Page 5 October 12, 1993 {494) Item BUDGET ~ USING (IIX) RESERVES TO PAY IMPACT FEES THAT WERE PREVIOUSLY EXEMPTED, DKFERRED OR AUTHORIZED FOR REIMBURSEMENT - CONTINUED TO OCTOBER 19, 1993 Greg Mthaltc, Affordable Housing Director, Informed the Board that he has discussed this Issue with the County Attorney's office, and they agreed that the interest In the impact fee funds may be used, but would prefer that they be used in the particular funding area, as well as in the districts the fees were collected in. He stated that when these Items were passed, they specified other funding sources because that was not considered at that time. Commissioner Matthews asked if there is the ability to change that funding source now? Mr. Mthalic replied that staff would have to determine if the reserves are suitable tn those districts and impact fee funds. County Attorney Cuyler stated that he did not know if the policy should be established that the Interest be used for waiver of affor- dable housing. Mr. Mthaltc reported that 4 out of 5 pro,acts are in Immokalee, adding that he is not sure that an analysis would produce enough reserves within the road funds within that particular area, but an analysis can be prepared. Commissioner Matthews confirmed that she would like to see that done. Frank Brutt, Community Development Administrator, explained that this is a request for a final plat for a small subdivision west of Bayshore Drive, noting that staff Is satisfied with the requirements and desired stipulations. Transportation Services Administrator Archibald replied that one of the requirements of staff placed on one of the developments was to make that a concurrent requirement. He confirmed that the sidewalks will be built before the Certificates of Occupancy are Issued. FOR CONS~UCTION Commissioner Constantine stated that he requested this item be removed from the consent agenda because the item outlined on the exe- cutive summary and the attached item are not the same, on the summary it ts noted as County Road Project No. 66033, the actual Item is noted as County Road Project No. 66032. Transportation Services Administrator Archibald explained that Project No. 66032 was used for the design phase, 66033 is used for the construction phase, 660300 series is allocated to Airport Road. He confirmed that the same document will be used. Commissioner Matthews expressed concern regarding Section "b" of the agreement regarding repaying North Road, she asked wh~t the life span was of the repaying? Mr. Archibald replied that the repaying had been done as part of the intersection work for signalization, adding that the service life Is typically 8 to 10 years. Page 8 October :12, :1993 Item ,8D1 BUDGET ~ FOR TH~ NARCO WAT~R-S~W~R DISTRICT - ~PPROV~D Ron Cook, Utilities Finance Director, explained that the budget amendment of $60,000.00 Is for bulk sewerage treatment as Southern States Utilities runs the actual treatment plant and half of the collection system, noting that the County also o~ns half. Commissioner Natthews moved, seconded b~ Commissioner Volpe and carried unanimously, that the ~dget ~en~ent for the ~rco ~ate~r District ~ appr~ed. ~ ~ 93-2092 FOR ~RTISING P~C~ S~VICES - ~O~D Tom Whltecotton, Human Resources Director, stated that the place- ment agencies are used to help research appropriate publications and target various recruitment. He remarked that this service is used primarily for managerial/professional positions. Conuntsstoner Constantine asked if this was done "in-house", how many hours would be necessary? Mr. Whltecotton emphasized that the primary benefit would allow a professional organization to research publications that are appropriate for our needs. In response to Commissioner Constantine, Mr. ~hltecotton replied that we do not have the staff to handle this function. Co~issioner Norris moved, seconded by Commissioner Constantine to award RFP 93-2092 for advertising placement services. Steve Carnell, Purchasing Director, pointed out the large majority of the money will be spent anyway and the agencies are sold adver- tisements at a different rate than companies and collect the dif- ference as the cost of their services for performing the work to us. Ztn#8F1 R~CONN~NDATION TO WAIV~ TH~ CONPETITIV~ BID PROCESS ~ND R~CO~NIZE NAPLES CONNUNITY HOSPITAL AS THIJ SOLE SOURCE PROVIDER FOR TH~ R~NTAL Page 9 October 12, 1993 OF BED LINEN UTILIZED BY THE COUNTY'S EMERGENCY MEDICAL SERVICES DEPARTMENT - APPROVED Commissioner Volpe stated that he requested that this item be removed from the consent agenda for an explanation of why the com- petitive bidding process ts being waived. Steve Carnell, Purchasing Director, Indicated that