~EREAS, the Coastal Area Planning Commission of Collier
County, Florida, petitioned the Board of County Commissioners of
Collier County, Florida, to amend the Comprehensive. Zoning
Regulations for the unincorporated area of the Coastal Area
Planning District of Collier County, Florida, as hereinafter
described:
NOW TIIEREFORE BE IT ORDAINED By THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA~
SECTION ONE:
The Comprehensive Zoning Regulations for the unincorporated
area of the Coastal Area Planning District of Collier County,
Florida, Ordinance No. 74-42 and Ordinance No. 75-24 are
amended as hereinafter described:
SECTION 21, "RS" RESIDENTIAL SINGLE FAMILY is amended by amending
Paragraph 2.B(1) as follows:
(1) Private boat houses and docks, with or without
boat hoists, on canal or water way lots, not protrudi~g
more than five (5) feet into the canal or waterway,
unless such canal or water way has a width of o~e
hundred (100) feet or more, then the dock may

by amending Paragraph 2.B(4) as follows~

hundred (100) feet or more, then the dock may protrude
twenty *(20) feet into such canal or water way or such

or configuration or some other natural condition.
No boat dock or boat house may be used as a residence.
All docks, regardless of length, shall have reflectors
four (4") inches minimum size installed at the outermost
end, on both sides.
SECTION 23, "RM-2" RESIDENTIAL MULTI-F~4ILY DISTRICT is amended
by amending Paragraph 2.B.5 as follows~
5. Private boat houses and docks, with or without
boat hoists, on canal or water way lots, not protruding
more than five (5) feet into the canal or waterway,
unless such canal or water way has a width of one
hundred (100) feet or more, then the dock may protrude
twenty (20) feet into such canal or water way or such
additional length as may be justified to the Director
based on water depth, currents, unusual land'contour
or configuration or some other natural conditions.
No boat house may be used as a residence.
All docks regardless of length, shall have reflectors
four (4") inches minimum size ins~alled at the outermost
end, on both sides.
SECTION 25, "RT" RESIDENTIAL TOURIST DISTRICT is amended by amending
Paragraph 2.B(5) as follows:
(5) Private boat houses and docks, with or without
boat hoists, on canal or waterway lots, not protruding
more than five (5) feet into the canal or waterway,
unless such canal or water way has a width of one
hundred (100) feet or more, then the dock may protrude
twenty (20) feet into such canal or water way or such
additional length as may be Justified to the Director
based on water depth, currents, unusual land contour
or configuration or some other natural condition.

SECTION 28, "MHSD" MBOILE HO~ SUBDIVISION DISTRICT is amended by

service buildings, utilities, and additions which
compliment the mobile home.

boat hoists, on canal or water way lots, not protruding
more than five (5) feet into the canal or waterway,
unless such canal or water way has a width of one
hundred (100) feet or more, then the dock may protrude
twenty (20) feet into such canal or water way or such
additional length as may be justified to the Director
based on water depth; currents, unusual land contour
or configuration or some other natural condition.
No boat or boat house may be used as a residence. '

SECTION 29, "MHRP" M(;BILE HOME RENTAL PARK, iS amended by
amending Paragraph 2.B as follows:

hundred (100) feet or more, then the dock may protrude
twenty (20) feet into such canal or waterway_or such

SECTION 34, "GRC" GENERAL RETAIL COM~ERCIAL is amended by
amending Paragraph 2.B as follows:

SECTION TWO:
This Ordinance is enacted pursuant to the provisions
of Florida Statutes ~ection 125.66(3) upon a finding and
declaration by the Board of County Commissioners that an
emergency exists and immediate enactment of this Ordinance
is necessary. This Ordinance shall become effective
immediately upon its placement, by certified mail, in the
United States,mail to the Secretary of State.
