A TEMPORARY EMERGENCY COLLIER COUNTY ORDINANCE
EXTENDING ~[E PROIIIBITION OF ~[E TRANSPORTING
OF COCONUT PALM ("COCOS NUCIFERA ADONIDIA OR
PRITCIIARDIA") TO OR TiiROUGI! COLLIER COUNTY,
FLORIDA FROSi O[{ TIIROUGII ~IONROE, DADE AND BROWARD
COUNTY, FLORIDA BY AMENDING ORDINANCE 72-6.
SECTION ONE:
BE IT ORDAINED BY ~IE BOARD OF COUNTY COMMISSIONEIt~OF~°
COLLIER COUNTY, 'FLORIDA:
1. It shall be unlawful for any person to cause "cocos
nucifera, Adonidia (veitchia ~errill.) or Pritchardia app." more
commonly known as Coconut Palm~, to be transported from, or
through; Monroe, Dade or Broward Counties into or through
Collier County, Florida.
2. Any person, firm or corporation aggrieved by this
Ordinance shall file an appeal, with the Collier County
Agricultural Agent, to the Board Of county commissioners
with a request listing the quantit~ and species of plan~s,
points of origin, and destination, time, route, means and
vehicle license number of and by which plants are proposed
to be transported in contravention of this Ordinance, and pre-
cautions taken against spread of "Lethal Yellowing".
3. The County Agricultural Agent is hereby instructed
to continue to accumulate and analyse current information and
continue to inform this Board of facts that Justify cancelia-
t~on or extension of this Ordinance and to refer any appeals
A violation of any provision of ~h~s Ordinance is a mis-
demeanor and shall be prosecuted in the name of the State in
the County Court by the Prosecuting Attorney, and upon convic-
tion shall be punished by a fine not t6 exceed $500[00 or by
imprisonment in the County 'Jail not to exceed 60 days, or by
both such fine and imprisonment. Each violation and each day
a violation continues shall constitute a separate offense. The
Board of County Commissioners shall have the power to collater-
ally enforce tho provisions of }his Qr.~inance by appropriate
judicial writ or proceeding notwithstanding any prosecution as
a misdemeanor.
SECTION THREE: ~merEency..
Be it declared 'that an emergency exists a~d the in~ediate
enactment of this Ordinance is necessary, therefore, notice
requirements are waived and this Ordinance shall take effect
inwaediately upon mailing to the Secretary of State, until six
(6) months after the effective date hereof, or such other date
as later established by Ordinance.
SECTION FOUR: Conflict.
In the event this Ordinance conflicts with other law, the
more restric::ive shall apply to the extent of such conflict.
SECTION FIVE: Severance.
Should any word, phrase, clause or section of this Ordinance
bc hcld invalid it shall be severed and shall not invalidate any
other word, phrase, clause or section.