the EMS Department contacted Purchasing several months ago regarding the con- tinuation of this service, and at that tame the hospital indicated that they wanted a cost adjustment. He reported that his staff con- tacts vendors who provide any type of related service to see if they would respond to a bidding process. Mr. Carnell gave the definition of "sole source provider" in this case by explaining that because Naples Community Hospital is the only hospital tn the county, the majority of runs are to the hospital, the linens for the paramedics are provided by the hospital, and as a patient is transported, the paramedics are able to pick up linens at the same time. He reported that they could only find one vendor who could provide this service, and it would still be more expensive and additional staff time would be necessary. In response to Commissioner Volpe, Bill Griffin, EMS Manager, revealed that the increase in price to Naples Community Hospital, was the/r cost, and they are charging us what it cost them to launder the linen. Com/sstoner Volpe moved, seconded by Commissioner Norr/s and carrAedunanAmously, that the competitive bid process be wa/red and recognize Naples Community Hospital as the provider of linen to our EMS department for the coming year. RECOmmENDATION RE TH~ PROPOSED CAPITAL PROJECT CONSOLIDATION PLAN - APPROVED" Tom Conrecode, OCPM Director, provided some additional information regarding the consolidation plan and a recapitulation of previously Page 10 October 12, 1993 provided information and, tn addition, a revision to Attachment C has been made. He addressed a point of contention regarding the engineers in the department, stating that although the different talents are distinguished, there are certain functions within engineering that are basic to the practice of civil engineering, adding that he recommends utilizing the common talents that cross traditional boundaries. Commissioner Constantine asked if it would be possible to establish a figure of money saved in a year's time. Mr. Conrecode was hesitant to offer a dollar figure, but agreed to report the savings in a year. In response to Commissioner Volpe, Mr. Conrecode revealed that he ia targeting a 40/50~ range of all the professional services to be done by county staff with the balance being contracted out to spe- cialists. He recalled that in the past five years, it has been tn the 15/20~ range. Mr. Conrecode gave a brief description of his proposed re- structuring, adding that there would be some crossover between the different functions. At Commissioner Matthews request, Mr. Conrecode reviewed the 14 positions that would be downgraded in the proposed plan. County Manager Dorrtll reported his goal from a management perspective and recalled in early 1992 the Board asked for a review of all mid-level positions that could be eliminated or phased out. He indicated 23 mid-level positions were eliminated and as a result the Board showed interest In a similar comparison In the Capital Projects division with emphasis on Increasing the efficiency by trying to maxi- mize the number of projects that employees could work on while increasing the number of projects completed In-house. He commented that although it is not a perfect plan, It is a very good plan and suggested that if the plan were approved, a 6 month review should be considered. In response to Commissioner Volpe, Mr. Conrecode disclosed that there Is some apprehension on. the part of some employees. Page 11 October '12, 2993 Commissioner Matthews revealed that she has contacted a number of engineering firms and noted that they all were structured differently from what is being proposed, emphasizing that the profit making firms have a consolidated program. Commissioner Matthews expressed her concern regarding the findings of the Management and Organization Review Report, dated 1/14/92, which mentions the re-organization of Development Services, which has not worked yet, adding that the report suggests no changes for Capital Projects. Commissioner Matthews disclosed that the interim report from the Productivity Committee this summer did not agree with the con- solidation. County Manager Dorrill remarked that the Q-Plus Task Tea~ endorsed the consolidation. Commissioner Constantine commented that when he served on the Productivity Committee, one of the recommendations was to adopt th~s consolidation plan. Gommissioner Matthews reviewed a number of questions asked by the consultants of the Productivity Committee. Tmpe ,2 Commissioner Constantine asserted that the consolidation was more efficient, cost effective and will reduce the reliance on outside consultants. Co~dssioner Constantine aoved