Second by Mr. Foley. Carried unanimously 10 - 0. III. Approval of Minutes from August 8, 2012 Meeting Mr. Disney moved to approve the minutes of the August 8, 2012 meeting as presented. Second by Mr. Dunnavant. Carried unanimously 10- 0. IV. Public Speakers None V. Staff Announcements/Updates A. Public Utilities Division Update— [Nathan Beals] Tom Chmelik reported there were no updates however, a representative will continue to appear before the Committee and provide updates on Department business which may be of interest to the Committee. B. Fire Review Update— [Ed Riley] Bob Salvaggio, Fire Code Official submitted the documents "Office of the Fire Code Official—Summary of Plan Review Activity—July - 12" and "Fire Plan Review— Time Frame Summary-July— 12" for information purposes. Mr. Valle arrived at 3:10pm C. Growth Management Division/Transportation Engineering— [Jay Ahmad] Jay Ahmad reported: • Oil Well Road Improvement Project—The project is near completion with the eastern and western portion of the improved roadway open for traffic. "Punch list items" are being addressed. • Davis Boulevard/Collier Boulevard Improvement Project— 52% complete and is ahead of schedule with completion slated for March 2014. • Golden Gate Blvd bridges—Over Golden Gate Main Canal—under construction; a temporary crossing is planned for 23`d Ave. • Master Mobility Plan— Staff/Consultants continue to develop the Plan. Ms. DeJohn arrived at 3:20pm D. Growth Management Division/Planning & Regulation Update— [Jamie French] Jamie French submitted the report "Monthly Statistics" which outlined building plan review activities. The Committee requested: • On page 5, expand the columns to a 24 month reporting period. • If possible, incorporate Fire Code Reviews into the Report. 2 September 5, 2012 Mr. French reported: • Staff continues to monitor employee expenditures within the Division. This includes identifying the tasks and duties completed by an employee so the proper fund source is accountable for any expenditures required. • Representatives of DSAC met with County Staff on September 4, 2012 to discuss the "CityView"portal. • The Fire Review Subcommittee continues to meet. VI. New Business None VII. Old Business A. Transportation Corridor Preservation Ordinance (changes to discuss) [Reed Jarvi] Mr. Jarvi submitted the "Collier County Transportation Corridor Preservation Plan Ordinance" for information purposes. He reported the Plan is not ready for formal review. Under Committee member discussions the following was noted: • Concern was expressed on the overall concept of the Ordinance as it constitutes an unfair taking of land given the way the Ordinance is structured. • Land uses may be prematurely restricted for lands within the areas under the auspices of the Ordinance. • The Ordinance creates an immediate decrease in property value and an encumbrance on an affected party's lands, when ultimately, no use of the property may be required. Nick Casalanguida reported: • Federal and State mandates require the County to develop the Long Range Transportation Plan. • The Ordinance has been revised intending to be a"notification process" with no requirements of the landowner to restrict their uses. • The "notification" is an attempt by the County to ensure landowners/future landowners are aware of any conceived public improvements affecting their property. • The "notification" would allow the landowner to make informed decisions on the use of their property, including transferring ownership of the affected lands for a fee to the County. • Currently, landowners are typically notified during the design phase of a project. Committee members noted: • The Long Range Transportation Plan is existing, and it is the responsibility of any party to undertake "due diligence" when making property/land use decisions, absent of an Ordinance. • It is more beneficial for "upfront" notification to an affected party, rather than delaying it whereby long term land use decisions are severely impacted by a public improvement. • Consideration be given to providing the "notification" to areas identified as Protected Corridors, not Planned Corridors. September 5, 2012 Discussion ensued with examples cited of the Ordinance's potential impact on property values and land use decisions. In conclusion, Mr. Casalanguida requested Committee members develop recommendations on an equitable means for the County to "notify buyers and sellers" (of lands) on the County's intentions for planned public transportation improvements. B. FEMA Discussion Jack McKenna submitted a document "FEMA Floodplain Storage." Mr. Chrzanowski reported the document outlines Staff's concern on the newly adopted FEMA maps and the related regulations negative affects on the potential development of properties in the County. Nick Casalanguida reported FEMA has informed Staff that County Ordinances must be structured in a manner which essentially prohibits development of approximately 10— 15K previously platted home site properties in the County. FEMA has notified the County of their position and required the County to amend applicable Ordinances or face revocation of the FEMA program within the County. He noted the Subcommittee is necessary to assist Staff in addressing the issue with the Board of County Commissioners, legislative delegations, Federal Agencies, etc. Their tasks and duties would include, (with the support of Staff), identifying the potential impacts of the policies through collection and analysis of technical data and developing findings and recommendations for consideration. It was noted the ultimate solution may require not only technical and scientific analysis, but political action. VIII. Committee Member Comments Judy Puig reported the County continues to pursue filling the vacancy on the Committee. IX. Call to Order- Select a Chairman Mr. French called the meeting to order at 2:00pm. It is anticipated there will only be one meeting, so electing a Chairman