Ordinance 71-04 AN ORDINANCE CREATING THE POINCIANA VILLAGE LIGHTING DISTRICT IN COLLIER COUNTY, FLORIDA PRO- VIDING FOR THE GOVERNING BODY OF SAID DISTRICT; PROVIDING FOR BUDGETARY PROCED- URE; PROVIDING THE POWERS AND DUTIES OF THE GOVERNING BODY OF SAID DISTRICT; PROVIDING THE GEOGRAPHICAL BOUNDARIES OF THE DISTRICT; AND PROVIDING AN EFFEC- TIVE DATE. ORDINANCE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: Section 1. All that land located in Collier County, Florida, end specifically described as: Poinciana Village~ Unit 1~ Plat Book 8, Page 61 Poinolana Village, Unit 2, Plat Book 10, Page 80 Public Records of Collier County, Florida is hereby created and established as a lighting district known as the Poinciana Village Lighting District, hereinafter called the district. Section 2. The governing body of the district shall be ex officio the Board of County Co~m~issionera of Collier County, Florida. Section 3. The district is formed for the purpose of pro- riding street lighting in the above described subdivisions~ and to that end shall possess all the powers to do all things reason- ably necessary to provide such services, including ownership of property, poles, wires, conduits, lights, meters, and the power to maintain the same and to enter into contracts for providing the same and the electric current to operate any lighting system therin installed. Section &. For the purpose of carrying into effect this Ordinance the Board of County Commissioners shall annually~ at the time required by general budgetary law) make an itemized estimate of the amount of money required to carry out the business of the district for the next fiscal year, which shall be from October 1, to and including September 30, following. The esti- mate shall have for what purpose the moneys are required and the amount necessary to be raised by taxation within the district. At the time and place for fixing the annual rate of taxation for county purposes the Board shall fix and cause to be levied on all property within the district subject to taxation a millage sufficient to meet the requirements of the estimate, provided, however, the total millage shall not exceed one (1) mill. Section 5. Taxe~ herein provided for shall be assessed and collected in the same manner and form as provided for the assessment and collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes.
