Pursuant to the provisions of Section 125.66, Florida
Statutes, this will acknowledge your letter of January 23 and
the 0rtginal and an official copy of Collier County Emergency
Ordinance No. 72-12, which 'was received tn this office on
January 26, 1973. Since this is the first ordinance adopted by
your county this year, we have renumbered it as Collier 73-1.

AN ORDINANCE ESTABLISHING BONDING
~EQUIREMENTS,$S A CONDITION PRECIDENT
TO THE REISSUE OF A BUILDING PERMIT,
PROVIDING FOR EFFECTIVE DATE, SAVINGS
CLAUSE, AND PENALTY WI~IIN COLLIER
COUNTY, FLORIDA.
BE IT ORDAINED by the Board of County Commissioners of Collier
County;
SECTION ONE:
Sec. 1. When the Building Permit issued by the Building
Official of Collier County, Florida expires, the owner or
contractor may appear befo?e the Board of County Commissioners
for an additional permit subject to special requirement~
deemed necessary by the Board in the interest of the pu , c~
health, safety, welfare and convenience. These precaut~'6ns
may include bonding requirements up to ten (lO%)~er cen~f,
cost of construction, or that amount of money estimated nec~
essary~ to complete the construction and associated projects
for which the permit is issued, whichever is greater. This
bond shall be subject to approval by the County Attorney.
The bond shall be subject to forfeiture at the option of the
County in the event the owner or contractor does not complete
the construction for which permit is issued within the period
of time of such extension with the provision that such funds
shall be applied to completion of the building to county
specifications at the direction of the County.
SECTION TWO:
In tho event this Ordinance conflicts with otb'er applicable
law, the more restrictive shall apply. 1 If any part of this
Ordinance conflicts with any part, it shall be severed and the
remainder shall have the full force in effect and be liberally
construed.
SECTION THREE:
Penalty::.: A violation of any provision of this Ordinance is a
misdemeanor and shall be prosecuted in the name of the ~_~ate~-in
the County Court by the Prosecuting Attorney, and upon ~v~t~n .
shall bo punished by a fine not to exceed $500.00 or "by ~pl/i%o?l~entl
in the County Jail not to exceed 60 days, or by both such fine
and imprisonment. Each violation and each day a violation con-
tinues shall constitute a separate offense. '~:e Board of County
Commissioners shall have the power to collaterally enforce the
provisions of this Ordinance by appropriate Judtclal Writ or
proceeding notwithstanding any prosecution as a misdemeanor.
SECTION FOUR:
Be it declared that an emergency exists and the immediate
enactment of this Ordinance is necessary, therefore, notice
requirements are waived and this Ordinance shall take effect
immediately upon its placement in the United States Mail to
the Secretary of State.
