Roll Call Chairman Poteet called the meeting to order at 9:00 AM. Roll call was taken and a quorum was established. II. Approval of Agenda Ms. Karim moved to approve the Agenda. Second by Mr. Curl. Carried unanimously 6 -0. III. Approval of October 12, 2009 Minutes Mr. Curl moved to approve the minutes subject to the following changes: • Page 2, item IV. Unit 53 Update line 1 — from "40 letters sent out..." To "44 letters sent out..." • Page 2, item IV. Unit 53 update — from "and $6, 000 1acre for parcels greater than 2.0 acres. " to "and $6, 000 1acre for parcels greater than 2.5 acres. " Second by Mr. Sterk. Carried unanimously 6 -0. IV. Old Business A. Real Property Management Update — A -list properties Cycle 6 properties — appraisals expected shortly; 44 offer letters sent out for Red Maple Swamp Preserve, 1 offer accepted but scheduled for tax deed sale in January. Winchester Head — to date, 69 offer letters sent out, 3 "no" replies and 2 "yes" replies with agreements for approval to be presented at the next meeting. 1. Fisiorek. Cindy Erb, Real Property Management presented the Executive Summary "Approve an Agreement for Sale and Purchase for 1.14 acres within the Winchester Head Multi parcel Project under the Conservation Collier Land Acquisition Program, at a cost not to exceed $19,3000 (Fisiorek) "dated December 14, 2009 and attached agreement for sale and purchase. Mr. Sterk moved to approve the agreement for sale and purchase. Second by Mr. Curl. Motion carried S "yes" —1 "no. " Mr. Dorta voted "no. " Mr. Dorta stated he voted "no " as the Committee's budget has not been solidified and expressed concern the Program may over extend itself. Chairman Poteet noted the funds for the purchase have been allocated from a previous Cycle. Alex Sulecki noted the Board of County Commissioners must still review and approve all Contracts after the owner signs it. Ms. Karim noted the Executive Summary contains discrepancies on the total acreage of the 115 parcels as indicated on page 1 and 3 (167.74 acres and 158.67 acres respectively). 2 December 14, 2009 Staff will review and correct. It was noted the Program cannot bid on "tax sale deeds" as the purchase price of a parcel needs approval of the Board of County Commissioners and another bidder could easily outbid the Program at the auction. Mr. Delate arrived at 9:04 am. B. Pepper Ranch Event recap Alex Sulecki presented a Slideshow on "A Day at the Ranch" highlighting the public event held at Pepper Ranch on November 20 and 21, 2009. November 20, was an event for the Collier County Home Schoolers, while approximately 312 public individuals visited the site on November 21, 2009 for tours, lunch and public speakers. Ms. Karim represented the Committee. C. Budget Recommendations — (Q) -Can management funds be transferred back to acquisition? Alex Sulecki presented a memo to the Conservation Collier Land Acquisition Committee, dated December 14, 2009 noting Section 6. Ld of the Conservation Collier Ordinance, 2007 -65, states funds from the Conservation Collier Management Trust Fund may supplement the Collier County Land Acquisition Fund subject to the approval of the Board of County Commissioners. D. Gordon River Greenway update - Jeff Curl It was noted the zoning application is still in process, signage is still being reviewed, and there is no update on the bridge alignment for the City of Naples. V. New Business A. Mcllvane Marsh IMP Alex Sulecki presented the "Conservation Collier Mcllvane Marsh Property Interim Management Plan — Final Draft' dated December 2009 for approval by the Committee. She noted the Plan is for management of the Preserve for the next 2 years until a Final Management Plan is developed. Mr. Delate stated the Lands Evaluation and Management Subcommittee reviewed the document and provided comments which were incorporated by Staff. Ms. Karim noted: • The exhibits as listed in the text should correspond to their presentation in the document. • Page 8, first paragraph, line 4 - revise Lygodium Mycrophyllum to Lygodium Microphyllum Staff will make the revisions. December 14, 2009 Mr. Delate moved to approve the Conservation Collier Mcllvane Marsh Property Interim Management Plan — Final Draft" dated December 2009. Second by Mr. Curl. Carried unanimously 7 -0. B. Coordinator Communications Alex Sulecki noted: • Members Mimi Wolok, Michael Delate and Robert Dorta's terms are due to expire and Mr. Dorta and Mr. Delate indicated interest in continuing to serve. The remaining vacant position will be advertised to the public. • Ms. Wolok received her 5 year Advisory Board Service Award on December 1, 2009. She will check to see if any other Committee members are eligible for the award. • The January meetings will include review of 3 applications from the previous Cycle and 4 new applications. • Staff will provide a budget update in January. VII. Sub - Committee Meeting Reports A. Outreach — Tony Pires, Chair Jeff Curl noted the Outreach Committee met at the Freedom Park Interpretative Center and discussed signage, fund raising and the event at Pepper Ranch. They will meet immediately following this meeting. B. Lands Evaluation and Management — Mike Delate, Chair The Subcommittee met at North Collier Regional Park and discussed hunting at Pepper Ranch, public access to Preserves and "geo- caching." C. Ordinance Policy and Procedures — Mimi Wolok, Chair None VIII. Chair Committee Member Comments Ms. Karim commended Staff on the preparation and success on the "A Day at the Ranch" event. IX. Public General Comments None X. Staff Comments The next meeting will be held on January 11, 2010 with Staff reviewing the status of the Committee's parking permits. Approve an Agreement for Sale and Purchase for 1.14 acres within the Winchester Head Multi- parcel Project under the Conservation Collier Land Acquisition Program, at a cost not to exceed $14,575 (Stark). OBJECTIVE: