and for the County of Collier, and also acting as the Board of Zoning
Appeals and as the governing board(s) of such special districts as

Legal notice having been published in the Naples Daily News on
December 29, 1993 and January 13, 1994, as evidenced by Affidavit of
Publication filed with the Clerk, public hearing was opened.
;. John Boldt, Stormwater Management Director, announced that this ts
the second public hearing to consider extending the current Ordinance,
lime'banning the enclosure of swales in Naples Park, to December 31, 1994.
The following people spoke on the Issue:

.Mr. Boldt clarified that the Issue is the extension of a mora-
,[,~orlu~ on enclosing the existing swales In Naples Park with culverts
· which is one of the conditions placed by one of the Agencies on the
permits He said that the original proposal was to enclose the 91st
.
iii(il and 92nd Avenue and the 8th Street ditches. He announced that the
;'[iconstructton plans were developed, but the permitting agencies would
~only permit the closing of the ditches with the ban on the enclosure
~of the small swales.
/,'~'~ County Manager Dotrill stated that consensus has not been reached
,: ,on creating an assessment district, taxing district or stormwater utl-
lity district to pay for the costa associated with large culverts that
;,i:need to be Installed in the canals.
In response to Commissioner Matthews, Mr. Boldt clarified that the
proposal to enclose the large ditches and canals includes the
"~'91et and 92nd Avenue on the West side and crosses 6th, ?th and up to
Avenues. He confirmed that there are approximately 40 miles of
i"swalem in Naples Park which are not to be enclosed.
Mr. Boldt confirmed that the whole Idea of extending the sofa-

~year to develop a petition that would establish a special assessment
~or taxing district to pay for the $3.3 million project to enclose the
,'large ditches along 8th Street and between 91st and 92nd Avenues.
Comm~ssioner Volpe mentioned that the Board at one point had
~:[ thought that a Stormwater Utility District could possibly generate
~. funds that may help underwrite the cost of enclosure of the ditches.
:[i . He stated that as a matter of policy as It relates to the establish-
;~. Lent of MSTU~s, the Board has Indicated that an MSTU can be created
~.f based upon a petition initiative where 50~ plus one of the affected
~i~' property owners agree to tax themselves In order to accomplish this.
He acknowledged that a great portion of the property owners would
(~.11ke additional time to find out how much this will cost and whether
:i:]:or not they wish to tax themselves. He pointed out that In order to
~,;'keep that opportunity open and keep the permits in place, an action
iii[ plan must be established to obtain that Information.
i!~:' Chairman Constantine closed the public hearing.

In response to Commissioner Volpe, Assistant County Manager
Hargett announced that Mr. Boldt will be the person responsible for
· providing the residents with the Information they need.
Upon call for the question, the Lotion carried 5/0, that Ordinance
94-2 be adopted ~nd entered into Ordinance Book 65.
