~IEREAS, the original survey of the land upon which Port
Au Prince development has been constructed was erroneous, and
~{EREAS, the error in the survey has prevented the owners
of said ~and from dedicating the roads therein to the public, and
WHEREAS, the inability to ~edicata said roads to the public
has caused them to become dstericrated and nearly ~passable, and
~{E~AS~ the defective condftiona of the roadway have, at
times, caused stoppages of school bus pickup thereby endangering
the lives of those children living in Port Au Prince, and
~{E~AS, a rosurvuy of the Port Au Prince Subdiv~on Is
necessary tn an accurate d~dioation of the roadway~ to the public,
and
~{E~, title to the entering roadway must bm purchased
prior to ~edtoation to the p~Xlo.

SECTION ONE~ Purpose.
The purpose of thi. Ordinance i. to facilitate the ~ic~on

SECTION TIIREE~ Taxing Power,
Tho Municipal Services Taxing Dlstr~ct il hereby empowmred to
levy an ad valorem tax not to exceed 8 mills in any one fiscal year.
SECTION FOUR~ Coverning Board~ Powers and Duties.
The Governing Board of the Port ~u Prince l{unicipal Se~vicel
Taxing District shall be the Board of County Comissioners o£
Collier County, Florida. The Board shall possess the power and
duty to conduct the affairs of the District as prescrib, d by law.
S~CTION FI~ Severability.
If any port,on, phrase or wor~ of this Ordinance is held
invalid or ~constitut~onal, the re~n~ng parts shall no~ ~
affected.
SECTION SIX~ Emergency Enactment of Ordinance.
The Board of County Commissioners at its Regu}.ar Meeting
has waived all notice requirements of the Florida Statutes by
at least 4/Sths vote of its membership. It has found that In emergency
exists and that lnvnediate enactment of this Ordinance is necellary.
SECTION SEVENt Effective Date.
This Ordinance shall take effect upon being accepted by the
Postal Authorities of the Government of the United States for
special delivery by registered mail to the Department of State.