Request approval of the attached Agreement for Sale and Purchase (Agreement) between the Board of County Commissioners (Board) and John G. Stark (Seller). CONSIDERATIONS: On January 25, 2005, Agenda Item 10D, the Board approved a Conservation Collier Land Acquisition Advisory Committee ( CCLAAC) recommended Cycle II - Active Acquisition List, (AAL) with changes, and directed staff to actively pursue acquisition of the properties under the Conservation Collier Program. A multi - parcel project included. on the Cycle II — AAL was a portion of Unit 65 in Golden Gate Estates (Winchester Head Multi- parcel Project). Staff has actively pursued acquiring parcels within Unit 65. However, on September 13, 2005, Agenda Item 16 A 34, the Board accepted CCLAAC's recommendation to, due to rising property costs, discontinue buying properties for the Winchester Head Multi- parcel Project for 90 days. On February 14, 2006, Agenda Item 10A, the Board approved placing the Winchester Head Multi- parcel Project on the "B" list of the Cycle III — AAL, and on January 23, 2007, Agenda Item 10A, the Board approved the Cycle IV — AAL, once again placing 4fb Multi - parcel Project on -the "`B" list. On May 22, 2007, Agenda Item 10F, the Board approved activating the Winchester Head Multi- parcel Project, with conditions, and it was placed on the "A" list on the current AAL. The Winchester `Head Multi- parcel Project consists of 115 parcels and a total of 158.67 acres. To date, Conservation Collier has acquired a total of 60.77 acres consisting of 43 parcels, and the Collier Soil and - Water Conservation District has acquired 2 parcels totaling 2.28 acviat,. Staff contracted with two independent, state - certified, general real estate appraisers(to.'appraise all parcels within the Winchester Head Multi- parcel Project. The appraisals dated October 2009, provided an averaged appraised value for all parcels within the Winchester Head Multi- parcel Project at $10,000 an acre. Staff sent out 69 offer letters based on the averaged appraised values, and to date, 2 have accepted our offers, and 3 said they are not interested. The Seller's property contains a total of 1.14 acres and is located within the Winchester Head Multi- parcel Project. The land cost for the 1.14 acre parcel is $11,400. The attached Agreement provides that should the County elect not to close this transaction for any reason, except for default by the Seller; the County will pay the Seller $57.00 in liquidated damages. As of January 11, 2010, property costs for Conservation Collier properties, including this property and those under contract, total $103,533,853.02. Estimated costs of maintenance in perpetuity have been considered by the CCLAAC and have been incorporated into the Conservation Collier Long Term Financial Management Plan. The entire site is within North Golden Gate Estates, a target protection area. Three different roads, one of which is paved, can access the site and from these roads half of the property can be viewed. The mature cypress and seasonally changing marsh enhance the aesthetic setting o f C ollier County. U sing aerial photographs, elevation data, soil maps and public input, a total of 115 parcels (158.67 acres) were identified as being important for acquisition. With the acquisition of the Ocean Investment Management parcel, Conservation Collier will own 61.91 a cres or 3 9% of t he identified project ar ea. One i mportant r eason f or t he nomination of Winchester Head is that this area functions to provide floodplain storage for surrounding home sites during high rainy season. In fact, these types of depressional storage areas were included in the water management models for the Golden Gate canal system done by the Big Cypress Basin, South Florida Water Management District and are a component of flood control for the area. O ther criteria that would be satisfied by a purchase h ere i nclude protection of surface and ground water resources, protection of wetland de pendent s pecies ha bitat, good pot ential f or r estoration a nd 1 ow a stimated management costs. Listed plant species were observed, while a 1 isted wildlife species (Florida bl ack be ar) ha s be en doc umented a t the a dges of t he pr operty. D uring a November 2009 site visit, it was noted that there was standing water within Winchester Head, that many birds are using the area, and that the wetland areas (except those directly adjoining roadways) appear to be nearly free of invasive exotic plant life, indicating good ecological value. Projected Management Activities: Active management of this project is not feasible until a significant contiguous area can be acquired. Since Winchester Head is relatively free of exotic plants, minimal control efforts consisting of herbicide applications on a xotics at the edges of owned properties may be done until a larger area is acquired. Nature photography and bird watching are two activities that can occur at present. After consideration of risks and liability, it may be possible t o a llow s chool c hildren t o vi sit s pecific pa rcels a s pa rt of an e ducational program about wetlands. C urrently, the two roads ( 37th and 39 th Streets N E) pr ovide access but t he onl y pa rking i s t he r oad r ight -of -way. U ntil t here a re a nough pa rcels acquired to provide a resource destination, a visitor parking area is not necessary. A parking area could be constructed in the future, however, only wetland parcels have been identified for acquisition and these are likely not appropriate as parking area sites. Land Development Code changes have been made to allow construction of a parking area on parcels in Estates zoning. In the future, an educational kiosk could be placed along one of the roads through the project. It would contain information on w etlands and on t he preservation of the area. S igns can be placed at boundaries along 37th and 39th St. NE.
