BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that Section 106.3 of Chapter 7 S3 of the Code of Collier County, Florida be amended to read as follows: SECTION ONE: "Section 106.3. Conditions of the Permit. The Building Official shall act upon an application' for a permit with plans as filed, or as amended, without unreasonable or unnecessary delay. A permit issued shall be construed to be a license to proceed with the work and shall not be construed as authority to violate, cancel, alter, or set aside any of the provisions of this code, or other ordinance, rule or statute, nor shall such issuance of a permit prevent the Building Official from thereafter requiring a correction of errors in plans or in construction, or of violations of this code or other ordinance, rule or statute. Any permit issued shall become invalid unless the work authorized by it shall have been actually commenced in the field within six months after its issuance, or if the work authorized by such permit is suspended or abandoned for a period of six months after the time the work is commenced; provided, that, within such period of validity, one extension of time, for a period not exceeding ninety days may be authorized by the Building Official and one additional extension of ninety (90) days may be authorized by the Board of County Commissioners. Each building permit issued or outstanding for a period of twelve (12) months, and any building permit not extended within its period of validity, is automatically null, void and of no force or effect. Ail permits in effect at the time of passage of this Ordinance that have been in effect for more than twelve (12) months and upon which no active construction has commenced are herewith canceled unless prior extension has been given by the Board of County Commissioners. SECTION TWO: This Ordinance shall become effective upon becoming la SECTION THREE: Instructions to Clerk: The Clerk shall: 1. Cause publication of "Notice of Intent to consider Ordinance" by publishing it in its entirety one (1) time at least fifteen (15) days before, and schedule its public hearing;' excluding Sundays ~nd legal holidays. 2. Send a certified copy to the Department of State within ten (10) days after its enactment.
