WHEREAS, there is a recognized need for low and middle
income housing for the elderly and such persons are known to
require less parking space, open space, and floor area than
the general public due in part to their limited income and
mobility.
NOW, THEREFORE BE IT RESOLVED BY T~E-BOARD O~COUNTY
COMMISSIONERS OF COLLIER COUNT~, lmLORIDA:'
SECTION ONE:
That Paragraph 8.b. of Ordinan'ce No. 73-13 be amended
by the addition of the following language:
The Board of County Commissioners, sitting as a Board of
Zoning Appeals, may grant an exception within multi-family
3 and 4 areas to permit the construction and use of multi-
family residences in compliance with the Federal Government
"236 Program", or similar federal program, as amended under
the following conditions:
1) The maximum income and minimum age limits
specified for "236 Programs" are incorporated in all
Charters or Bylaws, Agreements and Covenants for
loans, mortgages and other commitments to finance the
project.
2) The Board of County Commissioners finds that:
a) Adequate utility, recreational shopping and
transportation services are available within walking
distance from the residences for the normal occupant;
b) Personal and medical services are available
within the general area;
c) The requirements of ~cher applicable Federal,
S~ate and Local law are complied with.
3) The automobile parking, minimum floor area and
occupancy of such "236 Program" multi"family living units
shall meet Federal "236 Program" requirements or the !
following whichever are the more restrictive:
a) Multi-family efficiency apartments with a
minimum "net rentable floor area" of 410 square
feet, for use by a maximum of two (2) persons
least one of whom is a minimum of sixty-two
years Of age~ or
,~) Multi-f~mily one bedroom apartments with a
minimum "net rentable floor area" of 532 square feet
for use by a maximum of three (3) persons at least
one of whom is a minimum of sixty-two (62) years
of age.
SECTION TWO:
1. Should any portion or provision of this ~rdinance,
or Amendments thereto,
a. Conflict with any oth?r law the more restrictive shall
apply;
b. Be held invalid by a court of competent Jurisdic-
tion such holding shall not affect the validity of any
other portion or provision or its application to other
parties or circumstances.
2. Be it declared that an emergency exists and the
~immediate enactment of this Ordinance is.necessary, therefore,
notice requirements are waived and this Ordinance shall take
effect immediately upon its' placement in the United States
mail to the Secretary of State.
