AN ORDINANCE PROHIBITING THE OPERATION
OF MOTOR VEHICLES AND MOTORCYCLES ON
THE BEACHES OF COLLIER COUNTY, LOCATED
OUTSIDE OF A MUNICIPALITY; DEFINING
TERMS; PROVIDING FOR REPEAL OF COLLIER
COUNTY ORDINANCE 70-7; CLASSIFYING
CERTAIN VEHICLES AS EXEMPT; PROVIDING
PENALTIESl PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA z
Section 1. From and after the effective date of this
Ordinance, it shall not be lawful for anyone to operate or drive
a motor vehicle on the beach within Collier County, Florida,
described as z
All that portion of the beach of Collier County,
not located within the city limits of the City
of Naples, or any other duly incorporated
municipality.
Section 2. As used herein, "beach" means that area of ~and
between the waters of the Gulf of Mexico and the natural upland
vegetation or seawall.
Section 3. "Motor vehicle" includes z
(a) Automobiles, motorcycles, swamp buggies, dune
buggies, motor bikes, motor trucks, trailers, semitrailers, tractor
trailer combinations, and all other vehicles operated over the
public streets and highways of this state and used as a means of
transporting persons or property over the public streets and highways
and propelled by power other than muscular power.
(b) Vehicles designed and equipped to provide living
and sleeping facilities for use as a home, residence or apartment
and for operation over the streets and highways of the state consisting
of:
(1) Mobile homes, trailer coaches, travel
trailers and house trailers, manufactured upon a chass4, e or 'under-
carriage as an integral part thereof,'without independent motive
power, drawn by a self-propelled vehicle, and
(2) C~mper type mobile homes mounted and trans-
ported wholly upon the body of self-propelled vehicles.

'included in this paragraph, and the term "trailer coach" refers to
vehicles included in subparagraph (1) of this paragraph.
Section 4. Any person who violates this Ordinance shall be
deemed guilty of a misdemeanor of the second degree, punishable
as provided in Section 775.082 or Section 775.083, Florida Statutes.
Section 5. Collier County Ordinance 70-7 shall be repealed
by passage of this Ordinance.
Section 6. Sheriff's Department, Police Department, Fire
Department, and Game and Fresh Water Fish Commission vehicles shall
be exempt from the operation of this Ordinance when they are being
operated by employees of these departments in the normal course of
their duties. Also, vehicles which must travel on the beaches in
connection with conservation and/or environmental work shall be
exempt if an exemption certificate has been obtained fror~ the
Board of County Commissioners of Collier County, Florida, and
said exemption certificate is prominently displayed on the wind-
shield of such vehicle. The procedure for obtaining such an
exemption certificate shall be by application to the Commission
in writing stating the reason or reasons why it is necessary
for such vehicle or vehicles to be operated on the beaches in
connection with a conservation and/or environmental purpose,
and an exemption certificate for such vehicle or vehicles shall
be issued by the Board of County Commissioners if the Board is
satisfied that a lawful and proper conservation and/or environ-
mental purpose will be served thereby.
Section 7. This Ordinance shall take effect upon receipt
by the Board of County Commissioners of Collier County, Florida,
of official acknowledgment of the Office of the Secretary of
