FLORIDA, AMENDING SECTION 8 SUPPLEMENTARY
DISTRICT REGUI.ATIONS BY ADDING SUBSECTION 23
AS HEREINAFTER DESCRIBED AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, The Coastal Area Planning Commission of Collier
County, Florida petitioned the Board of County Commissioners of
Collier County, Florida to amend Section 8 of the Comprehensive
Zoning Regulations for the Unincorporated Areas of the Coastal
Area Planning District of Collier County, Florida as hereinafter
described,

COmmISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
1. The Comprehensive Zonin9 Regulations for the unincorporated
areas of the Coastal Area Plannin9 District of Collier County,
Florida and Ordinance No. 74-42 and 75-24, Section 8 is amended
as hereinafter described:
23. Private Airports: The following regulations apply to the
location and layodt, of private airports:
A. Definitions - For the purpose of this Section, the
following definitions shall apply:
(1) Airport Hazards - (See Section 10.2 C)
(2) Approach Zone - a trapezoidal area increasing
at a rate of 1:10 in width from 50 feet either side of thee...

B. Control of Airspace:
The applicant must control the airspace within 700
feet from the ends of the primary surface(s). This control is
to prevent any airport hazards from being grown, erected or
otherwise placed within a glide path of 20:1 from the ends of
the primary surface(s). T~is control may be created by owner-
ship, right-of-way, easement, or a combination of these.
C. Minimum Yards:
(1) Setback primary surface - 200 feet
(2) Other structures - Other structures must conform
with setbacks of the base zone, however, they may not be

plac~d within 50 feet of the primary surface.
D. Location - Private airports shall be located in accordance
with Chapter 14-60 of the Florida Administration Code.
E. Findings - Before a private airport shall be recommended
for approval to the Board, the Planning Commission shal: make a
written finding that satisfactory provisions and arrangements have
been made concerning the following matters, where applicable:
(l) Compliance with Section 10.5 and 39.8 of the
Zoning Ordinance.
(2) General compatibilitx with adjacent properties and
other properties in the district.
(3) Storage of volatile materials.
(4) Safety and fire equipment.
(5) Airport hazards.
(6) Airplane tiedowns.
(7) Control of airspace
(8) Compliance with all elements of the Comprehensive
Plan.
F. Conditions and Safeguards - In recommending approval of
any private airport, the Planning Commission may also recommend
appropriate conditions and safeguards in conformity with this
Zoning Ordinance.
Any private airport use shall expire twelve (12) months
from the date of the granting of the zoning unless a photostatic
(or other suitable) copy of the Florida Department of Transportation's
Airport I.iccnse is presented to the Director of Community
Development. A twelve (12) month extension may be granted by the
Director upon receipt of just cause.
SECTIO~ TWO:
This Ordinance shall t~ake effect upon receipt of notice that
it has bccn filed with the Secretary of State.
