ACCESS EASEMENT
THIS EASEMENT, made and entered into this day of
�-+ 2012, by NAPLES HMA, LLC, a Florida limited liability company,
successor in interest to Naples HMA, Inc., a Florida corporation, whose mailing address
is 5811 Pelican Bay Boulevard, Suite 500, Naples, Florida 34108 (hereinafter referred
to as "Grantor "), to the BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS
EX- OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY
WATER -SEWER DISTRICT, its successors and assigns, whose mailing address is
3335 Tamiami Trail East, Suite 101, Naples, Florida 34112 -5356, (hereinafter referred
to as "Grantee ").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument
and their respective heirs, legal representatives, successors or assigns.)
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a perpetual, non - exclusive easement for all purposes of
access over, upon, and across the following described lands located in Collier County,
Florida, to wit:
That Easement Area shown on Exhibit "A" attached hereto and
incorporated herein by reference, together with access over and upon the
established drives and parking areas of Grantor's Pine Ridge Road medical
center facility to access the Easement Area from the public right of way of Napa
Boulevard.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to
enter upon said land for all purposes necessary to gain access to Grantee's reclaimed
water utility facilities lying westerly and northerly of Grantor's property at this location.
The easement granted herein shall constitute easements running with the land and
shall burden the lands described above.
Such access by Grantee shall not unreasonably interfere with Grantor's
operations. Any damage caused to the Grantor's property as a result of the Grantee's
use of the property for access purposes shall be promptly repaired by Grantee at its
sole cost and expense.
Grantee has confirmed the ownership of the lands underlying the easement
granted herein, and Grantor and all its related entities make absolutely no
representations or certifications with regard to same.
