UTILITY EASEMENT
THIS EASEMENT, made and entered into this 1 ` A day of j1t4P2 , 2012,
by LEAWOOD LAKES HOMEOWNERS ASSOCIATION, INC., a Florida not - for - profit
corporation, (hereinafter referred to as "Grantor "), whose post office address is 3701
Tamiami Trail North, Third Floor, Naples, Florida 34103, to the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER
COUNTY AND AS THE EX- OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY
WATER -SEWER DISTRICT (hereinafter referred to as the "Grantee "), c/o 3335 East
Tamiami Trail, Suite 101, Naples, Florida 34112, its successors and assigns. (Wherever
used herein the terms "Grantors" and "Grantee" include all the parties to this instrument
and their respective heirs, legal representatives, successors or assigns.)
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a perpetual, non - exclusive easement for underground utility
purposes, and access, which would be subject to the requirements of Florida Statutes
704.06, on the following described lands located in Collier County, Florida, to wit:
See attached Exhibit "A" which is incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to
enter upon said land, place or remove materials for the purpose of constructing,
operating and maintaining utility lines, pipes, and other associated equipment or
improvements appurtenant thereto or thereunder, all of which shall be installed below
the surface of the easement area described in Exhibit "A ". Access and maintenance
rights for the underground utilities are granted throughout the entire easement area,
with installation of utility lines, pipes, and other associated utility equipment or
improvements limited to underground infrastructure only subject to F.S. 704.06. Grantor
and Grantee are used for singular or plural, as the context requires. The easement
granted herein shall constitute easements running with the land and shall burden the
lands described above.
