UTILITY EASEMENT
THIS EASEMENT, made and entered into this ~ day of NW'MAbl-t ,2010, byGB PENINSULA,
LTD., a Florida limited patnership in its capacity as debtor-in-possession, in jointly administered Case
No. 9:10-bk-03846 United States Bankruptcy Court Middle District of Florida (hereinafter referred to as
the "Grantor"), whose post office address is 8156 Fiddler's Creek Parkway, Naples, Florida 34114, to the
BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF
COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER
DISTRICT (hereinafter referred to as the "Grantee"), 3301 East Tamiami Trail, Naples, ROOda 34112, its
successors and assigns. (Wherever used herein the terms "Grantors" and "Grantee" include all the
parties to this instrument and their respective heirs, legal representatives, successors or assigns.)
WIT N E SSE T H:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration paid
by the Grantee, the receipt and sufficiency of which is hereby acknowledged, hereby conveys,
grants. bargains and sells unto the Grantee. its successors and assigns, a perpetual, non-exclusive
easement for utility and maintenance fadities purposes, and access, on the following described lands
located in Collier County, Florida, to wit:
See attached Exhibit "A" which is incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter upon said
land, excavate, and place or remove materials for the purpose of constructing. operating and
maintaining utiRty Ones, pipes, and other associated equipment or improvements appurtenant thereto
or thereunder. Access and maintenance rights are granted throughout the entire easement area,
with installation of utBity lines, pipes, and other associated utility equipment or improvements limited to
the southem half of the easement area. Grantee agrees that it shall, at the Grantee's cost, repair any
damage caused to Grantor's property as a result of Grantee's construction activities, and. at the
conclusion of construction, to restore the surface of the lands to the condition existing prior to the
commencement of construction. Grantor and Grantee are used for singular or plural, as the context
requires. The easement granted herein shall constitute easements running with the land and shall
burden the lands described above.
