6. If Broken Back Road /Collier Boulevard (CR -951) is not yet constructed to the project's
proposed eastern driveway at the time the developer applies for permits for the final construction
of the eastern "public -use" access /entrance, then the developer agrees to extend /construct
Broken Back Road /Collier Boulevard (CR -951) from the Quarry's north
entrance (alternatively, from its terminus that may be north of the Quarry's entrance as a result
of road construction by others for their site specific access needs) to the project's eastern
driveway connection. The interim use of the eastern access for "construction- only" traffic shall
not require the Developer to extend Broken Back Road /Collier Boulevard (CR -951) or improve the
road above its current condition, except to install stabilized road base and dust abatement
measures as needed for construction traffic.
The roadway design and construction shall be inclusive of drainage features necessary to accept
and convey the stormwater for the improved roadway area, within the limits described above.
The stormwater shall be conveyed to the Quarry for storage /treatment as previously planned.
The Developer is not required to provide for treatment or storage of stormwater other than
within the Broken Back Road /Collier Boulevard (CR- 951) right -of -way and the Quarry site. The
Developer is not required to secure any off -site areas for the roadway's stormwater. The roadway
shall be constructed in accordance with the design standards of a two -lane collector per
Collier County LDC and shall consist of the two northbound lanes of a future four lane road
design. The Developer will be required to construct only those site access improvements along
Broken Back Road /Collier Boulevard (CR -951) that are specific to the Project. Any improvements
to Broken Back Road /Collier Boulevard (CR -951) made in order to connect to the development's
eastern driveway shall be constructed at no cost to the County, except for those
improvements that the County may request of the Developer that exceed
the collector standards of the LDC. All construction costs associated
with improvements that exceed the collector standards shall be eligble for impact fee
credits. The County will accept the roadway for ownership and maintenance one (1) year after
acceptance of the construction of the roadway.
