Resolution 2011-170 (CRA)CRA RESOLUTION NO. 11- 170 A RESOLUTION OF THE COLLIER COUNTY COMMUNITY REDEVELOPMENT AGENCY RELATING TO COMMUNITY REDEVELOPMENT; AMENDING THE BA YSHORE GATEWAY TRIANGLE REDEVELOPMENT GRANT PROGRAMS; PROVIDING FOR SEVERABIILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the BCC adopted Ordinance No. 2002-38 on July 30, 2002 creating the "Collier County Redevelopment Grant Program" creating a Site Improvement and Impact Fee Assistance Grant for the Bayshore Gateway Triangle Redevelopment Area; and WHEREAS, the BCC adopted Ordinance No. 2008-61 on October 28, 2008 amending Ordinance 2002-38 by modifying the existing grants and adding additional grant programs; and WHEREAS, the Community Redevelopment Agency (CRA) desires to use a portion of the funds in the Redevelopment Trust Fund for site improvement grants to allow the use of tax increment funding for projects within the redevelopment area; and WHEREAS, the CRA desires to specify qualified residential and commercial projects eligible for grant funding. NOW, THEREFORE, BE IT RESOL VED BY THE COLLI ER COUNTY COMMUNITY REDEVELOPMENT AGENCY THAT: SECTION I. Title. The grant programs shall be known as the Site Improvement, Commercial Building Improvement, Impact Fee Assistance, Landscape Improvement, Sweat Equity and Shoreline Stabilization Grants for the Bayshore Gateway Triangle Redevelopment Area. SECTION 2. Adoption of the Grant Pro~rams as Amended. There is hereby established, created and adopted, in accordance with the provisions of Collier County Ordinance No. 2008- 61, new Grant Application processes and Agreement documents for each of the Impact Fee Assistance and Commercial Building Improvement grant programs, attached hereto as Composite Exhibit A. SECTION 3. Administration bv CRA. After the Board of County Commissioners allocates grant funding for the fiscal year, the CRA shall approve grant recipients, grant funding and grant payment upon completion of work. The CRA delegates the administration of the grant program to the Executive Director and the Bayshore Gateway Triangle Local Redevelopment Advisory Board to include, but not to be limited to, application process and review, recommendation of recipients, monitoring grant progress, and recommending grant payment upon completion of work. The recipients of any grant funds shall be required to execute an agreement, a part of Composite Exhibit A, in the form approved by the County Attorney's Office for legal sufficiency and approved by the CRA. SECTION 4. RCDlacement ResolutioO. This Resolution replaces and supersedes CRA Resolution Number 06-253, adopted on September 26, 2006; CRA Resolution 07-55, adopted March 13, 2007; CRA ResoJution Number 08-316, adopted on October 28, 2008, and CRA Resolution 10-134 adopted on July 27,2010. SECTION S. Effective Date. This Resolution shall become effective immediately upon passage and adoption. TRIANGLE Commercial Building Improvement Grant Program The Commercial Building Improvement Grant Program (C-BIG) is a redevelopment initiative funded and administered by the Bayshore/Gateway Triangle Community Redevelopment Agency (CRA) as partial reimbursement for exterior and interior improvements to commercial buildings and assistance with Land Development Code conformity issues on commercial sites within the Redevelopment Area. Overview of the Program The C-BIG program funds exterior and interior improvements to qualified commercial buildings in the CRA, as well as sites that have non-conformity issues with the Land Development Code. Grantees may receive C-BIG funds on a 50% match basis, with a maximum reimbursement of$50.000. Funding for interior improvements (maximum award of $20,000) is contingent upon grantees performing exterior or conformity improvements. All improvements must be approved by the CRA prior to commencing any C-BIG- funded projects. All exterior improvements must have some component that is visible to the public, either from the public right-of-way or some other highly visible location. Grantees generally receive C-BIG funds in about 45 days after CRA statTvisit the site and review all project summary paperwork (see Required Paperwork for Reimbursement) and verify grantee eligibility. Any funds awarded for the confonnity program will require an equal match from the applicant, not to exceed $30,000 awarded, and shall tau the place of exterior and/or interior C-B/G funds of the same amount, not to exceed $/5,000 from either exterior or interior. The mllXimum llWard for C-B/G applicants is $50,000; $30,000 exterior/confonnity funds must be awarded prior to any applicant being considered for an llWard up to $20,000 in interior funds. Applicant Eligibility Tenants and owners of commercia I properties for which property taxes are paid to the current year and which are located within the CRA boundaries may be eligible to receive C-BIG funding. Not-for-profit. 