No. 2006090292 Dear Ms. Flagg, This correspondence is offered to establish the completion of all required actions concerning the above as of September 30, 2008. Specifically, I have addressed each of the following: • Engaged Boylan and Associates to prepare and submit a mitigation and monitoring plan for the affected area. • Completed the required replanting for those areas in accordance with the approved plan. • Acknowledged the two year monitoring requirement. The above efforts have addressed all issues and have fully abated the original clearing and fencing. I am prepared to reimburse the county for its operational expenses associated with the case,but I am requesting relief from the Board for the fines imposed. Based on discussions with the former Director of Code Enforcement, I advised that the original stipulation agreement was not completed in a timely manner by my husband as a result of his arrest in January of this year. Since that time I have made consistent efforts to resolve all of the Board's concerns.As a result of my husband's arrest, I have returned to work in order to support my three sons and members of my family. Any relief from the accumulated fines would be greatly appreciated. I have worked diligently to resolve these matters in addition to other legal and financial challenges this past year and would appreciate your help. The mitigation plan shall be prepared by a person who meets or exceeds the credentials specified in Section 10.02.02.A.3;by establishing a monitoring program(10.02.06 E.3.e.i)that would determine the 80% survivability of species of the plants used in the mitigation effort over a two year period with replacement required to maintain the 80%minimum annually. A minimum of two reports will be submitted by Respondents. Reports will due at one year intervals. The mitigation plan must be submitted within 90 days(January 29,2009). 3. By installing all plant materials in accordance with the mitigation plan within 180 days of acceptance of the mitigation plan. 4. That if the Respondents do not comply with paragraph 1 of the Order of the Board by November 30, 2008,then there will be a fine of$100 per day for each day until the violation is abated. 5. That if the Respondents do not comply with paragraph 2 of the Order of the Board by January 29, 2009,there will be a fine of$100 per day for each day until the mitigation plan is submitted. 6. That if the Respondents do not comply with paragraph 3 of the Order of the Board within 180 days of acceptance of the mitigation plan,there will be a fine of$100 per day for each day until the plant material is installed. 7. That if the Respondent does not comply with paragraph 2 of the Order of the Board within 180 days of acceptance of the mitigation plan,there will be a fine of$100 per day for each day until the plant material is installed. 5. That the Respondent is to notify Code Enforcement officials that the violation has been abated within 24 hours of abatement and request the Investigator to come out and perform the site inspection. 6.
