Oomtsetoner Ooodntght suggested both Petitions A-g2-1 and
cU-gl-1 be continued due to correspondence received from the South
Florida Water Management District (SFWMD) Indicating their Intent to
review permit issuance on this matter.

Attorney Dudley Goodlette, representing Southfield Farms, asked
the Board to proceed with the petitions, because the tssue8 relating
to the SFWMD are not relevant to the zoning teeues before the Board of
County Commissioners. He also reported changes tn the Unified Land
Development Code (ULDC) proposed for adoption by the Board on
July 22nd have a very direct impact on Petition CU-91-1. He urged
the Board, should these items be continued, to exempt this project
from any changes in the ULDC subsequent to this date.
Attorney George Varnadoe, representing the applicants for Petition
A-92-1, requested the Board to continue both items due to the letters
received from the SFWMD.
Attorney Steve Walker, representing Southfteld Farms, advised the
Board that he is a former General Counsel for the SFWMD and is aware
that the District cannot change an existing permit without going
through a lengthy administrative process of approximately six to eight
months. He said any hearing by the SFWMD in July will only be the
beginning of that process.

mouth to the Marco Island Bridge as "Isle of Capri Road" to coincide
wtth the remaining portion of S.R. 951 running north from S. R. 84 to
I~okalee Road, which was given that name by the Board of County
Co~ss~oners ~n 1988. He explained this w~ll eliminate confusion for
the benefit of the health and welfare of c~t~zens of Collier County

Mr. Brutt informed the Board of Staff's participation in a program
through the Federal Emergency Management Agency which has resulted in
a 5~ cost reduction to all persons paying flood insurance premiums in
Collier County. He mentioned if the application ts continued tn the
next year, there may be the opportunity to gain another 10~ tn the
policy costs. He asked the Board to acknowledge Staff for their
endeavors In this very successful program.

Tom Kuck, Transportation Capital Projects Director, stated this
construction project consists of the four-laming Improvements to
Road from U.S. 41 to 1-75, which also includes storm sewers,
~ttars, street lighting, signal syetems Improvements and pro-
visions for future landscaping. He said It ts anticipated that
construction will start around Au~st, 1992 with a completion date of
November, 1993. He reported six bids were received, and Westwlnd
Contracting, Inc., was the lo~ bidder with a total base bid amount of
$5,298,~01.80, or 20.12~ below the Engineer's Estimate. He recoa-
atended the Inclusion of Alternate J1 tn the amount of $50,147 for
canal excavation for the SFWMD, which will be subject to an Interlocal
Agreement and reimbursable to the County.

Sandra Taylor, Real Property Management Director, explained Staff
Is recommending the Board of County Commissioners support the acquisi-
tion of acreage tn Units 11, 12, 13 and 14, Golden Gate Estates,
located near Wilson Boulevard and Golden Gate Boulevard, for purposes
of constructing a recreational library facility pursuant to the GAC
survey.
In response to Commissioner Volpe, Ms. Taylor lsd/cared the land
adjacent to the Big Cypress Elementary School ts not of sufficient
e~ze for a community park, even with a Joint usa with the school site.
She advised after the YMCA project fell through, Staff contacted the
Big C~ress Elementary School who has given the County permission to
use the school site tn the Interim.
Commissioner Goodntght advised the school site is not available
during the summer months.
Co,missioner Volpe communicated the School Board Is desirous of
entering into a use agreement with al/ their recreational facilities
at elementar~ 8chools. He asked if that ty~e of agreement has been
pursued with the Big Cypress Elementary School and the School Board?
Tom Olltff, Public Services Administrator, ~ndicated Staff ie
attempting to come to an agreement for all schools and has not under-
taken endeavors for any individual site. He said under current
conditions, he does not have the people to staff additional
stafftn~
areas. He noted the School is Interested in providing the site during
the e~uLmer because there are no recreational facilities in the area.

