EXECUTIVE SUMMARY
RECOMMENDATION TO ADOPT A RESOLUTION AUTHORIZING THE ACQUISITION
OF RIGHT-OF-WAY REQUIRED FOR THE CONSTRUCTION OF ROAD, UTILITY AND
DRAINAGE IMPROVEMENTS TO AIRPORT ROAD ( CR-31 ) , AT BOTH THE ESTEY
AVENUE INTERSECTION AND THE DAVIS BOULEVARD INTERSECTION (A PORTION
OF CIE NO. 003 ) , AND TO GRANT TO STAFF THE AUTHORITY TO STREAMLINE
AND COMPRESS STANDARD OPERATING PROCEDURES IN ORDER TO EXPEDITE
RIGHT-OF-WAY ACQUISITION AND CONSTRUCTION.
OBJECTIVE: To obtain authorization from the Board of County
Commissioners , Collier County , Florida, to acquire right-of-way
required for the construction of road , utility and drainage
improvements to Airport Road , at both the Estey Avenue
intersection and the Davis Boulevard intersection , and to obtain
Board authorization to expedite the appraisal and negotiation
phases of the project .
CONSIDERATION: Adoption of the attached resolution will authorize
the selection of ( an ) appraisal firm( s ) from the list of appraisal
firms pre-qualified and approved by the Board of County
Commissioners for work on right-of-way acquisition projects ; and
will authorize the Finance Department to make immediate payment to
property owners who have agreed to convey to the County, at or
below the estimate of compensation as specified in the appraiser' s
Certificate of Appraisal , the right-of-way required for
construction of the project . Traditional right-of-way acquisition
processes streamlined thereby involved :
o Returning to the Board , after the initial authorization to
acquire , for subsequent authorization to begin the
competitive selection process for appraisal firms , and then
returning to the full Board for subsequent approval of the
Appraisal Agreement ; and
o Returning to the Board , after negotiations , for the
subsequent approval and execution of a bilateral purchase
agreement for each and every purchase on the project
( regardless of the dollar amount of the purchase ) .
By law , staff must continue to seek Board approval for any purchase
in excess of the appraiser ' s estimate of compensation . The major
change proposed in the method of acquiring real estate is the
substitution of a Seller ' s Affidavit ( or unilateral agreement ) in
place of the bilateral agreement , in those instances where the
property owner is willing to convey the right-of-way at or below
the appraiser' s estimate of compensation. Staff hopes that the
promise of immediate payments by the County, upon the execution of
such Seller ' s Affidavits by property owners , will serve as a
significant inducement to prompt settlements.
Adoption of the attached Resolution will also confirm that , once
acquired and recorded in the Public Records of Collier County,
Florida, the right-of-way for this Project shall be formally
"accepted" by the Board of County Commissioners , Collier County,
Florida, for the following purposes:
o Six-lane construction, and drainage and utilities
installation on Airport Road ( from US-41 to Radio Road) ;
and
o Maintenance of all improvements as required for public
safety.
FISCAL IMPACT: Staff estimates that the total cost of the right-of-
way acquisition phase of the project, if limited to the subject
intersections , shall not be in excess of $425 , 000. 00 This
estimate includes all service fees (title search, appraisals,
attorneys ) , the value of the land and improvements and any
severance damages to the remainder properties , and also includes
contingencies for settlements above appraised value and for
condemnation awards.

