WHEREAS, Mr. James Topping, representing Forest Lakes Golf &
Country Club, Inc., owners of the property hereinafter described,
petitioned the Board of County Commissioners of Collier County,
Florida, to change the zoning classification of the real property
hereinafter described.
.NOW THEP~EFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
1. The Zoning Classification of the herein below described real
property in Collier COuntyr.-Flomi. da, is changed from "GC" Golf
Course to "RM-2" Residential Multi-Family and the Official Zoning
Atlas described in Section 4 of Ordinanc~ No. 74-42 & 75-24 is
hereby amended accordingly.
A parcel of land in Section 14, Township 49 South, Ra~ 2~Ea~

SECTION ~0:
1. Penalty. A violation of any provision of .this Ordinance
is a misdemeanor and shall be prosecuted in the name of the State
in the County Court by the Prosecuting Attorney, and upot conviction
shall, be punished by a fine not to exceed $500.00 or by imprisonment
in the County Jail not to exceed sixty (60) days, or by both such
fine and imprisonment. Each .violation and each day a violation
continues shall constitute a separate offense. The Board of County
Commissioners shall have the power to collaterally enforce the
provisions of this Ordinance by appropriate Judicial Writ or
proceeding notwithstanding any prosecutio~ as a misdemeanor.
2. Conflict. In the ~vent this Ordinance conflicts with any
other ordinance of Collier County or other applicable law, the
more restrictive shall apply. This Ordinance shall not apply in
any municipality within Collier County unless the municipality
adopts a resolution or takes other official action requesting
that the County enforce this Ordinance within the limits of its
municipal jurisdiction.
3. Severance. If any phrase or portion of this Ordinance is
for any reason held invalid or unconstitutional by any court
of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding
shall not affect the validity of the remaining portion.
4. Liberal Construction.~he provisions of this Ordinance
shall be liberally construed t~ effectively carry out
purposes in the interest of th~ public h~alth, safety, welfare
and convenience.
Effective Date. This Ordinance shall take effect upon
rccelpt.of notice that it has' been filed with the Secretary of
State.
