-laning construction, drainage and utilities installation and temporary access to adjacent areas necessary for the construction on Bonita Beach Road; 2) Turn lane improvements to Vanderbilt Drive; 3) Alternate alignments for the area surrounding Fish Trap Bay Bridge and the replacement of the bridge; 4) Any other improvement(s) not mentioned above which is(are) deemed necessary for the completion of the project; and 5) Maintenance of all improvements as required for public safety. FISCAL IMPACT: Preliminary appraisals indicate that the cost of the perpetual road right-of-way, utility, drainage and maintenance easements, temporary construction easements or fee simple title purchases, if limited to the intersection improvements, shall not be in excess of the budgeted/appropriated amount of $620,000.00 This budgeted amount includes all service fees (title searches, appraisals, attorneys), the value of the land and improvements and any severance damages to the remainder properties. All future purchases will be charged against account numbers: Capital Expense - 313-163650-761100-60021 $600,000.00 Operating Expense - 331-163650-631600-60021 $20,000.00 It should be noted that a future budget amendment will be processed recognizing carry forward necessary to fund this request. Hence, this Executive Summary does not include a current request for expenditures. GROWTH MANAGEMENT IMPACT: As a Capital Improvement Element project, the recommendation is consistent with the County's Growth Management Plan. The Board has considered the environmental factors, safety factors and cost factors relating to the location of the transportation im- /..provements and related facilities. 2. The road right-of-way, utility, drainage and maintenance ease- ments, temporary construction easements or fee simple acquisitions identified on Exhibit "A" are the most feasible locations in order to permit the construction and maintenance of the transportation improvements and related facilities. 3.