to approve the consolidation plan, to be reviewed within a certain tile period. Commissioner Saunders stated that more focus should be placed on the /n-house memorandum's being circulated from some of the engineers who will be affected. He emphasized that the downgrading will cause morale problems.' Page 12 October 12, 1993 Commissioner Sounders opposed the motion, remarking that a great deal of expense will be Incurred by the time this plan ts reviewed, and suggested that a more appropriate approach ts to evaluate the pro- posal, alternatives and the implications for the alternatives and then make a decision based on all the information. Commissioner Volpe questioned whether the project has been sche- duled in a manner to allow maximum utilization of all the parking spa- ces during the peak tourist season. He noted that the County has no ordinance dealing with vagrancy or loitering. County Attorney Cuyler advised that there Is an ordinance prohi- biting loitering and prowling In the unincorporated area which follows the State Statutes. He noted that the ordinance addresses public or semi-public areas. Commissioner Saunders suggested that County Attorney Cuyler review the ordinance and determine whether there ts a loophole that needs to be filled. County Manager Dorrtll recalled previous discussions with regard to homeless people sleeping tn the woods. He indicated that the County does not have an ordinance Involving that type of activity and cited that the Boar~ may desire to revisit this matter. He indIcated that the burden ts being placed on the renter instead of the owner of the property. Commissioner Constantine cited if the property ts not up to par relative to landscaping requirements or Is short a parking space, Page October 12, 1993 there ts nothing a renter can do tn this regard. He remarked that the renter has to go back to the landlord and attempt to have him make the necessary corrections to bring the property tnto compliance. He noted that this placed the burden on the wrong party. Current Planning Manager Bagtnskt reported that the Land Development Code (LDC) and other requirements indicate that staff review Occupational Licenses prior to the Issuance. In addition, he advised that those places that are non-conforming based on parking, landscaping, or handicapped parking spaces must be brought into compliance as deemed appropriate. Commissioner Volpe stated that the burden ts not requiring the renter to make the corrections to the property, but merely a notifica- tion mechanism that goes back to the landlord. Commissioner Constantine communicated tf a plaza has been operating satisfactorily for 7-10 years and one unit becomes vacant for three months and a new business moves tn, that occupant ts asked to bring everything up to Code. He revealed that he has a problem in this regard. He advised that the Collier County Planning Commission reviewed this petition on September 16, 1993, and their comments are noted within the Executive Summary. Mr. Weeks referred to the maps contained In the agenda packet. Ne pointed out that each of the subject properties are Identified therein. Mr. Weeks called attention to Page 33 of the Executive Summary, noting that these properties are tn Golden Gate City, located on the East side of Santa Barbara Boulevard. He reported that these properties have had Compatibility Exception applications approved and staff Is not attempting to rezone them In the transitional sense from C-2 to another zoning district, but Instead, adding one condition regarding buffering. Mr. Weeks advised that each of these properties are 50' wide and concern has been expressed with regard to a potential access point every 50~ along Santa Barbara Boulevard. Planner Weeks advised the only differences are the size of the properties on Golden Gate Parkway is ~arger and more than one lot may be under the same ownership. He said because they are larger proper- ties there may be 100 or more feet with one access point as opposed to potentially one access every 50 feet for the subject property. Commissioner Constantine stated the owners of the properties on Golden Gate Parkway are being required to work out an access plan, yet Staff is saying the Board cannot require the owners of these pro- parties along Santa Barbara Boulevard to do the same. Planner Barbara Cacchione explained certain restrictions have been placed on the commercial area along Golden Gate Parkway in order to avoid the problems being experienced on Santa Barbara Boulevard. She sa~d at this point, because of the development pattern already in place along Santa Barbara Boulevard, the only thing Staff can apply is the access control policy, which