501 (c) (3) and other private entities such as churches, social services, government agencies. etc., are not eligible for C-BIG funding but may be eligible for grants through the Site Improvement Grant program. Applicants must own a business or commercial property within the Redevelopment Area (See map in Appendix A). Eligibility criteria are as follows: · Applicants who are business owners must have a valid business tax receipt at the time of application. · Business owners who rent the building or unit space where their businesses are located must secure a signed Owner Authoriz..ation Form (attached) from the building owner to construct improvements. · All property taxes on the site must be current. A business site- defined as the folio number (parcel 10) of business location-may receive up to three C- BIGs, not to exceed the maximum allowable amount in effect at the time of the first application, subject to availability of funds. Once a business site has received its maximum funding, it is no longer eligible for further C-BIG funding for the remaining life of the program (subject to CRA funding availability). Bids for Work For each type of improvement to be funded, applicants must obtain a minimum of two bids by contractors from the list on the Collier County Contractor's Search page, located at htto://apos2.colliergov.net/webaoos/vision/ConCert/default.aspx . Bids from contractors not listed in this database will not be accepted for the C-BIG program unless they are licensed by the state of Florida and are bonded and insured with Collier County. The grant amount will be equal the sum of the lowest bids (not to exceed $50,000) by all contractors for each improvement though any contractor meeting the criteria above may be used. Required Documentation for Reimbursement Grant funds are disbursed after CRA stafTverify the improvements are complete (this includes review ofcertificates ofoccupancy and/or permits from Collier County). To receive reimbursement, grantees must prove that payment for the improvements was paid to contractor(s) as approved with the original application by check or credit card in the name of the grantee. Under no circumstance will payment to unlicensed contractors or subcontractors be reimbursed. Grantees must provide receipts and invoices with the payment amount indicated clearly and must also include dates of work performed. No reimbursement will be disbursed for work paid for with cash. All invoices must reconcile against payments. Project Requirements Exterior Improvements In order to be approved, exterior improvements must result in one or more of the following: (I) increase in the aesthetic appeal of the area; (2) improvement to the functionality of the premises; (3) remedy of structural problems or code violations or (4) aid in business operation. The grantee will be reimbursed for exterior improvements at a 50 percent match, up to a maximum award 01'$30,000. The following are examples of improvements eligible for grant funding. Fire code compliance · Any other improvements subject to CRA approval. Examples of other improvements which qualify for grant funding include the following: . Removal 0 f deteriorated materials · Parking lot improvements · Building cleaning (sand blasting/pressure washing) · Courtyard and outside dining development · Enhancement of access (e.g. wheelchair ramps) · Demolition required to build a new entrance to a building · Remediation of code violations . Landscaping. . Any other improvements subject to eRA approval. *Landscaping with invasive pest plants listed by the Florida Exotic Pest Plant Council is strictly prohibited (this list available from CRA). Landscaping techniques as outlined in Waterwise: South Florida Landscapes, published by the South Florida Water Management District is encouraged; free copies of this manual are available at the CRA otlice. Special assistance for landscaping is available free of charge through Collier County Extension Services. Contact a master gardener by calling (239) 353-4244. Conformity Improvements The Conformity Program provides financial assistance to commercial projects in the Bayshore Gateway Triangle CRA for sites that have been recognized as non-conforming and have been vacant for a period of time, or are found to not meet minimum development standards as set forth in the Colfier County Land Development Code. A hardship is created with non-conforming sites because the size or shape of the lot, location of the building, etc. makes it impossible or not profitable to improve the site according to standards. The applicant will be eligible on a per site basis, based on a determination of merit, economic feasibility and the resulting end-product of the project. Parcels that are deemed to be nonconforming in lot size by the Growth Management Division shall be considered for additional property acquisition if the landowner is able to reach an agreement with adjacent property owners to either acquire an additional parcel of neighboring property, or go through a Lot Line Adjustment application. Properties that are awarded funds to remedy lot size should be legally conforming lots once the additional property is acquired. Funds used to remedy any nonconformity issue shall result in the issue being made conforming to current Code standards. Examples: FEMA elevation requirements, fire code, ADA accessibility, storm water, transportation access issues, etc. Interior Improvements Grantees who wish to improve the interior ofapproved commercial properties may be reimbursed for that work through the C-BIG program only if they earn the maximum dollar award for exterior improvements, or some combination of exterior and conformity improvements. Interior projects must be approved at the same time as exterior projects and will be reimbursed at a 50 percent match, up to a maximum award of$20,OOO. A grantee who fails to perform enough exterior/conformity