Assistant County Attorney Wilson advised that one of the powers of the Board is to instruct certain steps be taken, and those instructions have the Power of law. She said it is a Power the Board has, however. it is not a reqUirement. She stated if the Respondents have a difference of opinion, an appeal to the Circuit Court is then appropriate at which time the COurt can advise on who is right on that POsition. She then diSPuted Attorney Ezatoff's arguments With respect to due process, stating that sUfficient notice was given regarding the ViOlation, therefore, the Respondents were given an opportunity to correct the situation. She added the Respondents were given an additional opportunity through the Board's Order to correct the Violations before a fine was imposed. She concluded by stating she would be happy to defend the County'S POsition on that point in Court if necessary. MOTIOl!: Mr. Lazarus communicated that he has two problems with the previous Order. He said one deals with the ownership issue and in his opinion, an Order needs to be iSsued which very speCifically states that it is the Respondent who is responsible. He adVised the Order should be amended to state the Respondent caused the viOlation. not the property. He mentioned the second problem is with regard to the date of the Order and the date of compliance. He accepted responsibility for signing the Order several days after the March 28th meeting. In a deSire to be fair to the Respondents and also to be conservative so there will be no pOSSibility that it be overruled, he suggested the Order be amended to reflect the effective date be the date of this request for rehearing, in effect, April 25, 1991. She asked if Attorney Ezatoff had any rebuttal evidence to provide the Board, so the issue does not remain outstanding? Attorney Ezatoff noted that in his oPinion, it is not a question of rebuttal evidence, since it is the Respondents' Position that there was no evidence presented that would establish the legal descrip- tion as set forth as the property at issue, or the designated owner is the owner of that property. He advised that since this potentially has the effect of resulting in a lien on the property described, he believes it is the County'S burden to demonstrate that that is the property of concern. ASSistant County Attorney Mafialich suggested to provide fleXibility, that the motion indicate the effective date of the Order be the date it is eXe- cuted. Mr. Andrews amended his motion to reflect that the Order be effective on the date of its execution. Seconded by Mr. Pedone. Carried 4/0 (Messrs. Constantine and Strain abstained).