GROWTH MANAGEMENT IMPACT: The construction of improvements to
Airport Road is part of the Transportation Services Five Year
Secondary Road Program covering FY 89/90 through FY 94/95 and is
listed as a Capital Improvement Element (CIE ) Number 003 within the
County' s Comprehensive Plan.
RECOMMENDATION: That the Board of County Commissioners adopt the
attached Resolution authorizing the acquisition of the right-of-way
which may be required for the construction of the road, utility and
drainage improvements to Airport Road.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION OF PROPERTIES BY
GIFT OR PURCHASE IN SUPPORT OF THE SIX\LANE IMPROVEMENTS TO
AIRPORT ROAD (CR-31) BETWEEN TAMIAMI TRAIL (US-41 ) AND RADIO ROAD
(CR-858) , (CAPITAL IMPROVEMENT ELEMENT PROJECT NO. 003) , AND
AUTHORIZING STAFF TO PROCEED WITH ACTIVITIES REQUIRED TO EXPEDITE
SAID PROPERTY ACQUISITION.
WHEREAS, on June 8, 1990, the Board of County Commissioners,
approved the Collier County Five and Ten Year Secondary Program
for FY 1989/90 - 1994/95 and FY 1995/96 - 1999/00, thereby
establishing priorities for budgeting, design, property
acquisition and construction of capital improvement projects; and
WHEREAS, the construction of the six-lane improvements to Airport
Road, between US-41 and Radio Road, is scheduled to begin
immediately upon completion of acquisition of all necessary
properties; and
WHEREAS, it is necessary and in the best interest of Collier
County, Florida, to maintain the flexibility to obtain control
over the property required for the construction of the
improvements (see Exhibit "A") either by perpetual, non-exclusive
easement or by fee simple purchase; and
■ WHEREAS, the expeditious acquisition of property is of paramount
importance to completing the Project on schedule, and attaining
infrastructure goals in accordance with the Capital Improvement
Element of the County's Growth Management Plan; and
WHEREAS, accomplishing the property acquisition and construction
on or ahead of schedule shall require a properly coordinated team
effort by the Transportation Division, the Real Property
Management Department and the Office of the County Attorney,
wherein certain routine processes shall require streamlining and
compression wherever possible.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The six-lane improvements to Airport Road, and the
acquisition of properties as identified in Exhibit "A", attached
hereto and incorporated herein, from US-41 to Radio Road is
necessary and in the best interests of the citizens of Collier
County, Florida.
•
2. Negotiation for the purchase of the required properties, up
to the appraised value, in either fee simple or by perpetual,
non-exclusive easement, is hereby authorized. The total property
acquisition cost shall not exceed $80,000.00
3. The Board of County Commissioners of Collier County, Florida,
recognizes the importance of completing the Airport Road project
at the earliest possible time; and further ; .cognizes the
relationship of the project schedule to meeting`' 'the concurrency
requirements of Collier County's Comprehensive Plan.

4. In accordance with the above-stated recognition by the Board
of County Commissioners, the Transportation Services
Administrator is hereby delegated the authority to negotiate with
appraisal firms from the existing Board-approved list of
appraisers, and the Chairman of the Board of County Commissioners
is hereby authorized to execute Appraisal Agreements (the
combined sum of which shall not exceed $10,000.00) , with the
appraisal firm(s) which, based upon the analysis and
recommendation of staff, is (are) best able to serve the needs of
the Project in a timely and cost-effective manner.
5. Upon the approval by the County Attorney's Office of all
documents necessary for the subject property acquisition, Real
Property Management Department staff is hereby encouraged to
offer immediate delivery to the respective property owners, of
the full compensation (as established by the appraisal) , in
return for the immediate and proper execution of the respective
easements and/or deeds, and such other legal documents and/or
affidavits as the County Attorney's Office deems appropriate in
order to protect the interests of the County; and the Board of
County Commissioners hereby authorizes its Chairman to execute
any and all documents pertinent to such property acquisition
which have been reviewed and approved by the County Attorney's
Office.
6. The Board of County Commissioners of Collier County, Florida,
hereby authorizes staff to negotiate with the respective property
owners for the purchase of the required properties, and in those
instances wherein the property owner agrees, by sworn affidavit
("Seller's Affidavit") , to convey the required properties to the
County in exchange for compensation in an amount not to exceed
the appraisal report, and upon the proper execution by the
property owner of those easements and/or deeds, and such other
legal documents as the Office of the County Attorney may have
required (see above) , the Board hereby authorizes the Finance
Department to issue checks, payable to the property owners of
record, in those amounts as shall be specified on a closing
statement which shall be based upon the amount of compensation
specified in the above-referenced appraisal report.
7. The Board of County Commissioners, in accordance with the
provisions of Chapter 125.355, Florida Statutes, hereby waives
the requirement for a formal, independent appraisal report for
the purchase of a property where the purchase price of the parcel
(the compensation due the property owner) is less than
$100,000.00. In place of the independent appraisal report, staff
is hereby authorized to make purchase offers for the properties,
the dollar amounts of which shall be predicated upon
consideration and application of appropriate market value and
cost data to the subject parcels, i.e. , based upon independent
appraisals (and the data therefrom) obtained on similar
properties.

8. All title to properties obtained in the manner described
above shall be deemed "accepted" by the •Board of County
Commissioners, as the governing body of Collier County, Florida,
a political subdivision of the State of Florida, and as such,
staff is hereby authorized to record in the Public Records of
Collier County, Florida, said easements and/or deeds, and such
other instruments as may be required to remove the lien of any
encumbrance from the acquired properties.