improvements to earn the maximum grant amount will forfeit all reimbursement for interior improvements. All documentation requirements for exterior improvements also apply to interior improvements (see Bids for Work and Required Documentation for Reimbursement above). The following is a complete list of qualified interior improvements · Asbestos removal . Improvements necessary for ADA- · Paint associated with wall compliance repair/replacement . Flooring upgrades and replacement · Electrical work to meet code . Ceiling upgrades or repair. requirements . Wall upgrades and replacement · Plumbing to meet code requirements . Interior fire code compliance · Termite damage repair . Interior sprinkler systems as required · Lighting improvements by code No other interior improvements will be approved for funding. NOTE: Projects listed below are ineligible for C-BIG funding. · The removal of architecturally important details; · Installation of aluminum or vinyl siding; · Improvements commenced prior to execution of agreement with eRA; · Purchase or installation of statues or fountains; · Any work by non-licensed contractors; · Construction of free-standing buildings (including construction of new rooms to existing structures); · Refinancing of debt; · Non-fixed improvements; and · Sweat equity. 4 Bay.hare Gateway Triangle eRA Commercial BuDding Improvement Grant .', ~ _, ,i)1'1,','IBtXl~~~E _ J1G TRIANGlI Change Orders and Time Extensions Change Orders to Increase Funding After a C-BIG agreement is executed, if a grantee discovers flaws in the building related to approved exterior or interior improvements, a change order may be issued to increase funding not to exceed the maximum award available. Change orders must be requested in time for staff to process the request and secure approval (allow a minimum of one month prior to expiration of grant). As with the original application, all work requested under the change order must be pre-approved with an amended agreement prior to starting work on these items. IMPORTANT: change orders cannot be processed within the last two weeks of the grant period. Upon successfully completing work under the original C-BIG, if the maximum funding amounts have not been met, grantees must wait one year and may then apply for additional funding for work unrelated to the original improvement[s]. Time Extensions The CRA understands that redevelopment projects can take more time to complete than is originally anticipated. For grantees who cannot complete their projects within one year, time extensions may be granted. Grantees needing extensions must request the extension within two months of the grant's expiration. Note: no extensions can be granted within the last two weeks of the grant period. Funding Levels and Matching Requirements Base Funding The base maximum grant award is $50,000 with the following breakdown of funding: I) $30,000 in SO/50 matching funds for exterior improvements; 2) $20,000 in 50/50 matching funds for interior improvements -absolutely no funding for interior improvements will be permitted if grantee does not perform a minimum of$60,000 of exterior improvements; 3) Up to $30,000 in conformity improvements may be debited from exterior and/or interior improvements in 50/50 matching funds, not to exceed $15,000 from either category. Grantee acknowledges to the CRA that Grantee has received a copy of the Collier County Community Redevelopment Agency Commercial Building Improvement Grant Program Information and Application (hereinafter referred to as "Grant Program"), that Grantee has read the Grant Program, and that Grantee has had ample opportunity to discuss the Grant Program with Grantee's counselor advisor. Grantee further acknowledges to the CRA that Grantee understands and agrees to abide by all of the terms and conditions of the Grant Program. Grantee agrees to the terms and conditions of the Grant Program. 2. Grantee is the record owner / tenant of property described as 3. The CRA has approved a grant to Grantee in the amount of to be administered pursuant to the terms of this Agreement based on an estimated cost of . Unless prior disclosure is included in the grant application, no Grantee, or any immediate relative of Grantee, shall serve as a contractor or subcontractor for the construction of the improvements and no Grantee, or any immediate relative of Grantee, shall receive compensation for labor for the construction of the improvements. An immediate relative of Grantee shall include mother, father, brother, sister, son, daughter, aunt, uncle and cousin or family member by marriage to include mother-in-law, father-in-law, brother-in-law and sister-in- law. Grantee has verified that all contractors who have provided bids for the approved work are actively licensed by Collier County or the State of Florida. Grantee acknowledges that the total grant award shall not exceed the sum oflowest bids/price quotes for all projects. Grant funds for work performed by contractors shall only be disbursed upon verification that said contractors are actively licensed by Collier County or the State of Florida. 