AN ORDINANCE TO REGULATE THE
USE OF CAMPERS, VANS, TENTS,
SLEEPING BAGS AND OTHER MOBILE
OR PORTABLE SLEEPING FACILITIES
OR EQUIPMENT UPON PUBLIC AND
PRIVATE LAND WITHIN ONE (1)
MILE OF THE GULF OF MEXICO NOT
CONTAINED WITHIN, OR ACCESSORY
TO AN APPROVED MOBILE HOME PARK,
OR CAMP GROUND; PROVIDING EXCEP-
TIONS; PROVIDING PENALTY, SAVINGS
AND CONFLICT CLAUSES; AND PROVI-
DING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF'COUNT.Y COMMISSIONERS OF COLLIER
COUNTY, FLORIDA;
SECTION ONE:
1. Definitions for the purpose of this Ordinance:
a. "Mobile Sl~epin~ Facility or Equipment" includes,
but is not limi.ted to, any Vehicle including a mobile home,
trailer, camper, covered van, truck or bus, tractor, boat
on a trailer, or other vehicle or automobile designed,
equipped 'or used for overnighting, spending the nightime
hour~, sleeping, or for use as living quarters.
b. "Portable Sleeping Facility or'Equipment" includes,
but ~s not limited ~6 a tent, sleeping bag or similar item.
or items designed, used or suitable for shelter, over-
nighting, sleeping or living in the open.
2. Area of Application..
This Ordinance shall apply to the unincorporated'area of
Collier County, Florida within one (1) mile of the Gulf of Mexico.
3. Unlawful to camp on private property without owners'
consent:
It shall be unlawful for any person to occupy, or to allow,
permit or cause to be parked, pitched, placed or e~ected upon the
land of another without the prior expressed consent of the owner
any "mobile or portable sleeping facility or equipment" as defined
above.
4. Mobile and Portable Sleeping Equipment Prohibited.
It shall be unlawful during the period of time beginning
thirty (30) minutes before.sunset until thirty (30) minutes after
sunrise each day for any person to occupy or to cause to be parked,
pitched, placed or erected any "mobile cz portable sleeping facility
or equipment" upon any public road right-of-way, park, beach or other
property or upon private land within the unincorporated area of
Collier County except as follows:
a. Within a mobile home or trailer park or campground.
or facility designated as such or otherwise permitted in
accordance with the Collier County Zoning Regulations and
certified by the Collier County Health Department as meeting
current State health standards, or
b. Such person prominently displays between any such
vehiclg, equipment or facility and the nearest commonly used
road, path, trail or walkway a current permit issued by the
County Zoning and' llealth Departments that the facility meets
the minimum sanitary and health standards of %he State Depart-
ment of Health. Such permit shall describe the person(s)
vehicle, location upon which parking shall be permitted and
the permitted period of time.
SECTION TWO:
1. Penalty. Any person violating th~ provisions of this
Ordinance shall be guilty of a misdemeanor and upon conviction
shall be punished as provided by general law.
2. Severance. If any portion of this Ordinance '.is declared
unconstitutiOnal o~ held invalid in application, the validity of
the remaining portions and applicability to other persons and
circumstances shall not be affected thereby.
3. Conflict. Should any provision of this Ordinance conflict
with other ordinances, codes or law, the more restrictive shall apply.
4. Effective Date. The provisions of this Ordinance shall
become effective upon receipt that this Ordinanc~ has been filed with
the Department of State.
