and for the County of Collier, and also acting as the Board of ZonAng
Appeals and as the governing board(s) of such special districts as

ORDINANCE 93-12 AMENDINO THE CURRENT NEWSRACK ORDINANCE, ORDINANCE
86-85, THEREBY CHANGING STANDARDS FOR NEWSRACKS PLACED WITHIN
RIGHTS-OF-WAY - ADOPTED; AND VOLUNTARY AGREEMENT WITH THE VANDERBILT
BEACH HOMEOWNERS ASSOCIATION - APPROVED
Legal notice having been published in the Naples Daily News on
January 28, January 29 and February 25, 1993, as evidenced by
Affidavits of Publication filed with the Clerk, public hearing was
opened.
Commissioner Saunders noted this is the second public hearing to
consider amending the current Newsrack Ordinance.
Planner Bob Lord noted the clarification of two items took place
at the first public hearing. He reported the ordinance was revised to
state a distance of no more than three inches is allowed between two
newsracks, and the maximum of the right-of-way newsrack location with
12 newsracks will not exceed 33 feet.
Cow-isstoner Norris moved, seconded by Commissioner Constantine
and carried unanimously, to close the public hearing.
Commissioner Constantine moved, seconded by Commissioner Norris
and carried unanimously, that Ordinance 93-12, amending Ordinance
86-85, be adopted and entered into Ordinance Book No. 60.
RespondLng to County Attorney Cuyler, Planner Lord stated he has
mailed a letter to the signers of the voluntary agreement asking for
authority to bind the principal to that agreement.
County Attorney Guy/er reported as soon as that authorization is
received, the agreement may be executed. He advised the Board to take
action to approve the agreement, have Staff receive the authorizations
for signature and prepare the final document.
Commissioner Volpe moved, seconded by Commissioner Matthews and
carried unanimously, to approve'the Voluntary Agreement, addressing
the appem~ance and placement of newsracks in the public road right-of-
way in the Vanderbilt Beach Area, with the Vanderbilt Beach Homeowners
Association.
