Ordinance 76-47' ' ~ ~% AN ORDINANCE SETTING LEGAL HOURS OF SALE '
~~REAS, a need exists for the regulation of times of
opening and closing establishments wherein alcoholic beverages
are sold within the unincorporated areas of Collier County;
WHEREAS, the Board of County Commissioners has been
given authority under Florida Statute 562.14(1) to promulgate
such regulations.
NOW, TZ~REFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
A. That in all unincorporated areas of Collier County,
except former County Commission District 5 of this County,
more particularly described as:
Deginning at the Northwest corner of Township 46 South
Range 23 East, Tallahassea Meridian, Collier County,
Florida, thence East along the Township Line betH~_~D
Township 45 and 46 South to the Northeast corner ~
Township 46 South, Range 30 East; thence South al~
the Range Line between Ranges 30 and 31 to the Noah-
west corner of Township 49 South,Range 31 East; t~6e
East along the Township Line between Townships 48~d
49 South, to the Northeast corner of Township 49 ..~th,~
Range 34 East; thence South along the Range Line ~ween,
Ranges 34 and 35 East to the centerline of Alliga
Alley (SR84); thence West along the centerline of
Alligator Alley (SR84) to the Range Line between Ranges
27 and 28 East; thence North along the Range Line
between Ranges 27 and 28 East to the Township Line
between Townships .48 and 49; thence West along the
Township Line between 48 and 49 South to the Range
Line between Ranges 26 and 27 South to the Township
Line between Townships 46 and 47 South; thence East
along the Township Line between To~nships 46 and 47
South to the Range Line between Ranges 27 and 28 to
the Township Line between Townships 45 and 46 South,
being the Point of Beginning.
the legal hours of sale of alcoholic 'beverages by persons, firms,
or corporations holding licenses under the State Beverage
Department of tha State of Florida, as alcoholic beverages are
defined in Florida Statutes Chapter 561, shall be from 7:00 A.M.
until 2:00 A.M. following, seven (7) days per week. In
former County Commission District 5 of this County, legal hours
of sale shall be from 8:00 A.M. until 2:00 A.M., Monday through
Saturday, and from 1=00 P.M. until the following 2=00 A.M. on
Sunday.
B. The sale of alcoholic beverages during hours other
than as indicated above is unlawful.
SECTION TWO=
That certain Resolution of the Board of County Commissioners
of Collier County, Florida dated March 17, 1965 and recorded
in Comm£ssionerst Minute Book 8, Pages 328-329, is hereby
rescinded' and repealed.
SECTION THREE=
Ordinance 76-16 is hereby repealed.
SECTION FOUR= EMERGENCY
Be it declared that an emergency exists and the immediate
enactment of this Ordinance ia necessary, therefore, notice
requirements are waived and this Ordinance shall take effect
immediate upon its placement in the United States mail to
the Secretary of State.
SECTION FIVEr
?enalt~. Violation of this Ordinance i~ punishable as
provided by law for the violations of county ordinances. Each
day an offense exists shall be considered a separate offense.
Prosecution as a misdemeanor shall not preclude othe= remedies
available in ]aw and equity.
SECTION SIX=
This Ordinance shall become effective immediately upon
deposit in the U.S. Mail.
