NINO: No, nothing to report. But let me remind you that for a while we had dropped out of this program. We've renewed it again. And it's the Planning Commissioners' finding, loaded with finding information. And henceforth you'll all get a copy of it. So please don't leave it on the desk. Take it home. COMMISSIONER PRIDDY: Is there any reason they put half the pages in upside down? COMMISSIONER RAUTIO: That was to see -- COMMISSIONER PRIDDY: To see if we were paying attention? COMMISSIONER RAUTIO: Right. That was just to see if you could read it. CHAIRMAN BUDD: We do not have a chairman's report. We'll move into our advertised public hearings, starting with BD-2000-07. (All speakers were duly sworn.) MS. SOTER: Good morning, commissioners. For the record, my name is Cheryl Soter, of current planning. This is boat dock Petition 2000-07. Petitioner is requesting an after-the-fact four-foot extension to allow a boat dock facility to protrude a total of 24 feet into the waterway. The property is located at 139 Trinidad Street, in Isle of Capri. It contains 60 feet of water frontage. The width of the waterway at this site is 100 feet. The proposed facility consists of a dock facility with a lift. This project meets all the criteria, and we have not received any objections. Staff recommends approval of this extension. CHAIRMAN BUDD: Any questions for staff? COMMISSIONER BRUET: How did the after-the-fact issue come about? MS. SOTER: They originally obtained a correct permit for the 20-foot extension. And then apparently when they were building the dock, the waterway was shallow, and they extended out the extra four feet. If you have any further questions, the petitioner can explain anything further. COMMISSIONER PRIDDY: How did that get caught? MS. SOTER: Through the spot survey requirements, the building permits. COMMISSIONER BRUET: And he pays an after-the-fact fee? MS. SOTER: He paid an after-the-fact fee for the extension, that's correct. CHAIRMAN BUDD: Any comments by the petitioner? MR. NEAL: Jerry Neal, representing the petitioner. The application should include a copy of the survey that reflects where the dock is. One of the things on the survey is that it shows the rip-rap above the water line, and actually around where the property line is, is also where the high tide is. And you know high tide is higher than the mean high water. So the actual location of the parallel dock is right at the base of where the rip-rap is. And they were assuming that since it's shallow, that they Page 3 May 18, 2000 were in fact still within the 20 feet. But after the survey, they found that they were not. This is a case where you don't have a seawall, you don't have a fixed object. And when we were out there with the crew, because the water was pushed on out due to the rip-rap, they were misled as to where they actually were. COMMISSIONER RAUTIO: May I ask who they are? MR. The petitioner is requesting a 16.5 foot extension to create a docking facility protruding a total of 36.5 feet into the waterway. The property is located at 76 Southport Cove, in Lely Barefoot Beach, and contains about 80 feet of water frontage. The project consists of the removal of an existing nonconforming dock and its replacement by a T-shape dock and boat lift. Page 4 May 18, 2000 Numerous similar extensions ranging from 30 to 46 feet have been approved for docks on this waterway. No objections to this project have been received, and staff recommends approval. CHAIRMAN BUDD: Any questions? COMMISSIONER BRUET: No comments from adjacent property owners? MR. The property is located at 163 Windward Cay, in Port-of-the-Islands and contains about 53 feet of water frontage. The project consists of a dock and boat lift constructed perpendicular to the shoreline. A similar extension to 38 feet was approved on nearby Lot 50. No objections to this project have been received, and staff recommends approval. CHAIRMAN BUDD: Any questions? Comments by the petitioner? Comments by the public? We will close the public hearing. The petitioner is requesting an 18-foot extension to create a docking facility protruding a total of 38 feet into the waterway. The property is located at 43 Southport Cove, in Lely Barefoot Beach, and contains about 150 feet of water frontage. The project consists of the construction of an L-shaped dock and boat lift. Three similar extensions ranging from 32 to 47 feet have been approved on this waterway in the immediate area, including one to 47 feet on adjacent Lot 49. No objections to the project have been received, and staff recommends approval. CHAIRMAN BUDD: Questions? Comments by the petitioner? Comments by the public? We will close the public hearing. We'll move on to the community redevelopment plan. Ms. Preston. Page 6 May 18, 2000 MS. PRESTON: Good morning. For the record, Deborah Preston, with your comprehensive planning department. The item before you today is to review the community redevelopment plan for consistency with the Growth Development Plan. The redevelopment plan was prepared for the two redevelopment areas that were established by the Board of County Commissioners on March the 14th, 2000. The Board of County Commissioners also named themselves to sit as the community redevelopment agency. The