Ordinance 71-01ORO2~A~C% XO. 71-1 AN ORDAZNANCE PROHIBITING THE OWNERS OF DOGS FROM PERMITING THEM TO RUN AT LARGE IN CERTAIN AREAS OF COLLIER COUNTY AND PROHIBITING DOGS IN CERTAIN PLACES IN SAID COUNTY, PROHIBITING THE KEEPING OF DOGS OF VICIOUS PROPERTIES, DE- FINING TERMS; AND PROVIDING AN EFFE6TIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF coLLIER COUNTY, FLORIDA: Section 1. Definitions (a) The construing the provisions of this Ordinance, except where the context plainly requires otherwise, words used herein shall be given their common and ordinary meaning. In addition, the following specific definitions shall apply. (b) "Owner" shall mean any person, firm or corporation having an interest in or right of possession to a dog, or any person, firm or corporation having control, custody or possession of a dog. (c) "Vicious" Shall mean the propensity to do any act that might endanger the safety of any person or property of another, including, but not limited to a disposition to mischief or fierceness as might occasionally lead to attack on h,-~n beings without provocation, whether in play, anger or outbreak of un- trained nature. Section 2. It shall be unlawful for an owner of a dog: (a) To permit a dog to run at large within any subdivision of Collier Count, a plat of which has been filed in the public records of chis County, with the exception of those subdivisions specifically listed as follows: (1) All units of Golden Gate Estates Subdivision. 87 7/- (b) To permit a dog to run at large in any park, or to enter upon any beach in this County or upon any public playground or school ground; provided, however, that this section shall not prohibit a person from walking or exercising a dog in a public park or on a public street when such dog is on a leash or otherwise under the immediate control of its owner and proper safeguards are taken to protect the public and property from injury or damage from said dog. (c) To permit any dog to enter any place where food is stored, prepared, served or sold to the public or any other public building or hall; provided, however, that this section shall not apply to any blind person using a trained seeing-eye dog, at veterinary offices of hospitals, or to animal shows or exhibitions. (d) To permit any female dog to run at large while in heat. (e) To permit any dog to trespass on private or public property so as to damage or destroy any property or thing of value, or to create a sanitary nuisance thereon. (f) To permit any dog to chase, run after or Jump at vehicles using the public roads. (g) To permit any dog to habitually snap, growl, snarl, Jump upon otherwise threaten persons lawfully using the public rights-of-way. ,oo 1 66 (h) To keep, harbor or maintain any vicious dog or dog wi~h vicLous propensities in a manner which may or does endanger the safeL~ of persons or property off his premises or lawfully on his premises. Section 3. This Ordinance shall take effect at the time provided by law.
