AN ORDINANCE AMENDING SECTION 42 OF COLLIER
COUNTY ORDINANCE NO. 74-42 EMPOWERING THE
BOARD OF COUNTY CO~4ISSIONERS TO ESTABLISH
FEES TO DEFRAY COSTS OF PROCESSING REQUESTS,
PETITIONS AND PERMITS RE~LATED TO LAND USE
REGULATION INCLUDIHG AMENDM/~NT OF THE COM-
PREHENSIVE PLAN, CHANGE OF ZONING DISTRICT
BOUNDARIES, TEMPORARY USES, SUBDIVIDING AND
PLATTING,REVIEW AND THE COSTS OF REVIEWING
EACH PLANNED UNIT DEVELOPMENTt ENVIRONMENTAL
IMPACT STATEMENT~ SUBDIVISION AND OTHER
REVIEWS; ESTABLISHING FEES FOR ANY APPEAL
FROM AN ADMINISTRATIVE DECISION, REQUEST
FOR A VARIANCE AND SPECIAL USE PERMIT; AND
FOR PUBLISHING AND REPRODUCING MAPS, REPORTS
AND OTHER DOCUMENTS; PROVIDING CONFLICT,
SEVERANCE AND CONSTRUCTION CLAUSES; PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA that Section'42 of the Collier County
Zoning Ordinance No. 74-42 be and is hereby amended to read
as follows:
SECTION ONE:
"1. The Board of County Commissioners is hereby authorized
and empowered to establish and revise from time to time by
Resolution schedules Of fees to be charged to defray the cost
of administering land use regulations including mn~nt of
the Comprehensive Plan, change of zoning district boundaries,
temporary uses, subdividing and platting review and the costs.
impact statement; subdivision and other reviews; establ i
fees for any appeal from an administrative decision, ~_es~ ~
for a variance and special use permit~ and for publis~-~
reproducing maps, reports and other documents. ~ ~
2. Such fees shall be reasonably related to the total
expenses involved in administration of land use re, ~lations
including the planning, zoning, building and related depart-
ments without specific reference to any particular permit
and without any cost accounting records rel'ating to any parti-
cular permit and shall be non-refundable.
37 No such request, peti~io~ or applicat~on shall be
complete without first having paid the fee established under
the authority of this Ordinance.
4. The Board of County Commissioners may waive any
such filing fee for an applicant upon presentation of a certi-
ficate from the County Welfare Department stating the applicant
is qualified to receive Federal, State or County welfare assis-
tance, and is unable to afford the fee. .
SECTION TWO~
~pnflict! Severance and Construction.
In the event any fee established under the authority of
this Ordinance conflicts with the amo%mt of a fee established
by other law the greater fee shall apply. If any part of
this Ordinance conflicts wi~h any other part it shall be
severed.
If any phrase or portion of th~a Ordinance is for any
reason h~ld invalid or unconstitutional by any court of
competent Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
The provisions of this Ordinanoo shall be liberally
con~trued to effectively carry out its purposes in the interest
of the public health, safoty~ welfare and oonvenience.
SECTION THREE~
Effective Date.
This Ordinance shall take effect upon receipt of notice
that it has been filed with the Secretary of State.