Florida Statute requires that the local planning agency review the plan for consistency and then to forward their recommendations to the community redevelopment agency for adoption. The Growth Management Plan that you should be using to review these plans is the 1997 Growth Management Plan that was adopted by the board, again on May 9th, 2000, and should be in effect on May the 19th. And also, the Immokalee Area Master Plan that was adopted by the board in t997. Staff finds that the plan is generally inconsistent with the Growth Management Plan. Both of these areas are located in an urban designated area, where higher densities and services are provided. I can give you a brief overview of each of the sections, if you'd like, or answer any questions at this time. CHAIRMAN BUDD: Do we have any questions on any of the sections? COMMISSIONER ABERNATHY: I have a question. I don't find any inconsistency with the Growth Management Plan, but I'm just curious, you have two areas that are 35 miles apart. They can be in the same community redevelopment act or whatever? MS. PRESTON: Yes. Actually, the act allows one county to have one redevelopment agency, but can have several sub areas. What we're proposing is that the tax increment financing that would be allocated through this program will be kept in separate sub-accounts. COMMISSIONER ABERNATHY: That was my next -- the TIF is a discrete account. MS. PRESTON: Right. Page 7 May 18, 2000 COMMISSIONER ABERNATHY: Those were the only questions I had. CHAIRMAN BUDD: Any other comments or questions? Anyone from the public to present testimony? I don't know if it's a public hearing, but if it is, we'll close it. Do we have a motion to find this consistent and forward it to the Collier County Community Redevelopment Agency with a recommendation of approval? COMMISSIONER ABERNATHY: So moved. COMMISSIONER RAUTIO: I just wanted to follow up on the efforts to correct mailing addresses. I know we had a slight glitch in the last report that was handed out, and there was a major glitch in the actual mailing to me for my packet. Mr. Nino, have we fixed the process in Development Services to make sure we have the right company name and address for Planning Commission mailings? MR. NINO: You all received revised lists. Is that list not correct? COMMISSIONER RAUTIO: The list was slightly in error for two places for Mr. Pedone. MR. NINO: We had to fill in some spaces. CHAIRMAN BUDD: I know the one you sent out to us a week or two ago, I made some corrections and gave it back, and I think there were a couple others. If we could get an edited version, because I know there were several corrections, just to make sure we're up to snuff, that would be helpful. COMMISSIONER RAUTIO: And then could we maybe find out what the process is internally so that all computers in Development Services actually print out the most current label? WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance 91-102) which establishes regulations for the zoning of particular geographic divisions of the County, among which is the granting of variances; and WHEREAS, the Collier County Planning Commission, being the duly elected and constituted Planning Commission for the area hereby affected, has held a public hearing after notice as in said regulations made and provided, and has considered the advisability of a 4-foot extension of a boat dock from the permitted 20 feet to allow for a 24-foot boat dock facility in an RSF-4 zone for the property hereinafter described, and has found as a matter of fact that satisfactory provision and arrangement have been made concerning all applicable matters required by said regulations and in accordance with Section 2.6.21. of the Collier County Land Development Code; and WHEREAS, all interested parties have been given the opportunity to be heard by this Commission in public meeting assembled, and the Commission having considered all matters presented; NOW THEREFORE, BE IT RESOLVED BY the Collier County Planning Commission of Collier County, Florida, that: The petition BD-2000-07 filed by Duane Thomas of Marco Dock & Lift, Inc., representing William Elliott, with respect to the property hereinafter described as: Lot 376, Isles of Capri #2, as described in Plat Book 3, Page 46, of the Public Records of Collier County, Florida. be and the same is hereby approved for a 4-foot extension of a boat dock from the permitted 20 feet to allow for a 24-foot boat docking facility in the RSF-4 zoning district wherein said property is located, subject to the following conditions: All docks, or mooring pilings, whichever protrudes the greater into the water, regardless of length shall have reflectors and house numbers four (4) inches minimum size installed at the outermost end on both sides. In order to address the protection of manatees, at least one (1) "Manatee Area" sign shall be posted during construction. o Permits or letters of exemption from the U.S. Army Corps of Engineers and the Florida Department of Environmental Protection shall be presented prior to issuance of a building permit. All exotic vegetation as defined in Section 3.9.6.4.1 of the Land Development Code shall be removed from the site and the property shall be maintained exotic-free in perpetuity.
