CREATING THE IH~IOKALEE LIGHTING AND
BEAUTIFICATION DISTRICT IN COLLIER COUNTY,
FLORIDA; PROVIDING FOR TIlE GOVERNING BODY
OF SAID DIST~CT; PROVIDING FOR BUDGETARY
PROCEDURE; PROVIDING THE'POWERS AND DUTIES
OF TIlE GOVERNING BODY OF SAID DISTRICTs
PROVIDING THE GEOGRAPHICAL BOUNDARIES
OF THE DISTRICT; AND PROVIDING AN EFFECT-
IVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMHISSIONERS
OF COLLIER COUNTY, FLORIDA:
Section 1. All th~ land located in Collier
Co~ty, Florida, and ~pecifically described as:
The South 1/2 of the South 1/2 of Section 29;
South 1/2 of the Southeast 1/4 of Section 30;
the Northeast 1/& of Section 31; all of Section
32; all of Section 33; the Southwest 1/4 of
,~ Section 34; and the South 1/2 of the South-
~est 1/4 o~ Section 28; all in Township 46
South, Range 29 East.
The Southeast 1/4 o£ Section 3~ t~e west 1/2
of Section 3; all o~ Section 4S the Northeast
1/4 of Section 5; the North 1/2 o~ the North-
west 1/4 of Section $~ the East 1/2 of Section
9 and the Southwest 1/4 of the Northeast 1/4
of Section 11; all $n Township 47 South, Range
29 East.
is hereby created and established as a lighting and
.b~auti~ication district known a8 the Immokalee Lighting
and Beautification Die~rict, hereinafter called the
D$str~ct.
Section 2. The governing body o~ The Diatrict
shall be ex officio the Board of County Commissioners
of Coil[er County, Florida. Said Board may at its
pleasure appoint an advisory group or board to
advise it in matters pertaining to the District.
Section 3. The District is formed for the
purpose of providing street lighting and beau[if[=
cation within the property above described, and to
that end shall process all the powers to do all
things reasonable necessary to provide such services,
including ownership of property , poles, wires, con-
duits, lights, meters, and the power to maintain the
same and to enter into contracts for providing the
same and the electric current to operate any lighting
system therein installed.
Section A. For the purpose of carrying into
effect this Ordinance the Board of County Comissioners
shall annually, at the time required by general
budgetary law, make an itemized estimate of the
amount of money required to carry out the business
o£ the district for the next fiscal year, which shall
be from October 1, to and including September 30,
following. The estimate shall have for what pur-
pose the moneys are required and the amount necess=
ary to be raised by taxation a millage sufficient
to meet the requirements of the estimate, provided,
however, the total millage shall not exceed one
(1) mill.
Section 5. Taxes herein provided for shall be
assessed and collected in ~he same manner and form
as provided for the assessment and colle~ion of
general county taxes and subject to the same fees
for assessing and collecting as general county
~axes.
Section 6. This ordinance shall take effect
at the time provided by law.