requires access points to be coor- Page 21 October 12, 1993 dinated when there is common ownership. Commissioner Volpe asked if there is anything the Board can do to encourage shared access for these properties? Planner Weeks responded the small size of the properties does not allow for an tnterconnection to work. He said the depth is only feet and they are on septic systems which means they must reserve a portion of the property for the sewer system. In answer to Commissioner Volpe, Planner Weeks stated the alley in the rear of the properties can serve as a secondary access for deli- veries or for parking. Again, he said, due to the size of the lots, the parking area in the front will not be able to connect to the alley in the rear. Commissioner Volpe inquired what will happen when Santa Barbara Boulevard is six-laned in the future? Planner Weeks replied that it may be possible to make part of the existing Santa Barbara Boulevard into a frontage road, which would necessitate going to the other side for the additional area needed to six-lane the roadway. He concluded the access problems have been discussed at length with various County departments and no solution has been found. Planner Weeks next individually detailed the seven maps contained in the Executive Sununar¥ and asked the Board to approve each one separately. He said Maps #1 and #2 depict various commercial lots on Santa Barbara Boulevard. It was the consensus to approve Maps #1 and #2. Referring to Map #3, Planner Weeks explained these lots are within Palm Springs Plaza Subdivision and zoned C-2. He noted the lots were the subject of a recent appeal hearing before the Board, at which time Staff was directed to rezone the properties to C-1. He called atten- tion to Parcels 3.! and 46 on the map. He recalled an exemption was granted for these parcels under ~he Zoning Reevaluation Ordinance based on an approved Site Development Plan, allowing the property owner to commence development of the property as long as the develop- Page 22 October 12, 1993 ment was in good faith and continuous. He advised Staff voided that exemption because in their opinion, development had not commenced in good faith even though some construction had occurred on site. He said the Planning Commiss~on and Staff have come to an agreement with the property owner to require a certain amount of construction to occur within a one-year time period, specifically, completion of the sewer system, construction of a portion of the roadway through the property and substantial completion of the water management system. Ha indicated this is similar to the amount of development that has occurred on another property owned by Mr. Dennis Lynch which was the subject of a lawsuit under the Zoning Reevaluation Ordinance. He said Staff is attempting to apply the same general standard of substantial completion of infrastructure that the Judge applied to the Lynch pro- perty. In answer to Commissioner Volpe, County Attorney Cuyler advised in his opinion, Staff is taking the appropriate action. Also in answer to Commissioner Volpe, P~anner Weeks stated if the owner does not live up to the agreement to complete the specified construction within one year, Staff will bring th~s property back to the Board for possible downzoning and a resu~ting ~oss of value of the property. It was the consensus to approve Map *3 with the exception of Parcels 3.! and 46. It was the consensus, with Commissioner Volpe dissenting, to withdraw Parcels 3.! and 46 on Map *3 from rezoning, subject to the agreement with the property owner. Planner Weeks next referred to Map #4 depicting a parcel west of Bayshore Drive and south of U.S. 41. He said the owner applied for a compatibility exception which was denied by Staff. He reported the recommendation ts to rezone the property to a density of three units per acre, while retaining its RMF-6 zoning. It was the consensus to approve Map #4. Planner Weeks explained on Map #5, the property shown in the upper Page 23 October 12, 1993 left corner is currently zoned RMF-12 and C-3 and was the subject of a compatibility exception appeal tn September, 1993, at which time the Board denied the appeal and directed Staff to Initiate the rezontng to RifF-12, converting the commercial to the maximum of 16 units per acre, which results tn an overall density of 8.9 units per acre. He noted the four properties located on the south side of Davis Boulevard have commercial and residential zonings and were also subject to an appeal. He recalled the Board's direction to Staff was to rezone the proper- ties to RMF-12, capping the density at 10 units per acre for five years, It was the consensus to approve Map #5.