7. Grantee agrees to obtain all necessary permits and submit any required plans to the County's Growth Management Division. Upon completion of the work, Grantee shall submit to the CRA staff a Project Summary Report, two (2) 8 inch by 10 inch photos showing the improvements, a list of materials and construction techniques used, a list of architects and/or contractors, and any other information specific to the project or requested by the CRA staff. The CRA, through its stan: shall confirm that the Commercial Building Improvements were constructed pursuant to the terms of the application approved by the CRA. 8. Within forty-five (45) days after confirmation that the improvements were constructed pursuant to the terms of the approved application, the Grantee shall be issued a check in the amount of the grant. However, if the Grantee fails to make the improvements pursuant to the terms of the approved application, or if the improvements are not completed within one (I) year of CRA approval, the grant shall be deemed revoked and Grantee shall not be entitled to funding. 9. This Agreement shall be governed and construed pursuant to the laws of the State of Florida. 10. This Agreement contains the entire agreement of the parties and their representatives and agents, and incorporates all prior understandings, whether oral or written. No change, modification or amendment, or any representation, promise or condition, or any waiver, to this Agreement shall be binding unless in writing and signed by a duly authorized officer of the party to be charged. The program has been established to encourage construction of new detached single-family homes that support the objectives of the adopted redevelopment plan. Improvements to existing structures may be funded through the Site Improvement Grant Program (see separate application). The CRA is partially funded by Tax Increment Financing (TlF). TJF is a unique tool that eRA's can use to leverage public funds and to promote private sector activity. For each project, the CRA will provide an impact fee assistance grant of up to $10,000 per new detached single-family home. For parcels having impact fee credits, the CRA will provide an impact fee assistance grant of 50% of the remaining impact fees after the credits have been applied, not to exceed $10,000. There is a maximum amount of funding allocated each year for impact fee assistance, so the program is managed on a "first come, first served". Impact fee deferrals may also be available through the Collier County Housing, Human and Veteran Services SHIP program for low and very low-income first time homebuyers. All applicants must contact the Collier County Impact Fee Coordinator for an estimate of expected impact fees. CRA staff: the Impact Fee Coordinator and the Bayshore/Gateway Triangle Local Redevelopment Advisory Board will review applications and make a recommendation for assistance to the Community Redevelopment Agency Board. The CRA Board will issue final approval and authori7-c expenditure of funds. This is a reimbursement program to the builder/owner, to be paid at the receipt of Certificate of Occupancy (CO). The grant application must be submitted, reviewed by the Advisory Board and approved by the CRA Board prior to submittal of building permit. No "after the fact" applications will be accepted. Applications will not be accepted after all CRA Grant Program funds are depleted. All work must be completed within one year of approval by eRA. Applicants are reouired to consult with CRA staff and the Impact Fee Coordinator prior to submittal of application. This grant is not available for mobile homes, manutactured/modular homes, apartments, duplexes, multi-family units (townhomes, common wall housing). Also residential units within a Planned Unit Development (PUD) or approved Mixed Use Project (MUP), or projects utilizing CRA density bonus units are not eligible for this grant program. Residential developers of multiple detached single-family parcels may apply for and receive up to four (4) Impact Fee Assistance Grants in any calendar year (up to $40,000 in impact fee assistance). All conditions apply to each grant-awarded parcel. Prior to re-application for additional parcels, one or more of the previous grant-authorized parcels must receive a Certificate of Occupancy and be deeded to a residential owner (an occupant/owner other than the development company). Grants funds may be used for: · Payment ofimpact fees related to a single project · Detached single family residential projects Grant funds may DQt be used for: · Working capital or administrative costs (payroll, rent, utilities, etc.) · Renovations or code compliance (other grants are available for these costs) . Demolition . Loans or other capital support Project Evaluation All projects will be evaluated based upon the following: . Applicant's financial contribution . Quality of the proposed housing product · Applicant has funding and is prepared to begin permitting process and hiring of qualified contractors immediately following CRA approval · Ability to complete project within one year · Compliance with objectives of adopted redevelopment plan and any applicable development standards and/or zoning overlays. Any alterations in the project must be approved by the CRA to avoid revocation of funding. Major changes to the project that significantly changes the impact fee amount may jeopardize funding. In all cases, the eRA contribution cannot be higher than 50% of the total impact fees (after impact fee credits are applied - ifapplicable), nor exceed the maximum grant amount of$IO,OOO. Participation in this program is contingent upon annual funding of the CRA Grant Programs.
