I~{EREAS, the public safety requires fire control and emergency
medical care services within tile Ochopee Area o~ Collier County,
Florida and Section 125.01(q) of the Florida Statutes grants
authority for the Board of County Commissioners to establish such
a district.
NOW, THEREFORE BE IT ORDAINED BY TIlE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA;
SECTION ONE:
1. Creation of the Ochopee Fire District.
The "Ochop_ee Fire Diztrict" is hereby created, within the

2. Governing Board; Powers and Duties.
a. The governing board of the district shall be the Board
of County Con~nissi'oners of'Collier County, Florida with the power
and duty to conduct the affairs of the district with the powers
prescribed by Florida Statutes Section 125.01(q) including, but not
li.mited to the power to equip, operate and maintain a fire departmi~nt
and m~ulnnce service within the diat.~ic~ to buy, lea~e, sell,

supply for fire prevention and protection purposes~ to employ and
discharge; employer~ and authorize them to enter upon priva%e and

rules and regulations for th~ prevention and control of fire and
to othe~ise protect persons and property within ~he district.
b. The Board shall appoint a co~ittee of three (3) to
five ~5) electors residin'g within the dis%tier to ~erve staggered
terms of two (2) ycars each ~o hold me,tings ak such times and
places as it shall determin~~ for tho purpose of advising the Board
regarding the affairs of the district.
c. The Advisory Committee shall 9nnually prepare a district
budget and estimate the funds, their purpose and the ad valorem taxes
necessary to carry out the provisions 'of this Ordinance for the
following fiscal year as prescribed by Chapter '].29 of the Florida
Statutes.
d. Upon adoption of the district budget by the Board it
shall cause tho budget to be recorded in the Board minu%es and
shall cause to be lovied on all property within the district a
millage sufficient to fund th~ budget not exceeding one (1) mill
Jn any one year to be assessed and collected as though Cowry taxes,
e. The Treasurer of the Board shall:
1) Issue all warrants for services, equipment,
materials and other expenses incurred by tho district and
approved for paymen% by the governing board.
2) On or before tho end of each fiscal year prepare
an mnnual report of the receipts and expenditures of %h~ dis-
trict to the governing board as required by Section 218.20
et seq of the Florida Statutes.
SECTION TWO:
1. This Ordinance shall be liberally construed as a remedial
act to promote the public purposes intended.
2. This Ordinance shall become effective as provided by law.