Vlad Ryziw Transportation Engineering Project Manager, explained
Bid No. 92-1861 relates to a construction contract for the six-laning
of Airport-Pulling Road from U.S. 41, north to immediately south of
the Radio Road intersection. He said the project scope includes a
comprehensive maintenance of traffic control plan. He noted the
contract prohibits work on Mondays and Fridays, which implies there
will be night work on the project. He stated of the three bids
receivld, Apac-Florida, Inc., is the low bidder with a total base bid
and alternate amount of 81,394,311.75, or 24% below the Engineer's
A lengthy discusalon ensued ex~latning Alternate "A", which deals
with methods to rehabilitate and strengthen the existing pavement.
Mr. ~ziw noted additional coordination of design within the
State's rights-of-way is necessary. Therefore, he said, Staff is

": the Board directed Staff to prepare a formal agreement outlining all
comttments and requirements to ensure the County is protected
regarding the installation of the golf cart crossing underneath
,,: Goodlette-Frank Road and to also assure that the County's roadway
extension project schedule is not adversely impacted. He concluded by
asking the Board to approve the Easement Agreement as prepared and
direct Staff to process the appropriate permits and conditions as part
of Ordinance 82-91.
Comtssloner Saunders questioned if adequate protection la pro-
vided the County? He referred to paragraph 8 which contains a hold
harmless indemnification for any potential liability during the
construction of the facility. He asked If there should be further
Insurance regarding any accidents that may occur In the future at that
j,~ site because of the golf cart facility?
&sslatant County Attorney Walgel responded he will draft addi-
tional language to address that concern during the discussion.
Co~testoner Volpe Indicated he Is troubled with the fact that the
easement Is being ~ranted for $10.00 and at some later point In time,
ii the value will be determined. He asked how future negotiations are

Transportation Services Administrator Archibald explained Staff Is
currently working with Westinghouse Communities In two other critical
areas concerning their project. He said Staff recouends the value of
this E&se~ent Agreement be reflected at the point In time when nego-
tiations covalence for the location, design and construction of
Vanderbtlt Beach Road through the project. He advised the value of
the mase~ent In the future, as the County negotiates for alignment of
· Vanderhllt Beach Road may be ~uch larger than Its present worth.
Conisstoner maunders communicated his concern with the language
of paragraph ? regarding contracts to perform the work of the golf
cart crossing being submitted to the County for record purposes only.
Assistant County Attorney Welgel said at the direction of the

time to put a value on the easement ts during the point in time when
the County ia considering the PDA.
Commissioner Volpe requested Mr. Hoegsted to agree that the grant
of this easement will not be relied upon for any estoppel argument In
connection with any future rezone with respect to this property, to
which Mr. Hoegsted concurred.

this item was removed from the consent agenda to make minor modifica-
tions to the resolution. He said the notice to property owners sec-
tion will be changed to decrease the number of dwelling units from
1,216 to 1,187, which will in turn increase the cost per dwelling unit
from $?40.20 to $?§8.29. He requested July 28, 1992, be established

Legal notice having been published tn the Naples Dally News on
June 7, 1992, as evidenced by Affidavit of Publication filed with the
Clerk, public hearing was opened.
Attorney George Varnadoe explained the Master Plan for Twelve
Lakes had five phases, and Phase 5 was nothing more than area set
aside for the temporary sewage treatment plant because the petitioner
did not know whether or not the County's facilities would be available
at the time of construction. He Indicated this resolution will now
add the Phase 5 land to Phase I, which does not change the number of
dwelling units, but will ensure the correct site plan is attached to
the a~ended Development Order.
Planner Nine asked If the Board ts inclined to approve this Item,
that Staff be allowed a slight modification without changing the
Intent of the resolution. He explained Assistant County Attorney
Student has expressed concern with the wording of the resolution.
Mr. Varnadoe Indicated he is aware of Ms. Student's concern and
has no problem with Staff's proposal.

to the Ordinance. Be suggested an additional change on page 3 of the
Ordinance, regarding the use of the County logo. He proposed tho word

Coutssloner Saundere, referring to page 4, Section Eight

County Attorney Cuyler referred to the list of boards on page 7 of
the Ordinance. He communicated that the Im~okalee Lighting and
Beautification Advisory Coulttee has removed the word "Lighting# from
Ate title.
· Jennifer Edwards recommended the Pocket of Poverty Review
Couittee become an ad hoc committee.
County Attorney Cuyler indicated he will investigate making that
change.

Planner Young presented Petition V-92-13, requesting a dual
variance in the RMF-6 zoning district tn order to place an 8' x 10'
storage shed on the property. He said Mr. Kersman ts requesting an
eight foot variance from the required rear yard setback of 10 feet and
a five and one-half foot variance form the required side yard setback
of seven and one-half feet, down to two feet on both the rear and side
yards. He advised although the request does not meet the criteria of
the Ordinance, the CCPC has forwarded the petition to the Board of
County Commissioners with a recommendation for approval, primarily
because Mr. Kereman's rear yard does not abut any other residential
