1) Pay operational costs in the amount of$112.29 incurred in the prosecution of this case within 30
days of this hearing.
2) Abate all violations by: Must apply for and obtain a Collier County Building Permit or Demolition
Permit and request required inspections to be performed and pass thru a certificate of
completion/occupancy within 90 days of this hearing or a fine of $200.00 per day will be
imposed until the violation has been abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office

The Board of Commissioners of Collier County, Florida, and the Respondents, Siegfried
and Irene G. Fascher, Co-Trustees of the Siegfried and Irene G. Fascher Revocable Family Trust
dated September 24, 1993, as owners or owners' agents,hereby stipulate and agree to the following
matters:
I. That the persons signing this Stipulation have the authority to enter into the
Stipulation and bind all named Respondents to the terms contained herein.
2, That the violations recited herein, exist at the property located at 11219 Keewaydin.
Island, Naples, Florida and have not been abated or corrected. The premises is not homestead
property.
3. That the structure on the subject property has been designated as a historical
structure by the Board of Commissioners of Collier County,Florida.

4• That before the Respondents could undertake any action to correct the violation
recited herein they were required to apply for and obtain a Certificate of Appropriateness from the
Collier County Historical/Archaeological Preservation Board("HAP13").
5. That on the 1 ith day of October, 2011, the HAPB issued a Certificate of
Appropriateness for the Respondents to preserve as much of the structure as possible to its original
appearance with the condition "of sliding glass doors and/or windows, keeping the front porch,
leaving part of the cantilevers as an element of the original and retain the bay side of the structure".
The HAPB also recommended ericoura,ging leniency by the Special Magistrate in
the Code Enforcement case,as long as the owners of Hari:Cottage were continuing with its historic
qualities.
6. That in order for the Respondents to complete the remedial work authorized by the
HAPB and thereby correct the existing violations, they verily believe it will take a period of
approximately twelve(12)months.
?, That the parcel on which the violations exist is located on a barrier island that is
accessible only by boat. 'mere are no residents in the immediate vicinity of the subject parcel.
Respondents have posted the property, fenced it, established a "collapse zone" around it, and
taken other actions to prevent any intruders on the property from being injured, pending the
completion of the corrective action to remedy the violations:
8. The Respondents, subject to the issuance of Certificate of Appropriateness by the
HAPB, shall have the right to demolish the structure in the event it becomes economically infeasible
for them to otherwise abate the violations.

9. That the Respondents are granted until December 31, 2012 to take the necessary
remedial actions, to abate and correct the violations and bring the property into compliance with
applicable County codes and ordinances.
10. That., if the Respondents do not correct the violations and bring the property into
compliance with the code sections cited herein on or before December 31, 2012, a fine of$250.00
for each and every day the violations continue past that date will be assessed. The tine, if imposed,
shall become a lien on-the property where the violation exists.
11. That the Respondents bear the burden of contacting Collier County Code
Enforcement Officer to arrange for a re-inspection of the property, in order to verify that the
violations have been corrected and the property has been brought into compliance with the code
sections cited,and may be provided with a written statement of compliance,if requested.
12. That this Stipulation is subject to acceptance of the Collier County Code
Enforcement Special Magistrate. If this Stipulation is not accepted by the Collier County Code
Enforcement Special Magistrate, a Notice of Hearing before the Special Magistrate will be issued
and this Stipulation shall become null and void.
13. That, as the Respondents, we recognize that we have the right to a public hearing
before the Collier County Code Enforcement Special Magistrate for the purpose of providing an
independent review of the violation(s) outlined herein; that voluntarily and knowingly, waive that
right and enter this Stipulation. We understand and agree that the.terms and conditions provided
under this Stipulation may be incorporated into, and become part of, the Special Magistrate's Order
to be entered herein.
14. That the following citation(s), correction action(s), conditions and/or exceptions

COMES NOW, the undersigned, ,(.1 M13- 1-J6.(� , on behalf of himself or Pacifica Naples, LLC as
representative for Respondent an enters into this Stipulation and Agreement with Collier County as to the
resolution of Notices of Violation in reference (case) number CEEX20110015355 dated the 22nd day of
August, 2011.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for December 2, 2011; to promote efficiency in the administration of the code
enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the
parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of$112.38 incurred in the prosecution of this case within 30
days of this hearing.
2) Abate all violations by:
Correcting all fire code violations (annual inspection of fire sprinkler system, replace missing FDC caps,
install light weight truss signage, replace painted sprinkler heads, label/identify fire alarm and sprinkler
cabinets, label/identify control valves/backflow preventers, replace missing and/or secure covers on
flow switches) wit a
hin dys or pay fine of $500.00 per day.

3) Respondent must notify Fire Prevention within 24 hours of abatement of the violation and request the
Inspector perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office
to enforce th- •rovis'ons of this agreement and all costs of abatement shall be assessed to the property

The first&fifth pages are the field work for the driveway. The second page is the actual Permit. The third page is the
driveway form as permitted. The fourth page is a partial copy of a survey. It appears the drive was indicated to be for a
detached garage (lot 31) and a separate drive for the house (lot 32 to the right facing the property from the road).
These were intended to be two separate driveways with an open area between the two drives. Ordinance 2003-58 does
not allow swale enclosures such as filling in between the culverts.
Filling in between the culverts violate Ordinance 2009-19 (ROW) and Ordinance 2003-58 (prohibited swale enclosure).