would not be necessary. II. Approval of Agenda The Agenda was approved by consensus. III. Public Speakers None IV. New Business A. Introduction and Discussion Mr. French reported the purpose of the meeting was to discuss the County's new "CityView" software system in the area of plan review to determine any changes in format the County may want to consider. The format of the meeting was a roundtable discussion. The following issues were identified by DSAC members: 1. The inability to copy and paste sections of the status letter issued by Staff It would be advantageous to have the ability to transfer comments to MSword or other documents so the consultant does not have to retype the comments into correspondence. Place boiler plate language at end of letter as opposed to the beginning. Staff will review, it may require reformatting of template changes by Staff or vendor as the letter may be formatted as a "locked"PDF version. 2. The tracking of comments is confusing to the consultants. When a correction or comment has been addressed by the consultant, the system appears to delete the comment and renumber remaining comments to be addressed. Staff will review the feasibility of leaving all comments in letter, indicate "resolved, or unresolved,"and maintaining a consistent numbering format as the review process proceeds. 3. The daily inspection schedule is not segregated by trade or project and does not list the employee responsible for completing the inspection. This format was available in the previously utilized software, "CD-Plus. " Staff will review. 4. The online portal does not identify the reviewer who made comment, so the consultant does not know who to contact'for questions, etc. 2 September 4, 2012 Staff will review. 5. Difficulty tracking the chronology of comments online utilizing the existing format. Staff provided a real time review of a permit application on the portal noting the comments are carried forward(upward on screen) with the most recent comment on top,previous comment, request for same correction listed below. Status letter is available at bottom for review or print. 6. In general, the previous system, "CD-Plus" was a more user friendly system. Staff noted the new format may require a `familiarization period"and/or education component for vendors using the system. 7. The system does not have the capability disseminating inspection results electronically. Staff to review, the current system in place only allows reporting via telephone through the IVR (Selection) system. 8. Consideration should be given to listing all discipline's comments together, (on a chronological basis) in comment letter including identification of the reviewer. Staff to review. Mr. French reported Staff will review the items raised and contact the vendor who provides the CityView software to the County. He noted there may be limitations within the system in providing all functions requested by the parties. It may be advantageous to create a"needs vs. wishes list"to assist in prioritizing proposed changes to the system. Staff will provide update at the October Development Services Advisory Committee meeting. V. New Business None VI. I thank you for our consideration. 2 I Co er County GROWTH MANAGEMENT DIVISION MEMORANDUM DATE: September 20, 2012 TO: Local Coordinating Agency FROM: Nick Casalanguida, Growth Management Division Administrator SUBJECT: FDOT Asset Management Contract and Transfer of State Road Maintenance Responsibilities As of 12:00 AM October 1, 2012, the maintenance responsibility for state roadways in Collier County currently maintained by the Growth Management Division Road and Bridge Maintenance Department, will be transferred to Transfield Services, the new FDOT Asset Maintenance Contractor in Collier County. We were one of the last counties that provided local asset management on state facilities. .A transition meeting between FDOT, Transfield Services and Collier County staff was held on September 19, 2012. The purpose of the meeting was to provide FDOT and Transfield Services with background information, the current status of county maintained state roadways, and to transfer necessary documents to allow for a smooth transition of the maintenance operations. Collier County still maintains, by contract, all signals on state roadways with the exception of those located in the City of Naples. Additionally, effective immediately, FDOT will now be processing all Right-of-Way permits for state facilities in Fort Myers at their regional office. We have been coordinating the transition over the past few weeks and they have notified us that they are now operational to process permits. I expect as we move forward there will be a transition period where community leaders, our citizens and other governmental agencies will continue to reach out to Collier County for issues on these facilities. Rest assured we will still act as a liaison to FDOT and Transfield Services for routine calls and emergencies in order to make sure our constituents are well served. The following roads are included in the Transfield Services contract: Section 03010; State Road 45, (U.S. 41) From Lee County Line to 5th Ave. S. Approximately 12 miles Section 03010; State Road 90, (U.S. 41) From 5th Ave. S. to State Road 29 Approximately 32 miles Section 03040; State Road 90, (U.S. 41) From State Road 29 to Dade County Line Approximately 32 miles Section 03001; State Road 84, (Davis Blvd.) From U.S. 41 to County Road 951 Approximately 6.5 miles Section 03030; State Road 951, (Collier Blvd) From U.S. 41 to S.S. Jolley Bridge Approximately 7 miles Section 03080; State Road 29 From U.S. 41 to Hendry County Line Approximately 45 miles Section 03050; State Road 82 From State Road 29 to Hendry County Line Approximately 7 miles These facilities are also shown on the attached map. I-75 (SR 93) has been maintained separately by a private contractor to the Florida Department of Transportation and is not included in this transfer.
