ADDITION OF SECTION 12-7 PROtIIBITING
CAPTURE OR TRANSPORTATION OF PORPOISES
IN COLLIER COUNTY, WITH EXCEPTIONS,
PROVIDING THAT VIOLATION IS A MISDEMEANOR,
PROVIDING EFFECTIYE DATE.
WHEREAS, Mammalian Dolphins are an indicator of the quality
of Collier County and its waters, and
WHEREAS, these Porpoises are an attraction to and are
enjoyed by the visitors to and residents of this County, and
WHEREAS, there is an approximate thirty percent (30%) mo~t-
ality of all Porpoises that are captured and confined in
captivity, and
WHEREAS, citizens and visitors while i~ and near the waters
of Collier County derive both pleasure and a sense of security
and well being from the presence and movement of these animals
and their aversion to sharks, and '
NOW THEREFORE, be it ordained by the Board of. County
Commissioners of Collier County, Florida, that the Code of
Collier County be amended to reda as follows:
SECTION ONE: ~
Sec. 12-7 Porpoises, capture and transportation ~h~ll~' '
(1) It shmll be unlawful for any person to capt~
molest a Mammalian ~lphin, hereinafter ref~e~
to as a Porpoise, or to transport a Port
~he w~ters of Collier County, Florida, exce~a~
Agent of the St~e Department of Natural Resources
to determine the cause of, or to prevent the injury,
de~th or disease of Porpoises·
(2) It sh~ll be unlawful for any person to molest or
~ capture a Porpoise, in the w~ters of Collier.
~ County, Florida, or to transport a Porpoise from
~ ,~ ~he wmters of Collier County without ~itten .

SECTION ~0:
Should this Ordinance conflict with other law the
more restrictive shall apply.
Should any section, sub-section, clause, phrase or
word of this Ordinance be held invalid it shall be severed and
shall not invalidate any other part of this Ordinance or Code.
SECTION THREE:
This Ordinance shall tako effect upon receipt of
official acknowledgement from the Department of State, of
the State of Florida that this Ordinance has been filed.
